I successfull dealt with LVNV and got something removed from my credit reports. Smile

After I initially wrote them a letter notifying them the original debt was older than 7 years, they wrote me back from on of their other company names-Resurgent Capitol.

I then wrote Resurgent Capitol and gave them the same documentation. (Return Receipt on everything of course).

I also disputed everything from LVNV with all 3 credit bureaus.

Within 2 months, it was gone.

It took a LONG time to track down the original debt and several phone calls, but I figured it out and am a happier man!

If a lawsuit has been filed you must file an answer to the complaint within the time period stated on the complaint.

I have also been sued by LVNV and should be getting a notice of a court date within a few weeks. The account they are trying to collect is an account that I never opened, used or received any statements on. There has been nothing that has appeared on my credit report as the SSN attached to the account is not mine.

Through discovery I requested all documentation of the account, applications, statements, receipts, shipping addresses, phone numbers used to activate or access the account, purchases made on the account, screen captures of internet transactions, etc., etc. So far I have received nothing, most likely because it doesn't exist.

One of the forms that LVNV has been sending me asks for my identification which I have not provided but I have submitted the forms as evidence to the court along with multiple requests for validation on the debt.

This company posted an account to my credit file that was fraudulent and it dropped my score such that I could not get refinanced on my home. I called them and they did the research and they verfied that it was a fraudulent account. They refused to give me a letter saying such, saying only that they contactd the credit bureaus to do a quick-delete??? I asked if I could get a letter stating that and they refused. I filed a complaint with the FTC and a week later, got the letter, which I have submitted to the credit bureaus. I fought with them for 4 weeks about this.

Good for you, jmbarbee01. You have been able to get the fraudulent entry removed from your file. It would have kept hurting your credit severely if it stayed there. Congrats!

This is the address that i have been using validating a debt on my friends credit report, but the problem when you validate the debt coz i have done it like 5 times you get replies from different companies, and different adresses, make sure you mail your letter certified. and also dispute that account with bureaus.

I reviewed my credit report and this company has different account numbers for the same balance, and they have it listed as open two years apart. How can this be?

Send a dispute letter to LVNV Funding asking to verify their records. They will correct it if wrong information has been posted. Or, you can dispute with the bureau also highlighting the disputed item.

I'm dealing w/ LVNV Funding w/ my husband. I sent a debt validation letter to LVNV funding the first time around (unfortunately, I didn't send it w/ a delivery receipt). I then received a letter from a Lawyer representing the debt talking about judgements. I sent anotehr validation letter (got a deliver receipt this time around!) and still haven't received anything. I did this back in February, I believe. How do I get a debt validation from them? No one is complying. Any ideas or suggestions??

The collectors must validate the debt if they are doing legitimate collections. In most cases, they fail to validate the information when they have nothing to give you. Now, you need to get everything in writing so that your side of the story is easily understood about taking care of the account. Chances are very rare, but if the matter is taken to the court, you will have sufficient proof in your favor about their negligence and the judge will rule in your favor.

LVNV keeps gunning me for money I do not owe them..I ask for debt validation and they simply sent a page with this written on it: Validation of debt you owe LVNV funding $5200. If you do not pay then additional charges will be added..How is that validation.They sent me no proof that I owe this debt and I never heard of them before and if it was for credit, I haven't applied or had credit cards in 7 years. How can they be allowed to gun me for something that is not mine.

Don't feel intimidated by LVNV Funding. They are doing such illegal practices with many others. The information given to you does not sound debt validation in anyway. Read this page and know the facts they are required to put in writing before attempting collections. The most important requirement is the details of the creditors they are collecting for.

The federal laws also state that you can refuse to pay anything to the CA until the proper details about the account have been given to you. Read this page direct from the FTC.

Though, they may sound that the debt validation is complete, send a verification letter and dispute the information given to you. Send it through certified mail so that you have every proof about your actions taken to resolve the matter. Read some more thread about LVNV Funding and know more about their illegal practices.

I recently recieved a debt letter from capital mgmt. services (working for lvnv funding. i was told that they have started to file against me in the county where i live. I am on disability income only and I need to know if there is a way to find out how to be in court on the day they attempt to get a judgement against me. Also, if I pay $10.00 per month, will that change the statue of limitations on filing a judgment against me? i was told they can sieze my accounts if i ever go back to work.

If you make even a small payment towards the debt account, the SOL will be renewed from the beginning. Did the company validate the debt account they are collecting for? It must be in writing giving out the complete details of your original creditors and the payments done in the past. It must be in writing as mentioned in the fdcpa. Read this

Don't fall into the catch of the collection agency. You don't know if the debt that has been put in front of you is at all legitimate. Ask the CA to validate the account in writing. It must give you the complete information about the debt you owe. Read the FTC website stressing on the need to validate the account before you pay anything to the CA.
