so recently I received a call from Midland Management inc from a rude guy saying that I owe...well he did not even discuss how much a I owe from a Chase bank. But the thing is I never had an account at Chase and I had an account at Commerce bank. So when i asked about the amount i owed he told me that I am refusing to pay it and that I will be taken to court. I'm a college student who makes $80 a week and I am just trying to get my way through school. Can they collect on this or is it just a scam? help!

The other day I found out that MCM had took all of my money out of my bank account. After talking to my bank and finding out what happern. I called MCM about what they did and ask them why. They explain to me that it was an old credit card that I had in 01. They had took the case to court. And recieved an judgement to take the money out of my account(which is a joint account). What I dont understand is that I never recieved a called or a letter from them . I was never serve to go to court or anything. I even look at my old credit report from 12/2008 this credit card was not even on there any more. So I thought it fell off my credit report. I pulled a new credit report up yesterday and it is not on there. I'm just stuck and don't know what to do.

go to your court and file a motion to dismiss for improper service.then get that money back into your account.then go to NACA.NET and find a consumer attorney who will work on contingency, and sue them for their illegal tactics.

MCM has been calling my home for the past 2 weeks asking for my daughter. When I tell them she doesn't live with me, they immediately hang up. Then they call back 4-5 times a day starting at 8 am until 10 pm at night.
Last evening, they called again and not admitting it wasn't my daughter, I asked what this was in reference to and "Carlos" spilled his guts....apparently this was from a CC which was discharged in a bankrupcy 3 yrs ago. When I explained I wasn't who he thought I was, he got nasty and started telling me I had violated goverment rules by having him tell me private information. I explained they ALWAYS hung up on me and never let me explain. I told him to stop calling my home. He hung up on me again. I want to complain to someone about these peoples behaviour and tatics, and can they legally collect that was discharged on a bankrupcy years ago.

To A Mom. It is illegal to try to collect a debt that has been discharged in BK. If Carlos spilled his guts then he is to blame. He's the one who violated the rules. He should have made sure that you were the correct person unless you told him you were daughter. Do not talk to these people. Find out their address and send them a letter ceritfied return receipt and tell them to quit calling you. If you talk to them, tell them you are recording the call and that you will report them to your Attorney General office and well as the one in their state. And you will report that they are attempting to collect a debt that was discharged in BK. Did they know about the BK or did you happen to know about it?

Midland called me last night (Oct 13, 2009) asking for my ex wife whom I divorced 11 years ago. My telephone number is different from the one we had 11 years ago, there was no reason to call me. The guy asked me for her phone number many times, but I wouldnt give it to them. I told them I would call her and give her the message. Told him not to call my number again, he didnt sound nice, and nope, couldnt speak good english either. I wish they'd come to my door, I really do.......

So if anybody could help me with a letter or should I wait for them to take me to court and bring it up to the judge then.

you are sure it's past the SOL right?then you send copies of that info along with the FOAD letter.if they sue or try to sue after that.then you get a contingency lawyer and sue them.

The credit bureaus do not allow any company to report the same debt more than once. If you have a merged credit report then sure since Midland does report to all three bureaus then you are certainly going to see the tradeline more than once possibly 3 times. we ask that consumers please educate themselves when it come to reading your credit rpeort befor you call Midland and start yelling.

Consumer please keep in mind that 2 companies have the authority to report the same account. The original creditor and the current owner. the original creditor will report the account as traded , sold or transfered and the current owner will report the current status of the account.
