umm ive gotten information
they told me the address used the phone number used and told me to send them a copy of a police report and my birthcirtifficate..a..acopy of it and that it would be cleared and i wouldnt have to worry about it..this is because im a victem of identity theft.

I have had Midland do the same duplication with me. Dispute this in writing not by the internet. Send the letter conformed mail delivery. Also report this to the FTC-Federal Trade commission. You have a right to sue Midland for providing violating the FCRA - Federal Credit reporting Act. It does not matter if this is an accident - although be,ieve me it is not. They purpose duplicate information and "create" balances due to cause a negative credit score. Even if you owe a debt, you have the right to sue. FTC told me each violation is $1000. Check the web for lawsuits against them.

I keep getting notices from Midland on a debt that is 25+ years old. Is that legal?
They list Citibank but I never had a card with them and in calling with the account number Midland supplied, they have no record of that account EVER existing.
I declared banlrupcy back 18 years ago and all debts were discharged.
How do I get these people off my back?

Right now this POS company has been as PITA calling repeatedly and even abusing me verbally on the phone because I would not allow them to get my hubbie's SS# out of me to verify a credit card debt. NOw understand my hubbie does NOT condone credit cards... he won't open one and refuses to USE THEM! I'm pretty sure they have the wrong person. I am also pretty sure they couldn't give a damn about that fact either.

I see a negative item on my report from midland, it was from a credit card about 9 years ago. On my report it says the date opened is 2007. Collection was back in 1999. Is there any statue of limitations or should I just try to settle with them?

Send them a Cease & Desist letter (Certified Mail, Return Receipt Requested). If they contact you after they receive it, file a complaint with the FTC & your state Attorney General.

It looks like they may have illegally re-aged the debt which may give you a chance to sue them.

SOLs vary from state to state, what state are you in?

IF it is past SOL, file a Dispute with the credit reporting agency(ies) on whose report(s) this fraudulent debt shows up on.

SOL is 5 years, unless you moved to another state for awhile. If not, dispute it.

I would dispute it with the credit agency. If you have any back-up documentation,that would be so much better. A copy of an older credit report which shows the default date would be ideal, along with any documentation that you may have from 1999 (collection letter, etc). I realize that is asking a lot, I'm just saying that the more documentation you have in your defense, the better. The credit agencies are required by the Fair Credit Reporting Act to conduct a proper investigation, whereas the FDCPA requirements for validation are weak and really only valid for the 30 day period covered by the dunning letter (which is the letter you get in the mail when a debt has gone to a new collection agency, that tells you how to dispute).

I called Midland and they told me that the account was opened in 1999 and went into collection in 2003 and no payment has been made since 2003. I asked about the five years SOL and they said that federal SOL is seven years. Thank you again for the advise. Another negative thing I see on my report is a medical bill from 2005 but it does not list any creditor name or original creditor, do you think this one could be an easy dispute since no creditor is listed for verification?

They are deceiving you a bit. State SOLs trump Federal, anyway. The 7 year SOL is for reporting on your Credit Report.

I posted a link to the actual law code.

As far as the other debt, its worth a try for sure. Dispute that with the CRA(s) on whose credit report(s) it shows. Dispute plicies for the CRAs will be on their respective websites.

Iave tried everything with Midland credit ,made payments ,there never showed on any statment ,it always stayed the same ,I wrote to California ,then to Pen. with certified mail ,send copy's of checks ,no respond from them but only a letter again how much I would owe them .I have been told not to send any more money .

good luck, Ive been going at it with them for a month, finally got a nice supervisor explained id theft drove to their office on AERO handed her a police report, she gave me a letter of deletion
