I recieved a summons from Palisades Sunday morning from a guy with a gray t-shirt and jeans. I asked him what the papers were for and he did not know. I need some advice also. They have filed a suit with me and I have 20 days to respond. How do I go about seeing if they are legit, before trying to settle this without going to court? They told me I had a bill of $900.00, but on the summons it says for a credit card and not a cell phone. I have never had a credit card with ATT.

What do you do when you've been served a notice with a threat of law suit over a $1100 AT&T bill?

Confirm with your local court if this notice is legitimate. It must have a court date on it.

If this is just an unofficial threat about filing a lawsuit, it's nothing but hot air.

Is Palisades Collection sending you the papers? You debt account should be put in writing they got from your credit company. After checking the details that it is free from all disputes, send your payments convenient to you.

Needless to say, this blog is providing very little help to anyone. How many times can someone tell us to send a debt validation letter? WE GET IT! Obviously, the normal steps to combat Palisades are NOT WORKING!!! Am I clear? The phone number does not help! It's worthless so thanks anyway. All they do is ask for more information that they can use to further ruin you! Can anyone offer some advice that actually works with Palisades? Probably not. Like everyone has been saying, Palisades is a SCAM! Why doesn't anyone address the real issue here? A class action lawsuit is needed. Basically we're all screwed. If you pay the debt, you're screwed, if you fight it, they sue you. And I'm so freaking sick of the people on here that can't form correct sentences or use correct punctuation. Can anyone use the English language the way it was intended and provide some accurate, helpful advice??? I can't understand half the entries writtin here. Are you all from another country or did you drop out of high school??? Do I send the damn validation letter just to have them sue me? Do I pay the debt and have them say I still owe it? For the love of God, are there any correct answers or any people with an education that can steer me in the right direct? I will pay you $50 for someone to give the correct advice.

often times when collection agencies buy debts from creditors. they purchase what is the remaining balance from a payoff. In other words, if you settle a debt for less than the amount of the original financed amount. Technically you don't have to pay anymore, but it still shows up on your credit report as a settlement in full or SIF. Some finance companies especially mortgage companies require that you payoff SIF's before financing you. These collection agencies purchase this remaining balance with the hope that you will want to turn a SIF into a PIF or payment in full on your credit report. Unsavory collection companies try to trick you into paying the remaining balance of your SIF's. I was a bill collector for Six years.

What is needed is a class action lawsuit; it's the only way to stop them. They have a lot to lose in the stock market, if they get sued by the public. They are listed as "Asta Funding Inc." On August 9th they reported record third quarter and nine months revenues and net income. They own Palisades and buy debt from mostly AT&T. I too have sent them two valdation letters certified. That was over 45 days ago. The CRA's refuse to take the debt from my reports, because Palisades electronically verifies the debt as valid back to the troglodytes at the CRAs. This is not even my debt from AT&T. Go to NACA (National Association of Consumer Adovocates). That is my next step. I have downloaded a firm's name from the internet that handles FRC and fdcpa cases. As soon as my stomach settles, I will give them a call. Don't bother with the BBB, or the Federal Trade Commission (no help there, and a waste of your time). I do not want your $50. Your are correct, this site is basically useless. Some advice for you, do not call Palisades back. I made that mistake just once. I feel your frustration.

They have to get a judgement against you first, and you must be notified. If you get one, show up in court. You do not need an attorney to defend yourself on that issue. Once you are put into that position, they will have to show proof that you owe the debt.

The FCRA has written rules to protect the consumer, but the more you read, the more you can see that, in realty, it does not. They do not inforce the very laws they make. The CRAs and collection agencies have the upper hand. The consumer must spend time and money to prove they do not owe a debt. Palisades can kiss my rear; they will never face me in court, because they know they have no proof. That is why they don't answer back when they are sent a validation letter. They are hoping we are a bunch of dummies who will pay up, or the low-life company they are (sucking blood from consumers)will keep it on your CRA. The CRA's are out to lunch permanently. Like the collection agencies they are only out to make a buck off our backs by selling our personal information for cash.

Call Cingular. They will get the information for you including an account number. They have an ATT wireless records group. I did this and found that the charge was somewhat legal and had to do with cancelation charges. I'm just paying it since I got them to fax me a 'we are going to delete from the CRAs" letter.

James, call Palisade collection LLC at 201-567-5648 and ask about the debt account they are listing in your credit report. Make them validate the debt in writing to confirm that they are authorized for this collection.

Can anyone help me out? I'm not sure what to do. I have just been notified from the district court that Palisades is suing me for over 1800 dollars and I called Pallisades today and they gave me another number to call and that number gave me another number to call when all was said and done the final information I got was that it was from a credit card debt. I have never had a credit card for any where close to that amount and the company they told me it was from I have never even heard of. I have now gotten papers from two different law firms for the same collection but they both have a different amount on them. I only have 20 days to do anything about this. I don't have a lot of money right now because I have been off work on medical leave for the past three months. Any information would be a big help. Thank you for all the help.
