Palisades Collection Agency collecting for wrong account – what to do?

The # I was able to reach someone at is 866-230-8094. They have an intro that automatically assumes you are calling to DUSPUTE the items. You then have to press 1, 2, 3, or 4 to get past that, Pressing 4 wil take you to being able to press 2 and hold for a person. At which you hold and hold and hold!

I have been reading this thread, and have a follow-up question regarding documentation. Palisades was able to provide documentation of the debt they say I owe to Verizon, however, the account is from 2001-2002, and since the debt is so old, Verizon did not have all of the account notes to provide to Palisades. The debt originally was a result of identity theft, which was noted in the account notes and the fraudulent dollar amount was written off at the time. However, that information was not forwarded on to Palisades, and when I ask both Verizon and Palisades, neither says they are in possession of the account information. I do not have documentation that the amount was written off and that it was not my responsibility. Do I have a recourse or further way of disputing the documentation and debt? Thanks |

You have quite a few options available to you.If they cannot prove it is yours they are required to cease collection in accordance with federal law. http://www.ftc.gov/os/statutes/fdcpa/fdcpact.htm#809 Since we know they can be stubborn,we want to hit them with a very large and painful club.Here is a plan of attack for id theft: 1. Go to www.ftc.com and click on id theft link. 2. Download id theft affidavit,fill out,and have 5 copies notarized. 3. Bring one notarized copy to police station nearest you and request a police report to support your statement. 4. You will need 5 copies of police paperwork. 5. Mail 1 copy of police report with notarized affidavit to collection agency certified return receipt. 6. Keep one set for you. 7. Mail 1 copy of report and notarized affidavit to each credit bureau with a letter stating this is a id theft account.They will place a fraud alert in your files,but that is no big deal.Make sure to send this certified return receipt also. 8. If they are on your reports anywhere,identify in your letter to bureau that this is a Facta id dispute and account must be surpressed. What I have just walked you thru is the procedure in the Facta amendment to the fair credit reporting act.So the law is on your side to give you a good resolution.If collection agency gives you problems after this,they will be violating fdcpa & fcra with some good damages they would have to pay you for not complying. __________________

I am a loan officer and I am in the middle of trying to help clients purchase a home. I have called all numbers referenced in this e-mail, and am unable to speak with anyone! I got the run around from a copmany called Asta or something like that, and they told me that they represent Palisades. This company's phone number is outsourced to India, and when I asked them to please give me the phone nuber for their client (Palisades) they told me that they can't give me the phone number. I need to speak with someone and get a letter faxed to me ASAP! Help please! email address removed as per forum rules - Mike

You should be able to go to the secretary of state's office in any state they are licensed in. Go to website and look them up in the corporation/commercial database.If they are not listed,they will have a registered agent you can contact to get your information. __________________

Totally shocked to check my credit report today and to see this company on my report. I havent recieved anything by mail or phone! Not even sure what this debt theyre claiming is from! I have been reading all of these other messages and quite frankly not looking forward with dealing with this company! Could I please have an address to be able to contact them. Thank You,Susan

Can anyone post a link to an explanation of what a validation letter needs to have in it? I've just had a collection notice post to my credit report and want to make sure that its legitimate before doing anything. Also, what are the chances that i'll be able to get this removed from my credit report if i agree to pay immediately......

first off, all these blogs have been very helpful. thanks! i was recently served and i'm suppose to appear in court over a debt apparently owned by palisades. can i still request a debt validation letter or is it too late? should i just contact the company and work out a settlement with them? any advice would help greatly. thank you!

David,if you are going to court first off answer their summons and don't miss any court appearance. Send your dv letter certified return receipt. Make them prove your debt in court/Most of these companies have very little proof.

David,I am unsure of their level of evidence.I would fight them purely on principle. To answer a summons you will need legal assistance. Normaly you would file your answer to their complaint with the courthouse and mail them a copy. If you wish to proceed,you will need to go to your courthouse and ask the clerk what are the rules of civil procedure for court.Then you can read up on them. If uncomfortable with legal headaches,explore option of getting a lawyer to file for you or contacting legal aid. I would not give them a dime until they can prove it is your debt.
