The first thing your daughter should do is check with local court clerk's office to see if a suit had been filed against her. If it has it depends on if she was served the civil complaint and summons. If not she can have the judgment vacated due to improper service.

If no suit had been filed they can get in big trouble for using a fabricated court document.

these guys are sooo professional!! i sent a out of sol notification to them and i got the little green card back. they signed it but did not put a date when they recieved it. maybe its just their way of saying oh,you sent it to us but we cant tell you when we got it!!! big a-holes!!

The missing date is a boo-boo courtesy of the US Pest Orifice. It's their responsibility to date it, then have the customer sign it.

Did you keep the mailing receipt [the green-and-white stub from the Certified Mail form]? That established when the item was mailed. Might be close enough for your purposes, I dunno.

For better info, go to the Post Office website [usps.com]. Click on 'Track and Confirm', enter the certified mail number, and hit Go. That should give you date and time of delivery. Since the green card is not dated, I'd do this:

Keep the green card [for the signature], a print of the usps.com confirmation page [for date/time of delivery], and the certified receipt [established mailing date]. Keep'em all together and safe. You'll be fine.

Certified letters are scanned on delivery, as well as at each stop along their journey. All of that info is available through usps.com.

thanks unclewulf! im just getting fed up with these people. i did everything they asked made a police report.even when the police said its past its reporting date and sent them that fraud report stuff but they still are trying to say this bill is mine by sending me a soo called validation bills fromm 2000. with my name and addresses i never lived at. two addresses! one from here and other from out of state!! but my s.s.n. data shows i have been working here the whole time!

They do buy accounts from Chase and they are hard to deal with. I suggest you ask them to send you proof of the debt. But send it certified mail. They will file suit but it will take sometime. You should also look at the Statute in your state. Just in case its your debt.

its not for a credit card. its for a att phone bill. and yes i asked for proof. so did the cra and they took it off my credit report cause they didnt validate with them. they just sent me a bull bill from 2000. and yes it is out of statues. i sent them a letter saying i know my rights and if they file suit ill say its a time barred debt that isnt mine which it isnt!!

Ok, just so I make sure I understand you perfectly I'm going to outline the points of your posts.

1. They are trying to collect on a bill that does not belong to you.

2. The debt is out of SOL

3. They failed to validate it with the CRA's and it was removed.

4. You sent them a debt validation letter which they have failed to respond properly to.

This being the case, I honestly wouldn't worry too much about it. They can't use it to damage your credit, they can't sue you for it. Since it is not even yours I would suggest writing a complete cease communication letter instructing them not to contact you at all.


However, just keep tabs on your credit reports to make sure they don't try to sneak it back in there.
