Palisades Collection Agency collecting for wrong account – what to do?

Palisades is not making a genuine collection towards your account. They must have shown you the payments made in the past. Send your debt validation in writing through certified mail with return receipt requested. You will cover your base after the company has received your request. Keep the receipt of the certified mail in your records. You might need it sometime later to prove your actions. |

Since we are all sharing our experience with Palisades Collection I thought I would share mine too. After receiving a notice of debt 9 months ago I asked for Palisades to send proof of the debt, they said I would get it within 90 days. 90 days ended 6 months ago! So now a few weeks ago I got a letter from Plaza Associates collection on behalf of Plaisades and ATT seeking payment on the same debt. So now I'm back with sending another letter.
I'm considering legal action to not go through a third round, any suggestions, advice, help? Not to self advertise but I stated a blog on it (9 months ago) in case my situation might help others. Link deleted as per forum rules - Mike |

Call Palisade at 201-567-5648 and get the debt validated in writing. Check it thoroughly before you make a payment agreement. The CAs often get disputed accounts and thereafter enforce collections on it. Review your account for any errors and then make a payment proposal. |

I feel for you, I am dealing with these people also, Problem is I can find them nowhere. In 1999 my husband ordered a phone from AT&T, before it arrived I talked him out of taking it and the service so we refused it at the door from the delivery man. We got billed for a year for 305 dollars. After numerous phone calls I finally got someone who found the information that the phone was returned and we never had service. OK so then I start getting my credit reports and there is Palisades Collections LLC. So I dispute it on the report and it comes back that I owe the money according to Palisades. So back on the phone to Cingular (now). And they can't find any Palisades collection, no Palisades in directory assistance, no Palisades in Better Business Bureau, not even can the credit bureau give me their phone number. Does anyone know how to reach these people? What a bunch of bolognie! I am trying to refi my house and need this off my credit. If anyone has any information please let me know. Thanks |

soohfys, I am surprised why the CRA or the BBB does not have any contact number of Palisades. This CA has many disputed accounts regarding AT&T. Call them at 201-567-5648 and inquire about the reporting in your file. Be aware not to make any payment agreement until you have verified the details. Also, check the date of last payment on this account. It might be out of the SOL period. This account should have been automatically removed from your file after the 7 years reporting time. It is mentioned in the FCRA.

Drew, dispute the account with Palisades. Check your credit file if they have put any negative remark. Collection entries hurt the scores severely. You must dispute the item with the CRA if it is shown in your file.
Send letter to Palisades for the details of the debt. Under the federal laws, they must give you the accurate information of the debt or send an apology letter. |

I recieved a letter from the mail today saying that I have Case filed at City of Rio Hondo Case filed By Palisades Collection L.L.C. It was filled June 1,2006 it says I will recieved a summons after this but I don't know what is this and what company it is regarding.. I don't recieve any letter from them before they file this. May question is Are they allowed to just file this without sending me any letter what is this regarding for. really I don't know what account is this.. Please help me!

Jetsen, the SOL in California for written contracts is 4 years. The statutes on oral contracts expire after 2 years. What is the status of your debt account? Check the date of last payment made for verifying the SOL period. If the SOL has expired, no agency can force you to pay the debt unless you are willing to do some improvement to your credit. Read the FCRA for more knowledge on the SOL

Know the details first from the company before making any payment agreement. After you are sure that the company is authorized for this collections and the debt is within the SOL period, propose a payment plan. Even if the debt is past the SOL, you can pay it off and improve your credit slightly. Most important thing is that you should clearly understand that they are having your account and the calculation of the debt is done properly. Here is their address info. Palisades Collection, L.L.C. My mom has the same problem. She received a letter from court saying that pressler & pressler is suing her for breach of contract saying that she owes $561.00. This account was originally opened by my aunt without my moms authorization and we recently found out. Anyways, the letter from the court said that she had 30 days from the date the secretary sent her the copies,May24th (5 days after this lawyers filed May 19th) to answer the complaint. Well thanks god I came across with this website and got some ideas on how to answer to the court. I replied back and took the papers myself to court on June 9th which would give them 15 days to answer. I sent pressler & pressler copies of my response and sent copies to palisades collection to validate this debt certified return receipt.
Well on June 21st she received 2 letters from pressler & pressler (still no answer from the court) dated June 15th, saying that I did not answer the claim on time and due to that error they werent able to validate this debt, but they will still request from the original creditor a copy of the application or contract and if its received they will foward them to her. In the meantime they sent me a print out from their computer showing the total amount (made by them) like a bill basically also showing her social. It shows that she owes $542.05 not $561.00 like they put in the summons and its signed by a different lawyer from the law suit filed in court. The second letter states that she must answer several questions within 30 days of receipt and return them certified to their office under the provisions of NJ court rule 6:4-3 and if they are not answered, judgement may be entered against her without trial. Then the second page following this one, looks like the papers you get from court but of course these arent from court, they were made them in their office. It says civil action interrogatories dated June 19th. It says: DEMAND is hereby made of defendant(S) for certified answers to the following interrogatories within the time prescribed by the rules of this court. Now what court are we talking about??? They are lawyers!! and once again she hasnt received any papers from the court showing proof of their response showing that she needs to show up. The first question basically asks to provide names, addresses, and dates of the people that used this cell number during the time they are charging her... The second one asks to provide cell phone numbers used by my mom in the past six yrs. Third asks to attach any documentation evidencing my moms mailing address between that time period (01-04) which should include copies of energy bills, mortgage loans, drivers lic, lease, etc... and list mailing addresses where my mom got each of these documents. Then the last part says I certify bla bla bla... basically she has to sign certifying that she told the truth and that provided legit documents. These people are scam artists!!!!! They of course dont have proof of debt validation, so they send these letter to scare my mom, showing that these papers come from the court when they were actually made in their office...Basically asking questions they need answers to. Should I counter sue them??? Then on top of that they said she never answered the complaint in time??? We all have proofs that we did. In fact the papers I took to court are stamped by the court and show that I made the correct steps..... Should I answer these letters or should I ignore them??? Thank you!! |

Uuuumm, let me think for a second....HELL YES!!!! Dude, do you know how much trouble they can get into for this? I'd sue them for $1000 for continuing collection after you sent a DV letter (continuing the law suit after you have requested validation is continuing collection activity), then I'd slap their ass with a separate extortion suit. Don't send them anything but papers from the person you want to serve them. __________________

just wanted to mention that i saw in my local district court report of the paper that pallisades was taking a area resident to court. i hope she gets her case thrown out. if i new the person i'd run over tell all about pallisades
