Now let's just see what this law office is going to do about it - I mean trying to collect on a old debt. Someone wasn't reading their paperwork correctly when the chose to harrass Elle. Looks like a "Dual" suite to me. The law firm should be accountable also for not evaluating their paperwork more carefully.

you people really need to take a stress pill. No agency is given all the paperwork. As for the law firm they would have copies of the payment this lady made unless she gives them to them. How ignorant are you people. You have a paid receipt from a bank saying you paid a bill the company you paid doesn't have it so if there's a screw up with who you paid guess what you would have to give them proof. This supposed law firm only need the info that the company gives them then they proceed. Phone any company that does thing kind of business. You have 100000 debtors that have 100 papers in there files. You would have to have a warehouse to store them. They contact the orignal company to get your validation. Unless the have the ability to go directly into there clients computer. Most companys would not allow a outsider access to there data bases. Clue in people.

Fed up most of what you said is a hundred percent true. In any company that passes the debt to another company does not give all the little papers. You get there information date time amount name etc. Most company request that you contact them and they will send out the personal information. Due to the Government Privacy Act. You can not release all the personal information. The other company cannot legally pass on certain info. Maybe the US does not have such a law ????. Even doctors cannot relay info on a patient to another doctor. They can only give some info the patient has to request that the rest gets passed on. I cannot explain any better then I have. I will once again say that if you would like help please call me. And Fed up thanks for some of your info but you could have been alittle nicer about it.

Well said Janet I gather your from the law firm. But I have been reading this site for a couple of days now and its funny. I owe debt to and just thought I would check out this site. I thought I could get some good information on how to spread out my debt. But all I really found on this site are a bunch of people that have nothing better to do with their time then have people waste the tax payers money by saying go to court , sue, well there are alot of serious criminals out there that are waiting for they day in court but the systems are so full of crap like this that everthing get delay. Maybe if someone would have just fix their problems in the first place including myself we wouldn't be here. Now I am on both sides of the fence. I owe debt didn't pay now I have people calling me. But I also am waiting for someone to go to jail for something they did to a family member and it's almost been a year. Every time we go to court there is bull like this in there.

Fed up I agree with you inregards to the courts. I am in court a couple of times in a week. At my old job i was there daily. I watch people come in because someone spit on them. They then get duty council. Guess who pays for this us tax payers. 95 percent of the day are cases like this. someone sues of 50.00 dollars but it just cost the tax payer to pay duty council for 4 or 5 times in court because they would hold it over. If I added up one day worth of waste in the court system I could feed 50 homeless people. Most court cases are a waste of time and money. I also agree that if this kind of stuff was stopped then these rapist and child molesters wouldn't be enjoying themselves for a year or two before there cases went to court and the familys would not have to suffer the wait they could have gotten on with their lives instead of having to re-live the horror for this time period. But you have to understand that some debtors get into binds. Some just don't care. But they are still good normal people. When you work in these kinds of businesses you see all kinds. In my old job and this onew I see so many people bankrupt. But the government allows them 200.00 a month for smokes and 200.00 a month for entertainment. etc. They still get to enjoy themselves well the people they owe go broke with no help. But hey thats how it is. Good luck with yoour family and I'm glad your paying your debt.

Hi, Fed Up! Hope everything works out for you.
Just wanted to say....the “lawsuit” thing goes both ways. In my particular situation, I was the first one threatened with being taken to Court…by Mr. David. As were my sister and another of my references. All this, mind you, over the collection of a $100.00 debt that I was actually trying to pay off. I thought that was totally nuts...which is why I came on to this Board. Had I not come here, I never would have received all of the support and helpful information that I have…nor would I have been introduced to Janet, who has been graciously helping me work out this situation.
This firm's client humiliated me and garnished my wages by submitting a wage assignment to my former employer using fraudulent documents. Do you think what he did was OK? Do you think I should just ignore it? I understand you must be stressed out and tired with regard to your own situation - but I gotta say, I don't know if I wanna just let this guy get away with what he's been doing.
With regard to collection firms proceeding without all of the paperwork, there is NO way a firm can know if they have ALL of their client's paperwork. They also have no way of really knowing whether a client is legit until something like this happens. I worked in the legal field (litigation, non-collection) for 14 years. I can tell you from experience…you don't know a client is nuts until AFTER they've retained you (lol…sad but true). A firm can only go by what their client is telling them when they retain their services. So…in my instance…you really can't blame the firm for not having a complete file. It's their CLIENT's fault for not giving them the whole picture. They had no way of knowing that…just like my employer had no way of knowing the garnishment notice they received pertained to an old loan and not the same one. I feel kinda stupid for not asking my employer to show me the wage assignment back when this all started.
All that said, when the firm does get the paperwork from their client, harassing phone calls should not be the first step. Initially, a breakdown of the debt should be properly presented to the debtor in writing, giving them the chance to pay it or dispute it, as I have done. This at least gives the honest people out there a fair chance to pay off their debt or challenge it. If the debtor turns out to be a deadbeat or is totally uncooperative, THEN the firm or agency can proceed to go after them.

Elle thank you for your kind words. I meant people like guest1 who just sounds like he chirps in to add fuel to a fire thats already being put out. A lawsuit against the first person i understand. A law suit a againt the people trying to collect the money is stupid. Unless you are a greedy person and someone trying to stir the pot. These people are doing their job maybe not so as nicely as they should. But I think this Janet is really trying to help. But this Guest1 and some other people are cutting her up to. It no different than a cop coming to your house because someone said that you hit them. You are place in cuff taken to the station made to feel like a total ass. Accused harrassed bullied etc. Until you can prove your not guilty. your don't get to sue or get a i'm sorry. People need to look at things in a better light. I'm sure you go to work and do stuff for your bosses that you might not like or agree on. But you do it because its yoour job. Or you'd be on welfare. No different than a debtor borrowing money they know they can't afford to pay back but they still go out and get it. ???????????????????

I hear you, Fed Up. (Sorry for the long-winded post before. Dag...I was on a roll..lol)
Financial hardship is just a horrible position for anyone to be in. It's stressful and depressing and people calling your home to collect...talking down to you and treating you like a loser...really doesn't help the situation. It's to be expected that discussions about it are going to get pretty heated.
I've already conceded to the fact that there are good people that work at collection agencies who are open to helping debtors if they can prove their position. But not all debtors are deadbeats, either.
My stand is that I don't think it's fair for a debt collector or attorney to automatically treat debtors like they're deadbeats without first giving them a fair chance to make arrangements or to defend their position.
And...although things about my job can be tedious, I would QUIT before doing anything that violates the law or that involves humiliating, insulting or demeaning people.

Fed Up - there is a difference between Civil court rooms and criminal court rooms. Civil court rooms are not tying up a criminals court rooms. I know this because I worked in the court rooms for many years so I AM speaking from accurate information when I say this.
Things seemed to be working out here and things have been cooling with the help of Janet (which Elle has confirmed) THAT is until your posting. It seems like you are trying to stir up the pot. Everyone is entitled to their own opinion whether you like it or not and your verbal comments towards other members on this forum is not productive nor helpful.
It is unfortunate that you are going through a tough time in your life but don't take it out on others.

Per that link, for a collection agency to collect a debt in the state of Illinois, you MUST be registered with the IL Dept of Professional Regulation. And I am sure this is true with many other US states. I want proof.
I went to this page:

and I searched for either Liability Solutions or Mr. Kupferstein's last name and I found nothing. To the best of my knowledge, your company is not registered to collect a debt in the state of Illinois. How many other states has your company failed to register in? Operating a business without a license in IL is a class A misdemeanor, with a penalty of up to $2500 Fine &/or Up to 1 Year in Jail.
