Hi folks,

Well I've done some interesting research today. A couple of my payday lenders, actually three out of the four, claim to be licensed in Delaware. Well, I checked the bank commissioner's site and they don't seem to be licensed. I tried different names and nothing came up. So I e-mailed them with the company names and addresses to see if they actually are licensed. I'm also in the process of filing a complaint with the AG's office in Kansas because of one my lenders is supposedly processing loans there without a license. The guy admitted to me on the phone last week that he didn't need a license in Kansas which is not true. I have this on a recorded phone conversation as well. This is the same company that left a voice mail for me stating I committed fraud. This guy told me he was licensed in Delaware but he had a processing center in Kansas. Don't you love payday lenders? lol Anyway, he doesn't seem to be licensed in Delaware either. I'm just waiting to find that info out now. The address he gave me for is Delware office is the the address of the Delaware Registry. Hmmm, nothing to hide huh? According to the payday loans in Delaware, a creditor cannot threaten with any criminal charges. This guy is in deep do do if he is not licensed. I'm going to see this jerk shut down. He doesn't believe he has to be licensed in the state of Ohio either. Wrong again but he didn't believe me. Plus, they violated a cease and desist order. Man oh man! Another company that is supposedly licensed in Delaware sent me an e-mail stating that I was a thief and stole money from them. Hmm, there could be harsh consequences for this company too. Wish me luck!

I am waiting to hear back from Sonic and United Cash Loans. I personally don't think I will hear back. Boy oh boy, if they don't this will make my cause even more worth while.

Just remember to remain professional in all your dealings with the payday lenders you are dealing with. Please also remember to not violate any laws when recording conversations. What could be conisdered key information, a very valuable piece of information in a court preceeding...could be considered worthless if not used properly.

It does appear that you are keeping great notes, and keeping up on your complaints. Please keep us all updated on the outcome of each one.

Mischele please let us know what you find out. I had a couple from County Bank of Reeboth DE (I'm not for sure if that's the exact name but close). I haven't heard anything from them in about a year or so.

In my state, I can record without their permission. I checked on that one. I am professional but firm in my dealings with these lenders. (most of the time) I almost lost my temper last week with the jerk but I remained calm as possible. Most of the others have been contacted by mail so that is more evidence on my part. My conversation with Quik Payday today was just matter of fact. I let them know I would further my complaints with my state's AG's office because I did not understand how the circumstances changed in two weeks and all of a sudden I had two accounts with two different banks.

Do I need to follow the laws in my state per recording conversations as well as the lenders?

Danna,

That sounds like the bank that Universal Cash Advance used to use but they went by another name then too. I cannot remember it at all. Google the bank name to see if you can find out some more information on them.

You seem so knowledgeable and I was hoping you could provide me with some advice here. I live in Ontario and would like to know how I can find out if a company is licenced or not. Are you required to pay for this service where you reside because I have been informed that I do here. I am in the process of a legal battle with a company that is trying to charge me more than what I owe. Unfortunately, they have gone to the court, filed an affidavit, I did not receive it and and then was told that it went into Notice of Default and that the wages are to be garnished. Upon contacting the court house they told me this also. Don't I have to be taken to court (attend a court hearing) for this to be done. The court house says that because it went into a notice of default this is the case. I am at my wits end here and they are now harrassing my payroll administrator.

I think JJ answered this in another thread. I'm really not sure about Canadian laws to be honest with you. Do you have something like a consumer protection office or bank commissioners office that you can check with? Can you get the papers from your payroll department? You may want to contact an attorney regarding this matter. Maybe someone else on the forum can give you better advice.
