If a collection agency does decide to take you to court and sue you, what happens if they put a judgement against you? What exactly does it mean and what happens to you?

If you do not pay creditors/collectors, they now have a right to go to court and sue you for their money. If you do not go to court to represent yourself or send in a lawyer, the collector will win the case and you will receive what is considered a judgement. They would have the right to place a levy against your bank account or even request garnishments from your payroll check to pay off the debt.

If a collection agency has been hired by the credit company, they will return the file back to the original company with a note that that debt is not collectible. It is their decision now to take the matter to the court or mark it as bad debt in the company accounts. Usually, a case can be filed if is for a huge amount.

If the credit company has marked the account with a zero balance, the CA becomes the original creditor who purchased it for pennies on dollars. They will like to recover their money even by taking the matter to the court. Do not let your case reach the court. You can still settle the matter with the company before it takes the legal route and a judgment gets filed against you. In some cases, the companies try to seize the asset of the individuals also for recovering the total amount. However, the most common form of judgment is wage garnishment. Every state has its own laws on judgment. Be aware of the laws in your state before it reaches that far.

I live in PA and no that they can't garnish my wages, so my concern is what other methods they could use to get there money. Do all states allow for levies on bank accounts? I have been setting up arrangements with all of my creditors. Some I am paying what I can, but they won't accept it as an "agreement". I am worried about those. I feel that at least I am paying something and if it did go to court, the judge can see that I am making faithful monthly payments and that they are being accepted. I am just really worried about all of this. It is soooo stressful. Do you think I have the right idea about this?

Yes, your payment effort will count the most. The judge will clearly understand from the papers that you are trying to take the responsibility and pay the debt. This will not allow them to take decisions against you. keep everything in your file as part of proof.
