Has anyone dealt with Pinion Management North out of Albuquerque, NM?
I have a couple of payday loans and they are telling me that they are getting ready to file on me. Can they file suit on me in Texas?

They won't accept something in a monthly form, they want something every 2 weeks and it's impossible now. Like this week, my check has to go to my rent, car payment and gas. I have nothing left even for food. But Pinion will call and will tell me that they are going to file against me.

Shbear, as Roxette said, the original creditor can file a civil lawsuit against you if they so choose, that is their right. Texas law requires them to file the suit in your county in the state of Texas. If they said they are getting ready to file a suit, it is just their way of intimidating you to make immediate payment. However, if they wont accept payment arrangements you can afford, then tell them I am sorry that is all I can do and hang up.
Then see what happens. They will more than likely send your account to a collection agency instead of filing a lawsuit. Lawsuits are expensive and besides, the judge could end up ordering only a percentage of the original debt to be paid based on the debtors financial situation.

This is a part of continued pressures put by some of the agencies. This helps them in recovering the money from the consumers. Your fear will make them stronger and they will try every bit to intimidate you.
A proper negotiation will be helpful in solving this matter completely. Try sending them a letter with a payment plan so that they can realize that you are willing to pay it from your side. If they cash your cheque, your request will seem to be accepted.
My experience says that they won't take any legal actions as long as you are willing to pay the debt. Do you mind mentioning the total amount they are trying to recover from you? Taking the matter to the court, they will have to go through all the court costs and other miscellaneous expenses.

If the original lenders sends the account to a collection agency,Cant they take it to court also?

One of them is down to $165.00 and the other one is $390.00. They want $50.00 every two weeks and I just don't have it.

I do not think a collection agency has the right to sue. I spoke to an attorney in my state (Texas) and he told me a collection agency could not file a civil lawsuit against a consumer for a bad debt. He said the debt is owed to the original creditor, not to the collection agency. Thus the right to seek remedy for a bad debt would be given to the original creditor only.

I am pretty sure that they won't take any legal actions for such a small amount. This amount can be easily paid in a monthly plan. I assume that they will try to study you for some time and later on, accept your proposal.
Follow the two things you need to keep in mind, one is that you don't need to get scared and feel confused. And secondly, stick to your payment plan. If it is too urgent and beyond their acceptance, raise it to a little more but it should be a monthly payment plan.
This is my suggestion that I have offered keeping myself in your place at that point of time. However, you need to make instant decisions depending upon the situations.

And all of these folks that are contacting me are collection agencies, not the original creditors. I think I am going to send letters to them next week stating my situation and tell them that I can do a monthly amount of $50.00 and that is all I can do. Then I will see what they will do.

I just received a call from Pinnion and I asked for them to send me documentation in writing regarding the debt. They told me it would not reach me in time before they file charges against me for check fraud. I think this is Oneclick Cash making these calls. His first call he said he worked for Pinnion and then when he called again and left a message, he stated he was with OneClick Cash. Im not sure what is going on with these people.

Pinion does collections for several payday companies. I dealt with them on 2 of the loans Ihad oustanding. I dealt with a guy buy the name of Eric Hill. He is at ext 5007. He was very good to work with me on payments. The first call I got was from a different guy. He was very rude and threatened all kinds of threats. He even went so far as to put in their computer that I promosed to pay the full amount and then backed out on it. The only problem with him putting that, was that he never even told me the amount. I had only told him I would have my rep from BHR call him to work out the details. Anyway, my BHR rep got in touch with Eric. He's the one who siad the first guy had put it in the computer. My BHR rep worked out an agreement on the first one. The second one I dealt with on my own with Eric. I'm now payday loan free and intend to st ay that way. But you might call and ask for Eric at ext 5007. He was really nice and really helpful with me. Just a suggestion.

I had a great experience with BHR. They really helped a lot and got some of my bills cut 50-70%. If you want the email to the lady I dealt with let me know and I can email you her email and phone number.

I would like the email and phone number of BHR. I am down to $165.00 on one with Pinion and $390.00 (One Click Cash). The lady that I am dealing with is not helpful at all. She wants money from me every two weeks and I just can't do that anymore.
