Not a lot on here as of late, but I cannot believe that post from the "debt collector - soon to be a lawyer" You have got tpbe kidding me! Can't spell, can't construct a sentence. I am only a c student through college, so don't rag on mine, but geez! OK, all of that stuff it/she/he said is wrong. It is against the law and you do have rights. Don't pay these people anything if you cannot afford your house and cars and put food on the table. Hell, Congress will be reaming them soon. Hang in there.

YEP! Daily phone calls!! These people are like flies! I worked customer service (retail)for 14 years and have had some really hateful customers. However, I have never encountered such hateful and rude people like those who work for Pennacle. My original debt is medical for $1,400 for 8 stitches in a finger. I sent the hospital $25.00 a month and then they sold my debt to some company in Houston. I sent those folks in Houston $25.00 a month then my debt was sold to Pennacle who said "we will stop calling if you will send $35.00 a month." I have explained to them in simple words that I am unemployed and have COPD. When,I offerd to send them $5.00 a month in good faith the woman hung up on me. So, I guess that means no. I will not be bullied by these rude alliens. I have rights and I am being violated. The state attorney's office as well as the fed's have ways of dealing with these people. Sure would hate for them to become unemployed or sick!

This person is a thief, and the only way you can get rid of him is turn him into the IRS, for income tax evasion, for he is not paying his taxes, and you can receive up to 10%, of what they recover. He will be put out of business forever! and probably proscuted

Powerful New IRS Whistleblower Program

On December 20, 2006, the President signed the Tax Relief and Health Care Act of 2006 (“the Act’).

Section 406 of the Act dramatically strengthens the IRS’s whistleblower program, by increasing available rewards and creating a reliable enforcement mechanism for whistleblowers to collect them.

Under existing rules, the maximum award generally available to whistleblowers has been 15% of funds recovered by the IRS (including taxes and penalties).

Section 406 establishes a floor of 15% and increases the cap to 30%, in those cases where the IRS pursues an administrative or judicial action against a taxpayer based on information brought to its attention by the whistleblower.

Moreover, while whistleblowers were unable to enforce their claims to awards under the old program (unless they had a contract with the IRS), the new legislation provides that payments to qualified whistleblowers are mandatory, and it permits whistleblowers to appeal IRS award determinations to the Tax Court. If they are successful, whistleblowers will be permitted to take an above-the-line deduction for attorney’s fees and costs paid by them to recover their award.

The new program is limited to claims against taxpayers whose gross annual income exceeds $200,000 and whose potential indebtedness for taxes, penalties, and interest is greater than $2 million.

The statute also places a 10% cap on awards to whistleblowers in certain cases where there have been prior public disclosures of their allegations. Rewards can also be reduced if whistleblowers planned and initiated the actions that led to the underpayments of tax.

The statute provides for the creation of a Whistleblower Office within 12 months to handle incoming whistleblower claims, and it requires the Secretary to report annually to Congress on the results. The law will apply to information provided on or after the date of the Act’s enactment.

The IRS is expected to promulgate implementing regulations concerning the new law in the coming year. New developments will be posted here.

I too am battling Pinnacle as they say I owe a Verizon phone bill from 2000. Well hate to tell them but I have never had a Verizon phone. I have always had Cricket from 1999 till a few years ago when the company I work for started providing one for me. I disputed it with the first collection agency and filed a complaint with the FTC. Now they have it with NES. I told the lady I disputed it and she puts it in her computer as a refusal. I told her she couldn't do that I told her I disputed it. She said to bad its a refusal. So I filed another complaint this time with Colorado Collection Board and sent a formal dispute letter to NES.

As for collector.... He dude/dudette, for a soon to be attorney, you better save up for a good paralegal because you can't spell or put a sentence together to save your life.

I just got off the phone with "Steve" the Account Executive handling my file. (ok) He told me NES should have never been collecting on my account they took it from them back in May and to disregard any letter they sent me.
He said they Pinnacle "shut" it down. I asked him to send me a fax to that effect and supposedly he put it in the system to go out in the next 15 minutes. I'll let everyone know if I get it or not. he laughed at my fax number because it had 666 in the prefix. I told I hated it too.

I got a letter today from some lawyer in NJ saying they represent Pinnacle Credit Services. I had never received a letter or phone call from Pinnacle. Anyway, they are looking for $941.59 for a credit card account with Household Bank which I never had! It's nowhere on my credit report. This happened to me before with another law firm and another crooked collection agency trying to collect on a delinquent credit card that I never had! I did ask for validation and of course never got it. I got one more letter from them and I sent them back another letter with a copy of the first letter where I had asked for validation of the debt and they had not replied & it had been over 3 months and by law they are not supposed to contact you again once you have requested validation, only if it is to send you the validation documents. I never have heard from them again and it's been almost a year now. I guess the best thing to do in these cases is call their bluff and send them a written notarized request for documentation and validation of the debt. They then have 30 days to send you the info and if they don't then they don't have a leg to stand on and even if they should wind up taking you to court it will get thrown out.

I called the law firm of the company who served me with papers asking them for proof of the debt and who the original creditor is. The lawyers office told me that I must go to court for any type of proof of debt. They also said that if I go to court for proof of debt the judge can decide a judgment against me. Why don't I have the right for proof of this debt first?

Back in May of 2004 I had a truck that was charged off. meaning that it had been repod and sold at auction to pay the difference. now 4 yrs later Pinncale is appearing on my credit report saying that I owe them $15000 yet I have never been contacted either by phone or by writing. So My question is this how the hell do I get them to quit reporting on my credit report since the statute of limitations has passed on the debt. This is trully srewing my credit score as I would like to purchase a home. if any one can help me I greatly appreciate it.

Melissa, you have us (debt consolidation Care) mixed up with your creditor. You might want to call the number on the bill.

This is a service board and they don't issue credit cards.

Also, you might want to remove your e-mail address and not post your personal information.
