They cannot arrest you, debts are civil matters, not criminal. By threatening you with this action they have violated the Fair Debt Collection Practices Act. Which is also a civil matter. You can sue them for $1000 in statutory damages, including punitive damages of mental anguish, defamation of character, etc. Also file complaints with their states attorney general's office and the FTC.

Freaked, looks like they don't mind breaking the law. I'm surprised that some collection agencies are still stupid enough to use the "you're going to be arrested" tactic. That's a $1000 violation of the fdcpa in your pocket, as well as if the communicate the debt to a third party (like the VP you mentioned).

Record the calls, if legal, or at best keep a detailed log. Then sue them.

Lawstudent, can you have their call recordings subpoenaed? I think it could be a great thing to use.

JCEMT, sure, I suppose you could if suit has been filed. You know the bit, "this call may be recorded...". You might also demand them in discovery. That's a very interesting idea.

i been getting phone calls three times a day for a month now saying that they are with crime prevention legal department and i asked them to send an email and it came from pre litigation services..i been reading information on different sites and i believe that these ppl are scam artists

There are lots of these places.
The best thing to know:

They must provide you in writing proof of the debit, if you ask for it (I suggest send it to them in writing)
Force them to send it to you registered mail, and make them send it so that you have to sign for it.

You can also get their address and tell them to stop calling you in writing. Send registered mail so someone has to sign for it. By Federal Law they must comply and not call you again.

IF they do not it is a scam and tell them to $#@!$ off and kiss your @#!$#@!
Or if it is a legitimate firm it then becomes harassment and you are in a position to sue for damages
That is a Federal Law.
