We received a message from a Mr. Rodriguez from Burgess Law Office back on July 25th 2007. The message was left on our answering machine. Mr. Rodriguez claimed he was calling us regarding an "urgent" law suit with case number ***-*** filed through our County Clerk's office. We had no clue what he was talking and had never been informed of any pending law suit. A friend of ours whom my husband had worked with was seriously injured on the job in a company vehicle in a multi-car accident on the freeway caused by somebody else. Traffic was stopped on the freeway while an accident was clearing up ahead and some guy in a large pick-up dropped his cell phone, bent over to pick it up, and in the process smashed into the stopped traffic. Our friend was in the very front of the line of five cars. The woman in the car behind her died at the scene and my friend had to be rushed to the hospital. She was out of work for several months due to her injuries. We knew that she had filed a suit against the driver. We thought perhaps this was the law suit in question, so my husband called Mr. Rodriguez back and left a message at his extension asking him to please call him back on his cell phone.
It was after my husband had already left his cell phone number that we decided to do an internet search of the law office's phone number and also to search for that case number he had given us. We were curious to see what was going on. First off, we could not find anything under the case number he gave us in our message. As far as we could tell it did not exist. Then we found this thread. A lot of you have mentioned that the law office called regarding some old unpaid debt you once had that may have gone to collections but it had been taken care of in some form or another. In our case we have no unpaid, overdue debt. My husband has never had a credit card or anything to that effect. I've never had an outstanding debt. In fact, our credit is rated as excellent. We even checked our credit reports after hearing about this scam and there were no outstanding accounts in our credit report either. We were awaiting a call back from this law office to hear what b.s. story they had for us, but never heard a word...until today.
Mr. Rodriguez called my husband's cell phone this morning and told my husband that he had been speaking with ME at that number for the past week about a "Mary (insert my maiden name)". Mind you, my cell phone account is still under my maiden name. I had added my husband to my account prior to us getting married and have just not gotten around to getting my name changed on the account. Not only that but I do not have any relatives by the name of "Mary", nor had I ever spoken to this man at all. My husband told him he was full of it, that there was no way he had been speaking to me at that number as it was HIS personal cell number. The guy abruptly hung up. So we still have no info as to what this supposed debt/lawsuit is about. I am prepared to file a complaint with the FTC, our state Attorney General's office, and the NY State Attorney General's office. I'm just waiting for this guy to give us more than just a bogus case number. I want to find out what this bogus debt/lawsuit actually is, so I can file my complaint with more meat to it.
