As for misinterpretation by consumers, sometimes they may occur but there are some agencies that actually do make these threats. You have to realize that while most collection agencies operate within legal guidelines there are some that do not. Why else did the PA Attorney General's office and the FTC file a suit against NCO Financial for $1,500,000 for violations of the FCRA? If you do enough research you will find other FTC cases for similar acts of misconduct and deceptive trade practices. Also keep in mind that the FTC will only step in when they see a pattern of conduct from a company. If you check with sites for each state AG's offices you will see many more, such as the FL AG's office and their suit against Bass and Associates.

That is so sad that companies use their power to torture people. I hope that the advice you've received here helps you get this straight. Good luck!

I have been getting phone calls from a person that claims that he is trying to collect a debt that I owe. I have repeatedly asked these people not to call at my current and former place of employement. It has been thru some digging and found out that a 3 year old account was sold to this company. They have refused to send me any documents that will explain this debt. I told these people at one time that I would be willing to set up a payment plan once they sent me the neccessary paper work. I did not know that the account was not paid three years ago and the former Account holder never notified me that I had an outstanding balance. What I need to know is what steps do I take at this time. The phone calls to my former employer and now my current employer are causing major problems!!!
