Bethann, the SOL depends on which state you are in. Most are between 4 and 6 years, except for Ohio which is an incredible 15 years. If you got a letter from RJM, nine times out of ten that SOL has run. Recently they've been trying to collect "debts" as far back as the early 1990s. Find out your state's SOL, and if it has run, send RJM a cease and desist letter (return reciept) saying that the SOL has run. Recently on some dunning letters I saw, RJM actually prints the date of last activity (such as Dec 20, 1994, etc) LOL. As I said earlier, in many states RJM is not even licensed, which adds to any potential litigation you might wish later.

cw, send your demand for proof registered mail return reciept. I would also add in the letter, until which time they provide strict proof, any negative information on your credit report should be removed, or you will seek remedies which the law provides.

I have received two demands for payment from RJM acquisitions over the last few months. Thing is, they were both for debts that were satisfied before they went to collections, 6 years ago to be exact. Do they think people are so stupid that the will not go to their credit reports to check on the debts? Also, how does offering an expensive gift or credit card to someone as incentive to pay off a debt if they have poor credit in the first place.?!?!?

kogarah, they offer incentives because most of the debts they are trying to collect are out of the statute of limitations. They don't count on the consumer to know such things, and offer some payment (which would restart the statute of limitations).

Received letter from RJM Acquisitions stating that I owed $144.41 to Household/California Fed Visa Classic from 1984. Letter stated that I opened the account in 1982 and made last payment 6/19/84. I never heard of this company and did not have a Visa card at that time.

Bill Boyd, I can't believe that they would think consumers are that ignorant. The statute of limitations would have run on that alleged debt in any state in the nation, and very long ago. LOL and the proof is all there in their letter, (with the date of last activity). Send them a cease communications letter and tell them that per their letter with the date of last activity, the statute of limitations has run on this "debt". If they ever try to sue over it, file statute of limitations as a defense, show the court their letter, and it will be thrown out quicker than lightning. It will never come to that though I'm sure.
Darlene, if you got the same sort of letter from them, also do the above. __________________

Have they validated the debt as per the fdcpa laws? If it has been done, then it will be better to pay it off as early as possible so that you improve your credit file. WHAT IS FDCPA LAWS? |
