Hi Clarice,
Call the company and ask the reason of debiting the account. You must also send the information to your bank and request them to dispute the charges with them. The company will have to send their verification with the charges or else you will be able to claim your refund.

I contacted the company and they called me back. The man that called me back proceeded to explain that the money i have been paying is for a refinancing fee for the loan. That i haven't paid any money one the loan, and i am obligated to do so. I have made ten payments $75.00 each thats $750.oo on a $250.oo loan. Now i owe $325.00 plus the refinance charge of $75.00. This is a rip they are taking money. I never recieved any documents or recieve a phone call which the man said i did. Everything was done online i dont even remember signing for the loan. For anyone looking to to get a payday loan go into a payday place dont do it online because you will get ripped off. These people dont care if you have families to care of there taking food out of my babies mouths every month. The man told me " you just better make darn sure those funds are in the bank". I will pay them off then im reporting this to bbb. So everyone beware of paydays online you see them in your spam mailbox delete them right away.

Clarice, have you asked the bank to dispute with the company? I think your bank will be able to refund the money back.
Also, you need to file complaints with the BBB and the FTC as well as your state attorney general and request for immediate action.

The payday loan industry is very simple to understand. It is no different than borrowing money from any source. YOU ARE OBLIGATED TO PAY IT BACK. YOU WILL BE CHARGED INTEREST. YOU WILL INCUR FEES IF YOU DO NOT PAY IT. YOU ARE BOUND TO CERTAIN TERMS. If people would just pay attention to what they are signing up for, or READ the damn paperwork, they would not find themselves in trouble. LEARN IT !!!!

You have the right to say those words, provided you do it in the fair way. If you and your business are professional, I am sure you will put everything in writing and resolve the consumer complaints. Sad to say, many companies don't put the contract in writing. They just prey on signing the loan online that does not have a legal existence. I am sure you have also heard such cases, any comments on such issues. Be fair!

I have had $90.00 coming out of my account for 5 months or more. I have called SJM Marketing and left 2 messages and when I tried to send an e-mail, the e-mail address can not be found. I am going to my credit union today and have this dipusted.

I too had a payday loan with SJM. It took me a long time and a lot of fees to pay it off. The big difference apparently between me and all the other people here is that when I took the loan, it was made very clear to me that in order for the fees to stop and to get the loan paid off, I would have to call the toll free #. The guy initially reiterated that the ONLY way to pay off would be to call. Did I understand that and do I still want the loan. Why are you all picking on Darryl for expressing his opinion? It cannot be possible that I am the only person this was stated to. I will never again get a PDL.

I guess we are not allowed to put our experience here unless we are anti-payday loan. Which I am by the way. I was not agreeing with the payday loan company, just stating how it worked when I got my loan.
I am NOT a debt collector.

Your post is still there (assuming it is the one you posted at 7:42 AM 6 May 2006), it is right above your post bashing us for deleting your post at7:50 AM 6 may 2006 (which we didn't). No, you do not have to be anti PDL and only say what people want to hear in this community. There are people who have had amicable dealings with PDL's, and I do encourage people not to focus on the negative.
However, I also caution that the use of PDL's should only be in emergency situations, and that people should fully read and understand not only the lenders disclosures, but also the governing State and Federal laws. Furthermore, I recommend that if people Find them in a situation where they have no other alternative, then they should deal with Store Front operation in their home town. Internet lenders should be avoided at all costs, as this undeniable protect your right under governing law.

I am basically having the same problems as everyone above with SJM Marketing. They have been debting my account for 2 years and I have tried to track them down as well as my bank with no success, I would like to pay them off.
Can someone help.

How much is the total debt? Since you have already been paying since the last two years, you might have paid the total balance. Request for an itemized statement from SJM Marketing (1-866-722-2770) and get the present account status. If possible, close your checking account and open a new one. You will be able to stop them from making further debits in the future.

On 6/15/06, an individual receivedd a threatening call at his place of employment from someone by the name of Chris Raikes regarding a past due payday loan. Raikes said something about messages & OCR.
The following is the information given to him:
Raikes told the individual that he had violated the Federal Patriot Act and that he was in violation of fraud, internet fraud, theft by conversion, etc.
Chris Raikes advised that he had filed federal charges and had already contacted the Sheriff to advise them of this and that the sheriff would have papers and be arrested the following day, if this individual did not send a Money gram for $700.00.
Chris Raikes did not give a company name, a phone number but did give the following numbers 2006-259981 (said it was a federal court case number) and then #3567.
Also mentioned something about pre litigation and Jacksonville, FL.
Calls began again on Friday, 6/16/06, harrassing the receptionist, and was very rude, threatening her and then informed the receptionist that they needed her to give them the individual's home phone number, she needed to verify the home address and asked if she could identify the individual as they were coming to get him. These calls took place before the individual even arrived at work.
Once the individual got to work, the harassing calls began again and he talked to the 3 different people, they all gave phony names (felt is was the same person each time); gave call back numbers that were for "Kaiser" and phony. When he called these numbers back, the individual that answered had never heard of any of the 4 names that were given. One other note, one of the individuals impersonated an officer of the law and "mirandized" the individual.
We want a file number, case number, phone number for whomever this has been turned over to and cannot get one.
We have now turned this over to our local sheriff and they are going to try and investigate this company and have told us they will be filing criminal charges agains the impersonating company.
We have sent email to SJM marketing and made several phone calls and they refuse to reply to the email or give any information.
Has anyone else had this problem with harassment, being threatened?

I just got a call today from pre-litigations. SMJ marketing has been taking 60 a month out of my account since may of 2005 I finally got tired of it and canceled my account. And just today I got the call that I would be detained for $340 if I didn't send it money grahm. They quoted the Martha Stewart Act to me and said I was in violation of that. I got all the info so I could send it.
