Can my spouse be sued for a debt in my name only ?

Hi

Yes, your spouse can be sued as you both are legally liable for this debt. It won't matter much if the contract has the signature of your spouse or the name is listed on the card as the joint account holder. Legal actions are still possible and the wages can be garnished of the spouse.

actually, there are 9 states which have 'community property' laws. if you were married during any time the debt occured, and you live in one of those 9 states, then YES, you spouse can be held liable. that can include reporting to their credit also. if you incurred the debt before you were married, and your wife did not make use of the services/good you are in collections for, then they are cannot be held responsible for anything.

in addition to that, a few states actually have laws which limit how a collector can communicate with any spouse in general.
