I just received a letter from a creditor threatening to confiscate my tax refund. Will they have access to my earned income credit also? I live in Illinois.

Lupe,
I would recommend speaking with a lawyer, but a creditor would have to obtain a judgement against you in order to have a claim on your tax refuned. Your EIC is included in your tax refund. There are certain amounts of your "assests" that are considered exempt in the State of Illinois, which is why it would be important to consult with an attorney.

Lupe,
Can you tell us what kind of debt is it? Do you owe to federal government? If yes, then they can take away your tax refund through IRS. Debts to federal government and some special kind of debts, like child support can be compensated with the offset of federal tax refund only.
However, consulting an attorney will be the best move on your part.
