I got a summons in the mail today from a city I used to live in 5 years ago (2001) Wwe moved in April 2001 so we never refived a bill for the personal property taxes. I got a letter about a month ago notifying me owing the back taxes. I called the treasury department and they said they don't prorate taxes. We only lived there from January - April 2001. I only owe $169. I want to pay this but cannot until June 16. The court appearance is June 22. My question is should I call the court or treasurers office and tell them I can pay these taxes on June 16. The summons also says "Warrant in Debt" To Defendent: You are not required to appear, however if you fail to appear, judgment may be entered against you. THis part is confusing to me. SO do I need to appear in court or can I just pay the taxes?
Also my husband is now deceased and the summons was addressed to him and myself and his name is also on the summons does this matter?

I would try to get in touch with the clerk of the court where the summons came from and see what they say. The summons may just be standard procedure like when you get a traffic ticket it always has a court date on it. I would definitely pay it by the due date and proceed from there.

Hi Sue thanks - The summons came from the City's treasurer's office. I'll call them on Monday. This was for back taxes in 2001 - I guess the treasurer department is cleaning out their closet so to speak - we moved in 2001 I din't thinkwe woule need to send them a change of address! Taxes in Virginia come out in May to be paid by June. I had to call the Clerk of the court in the same city when I got a traffic ticket to make sure they got my payment, just to make sure I didn't have to go to court LOL!! Thanks for your suggestion!

You should be able to pay the taxes to the court before the court date. This way you won't have to actually appear in court. I would call them on Monday to see what arrangements can be made.

oh2benc2, you can take some advice of a tax attorney and pay off the tax before the court date. Show the receipt to the judge and there won't be any judgments against you.

I thought it was a summons but on the paper it is called "Warrant in Debt" for back taxes in Virginia) I called the clerk of the court and she said to call the lawyer who is in Florida-which I did and left him a message to call me. The court date is June 22 so I have at least one month - I can pay the taxes on June 16. Thanks for your help.
