Everyone is concerned to improve his CR. Not paying the debt will hurt his file and he will be denied credit in every phase of life. So, people understand the need to pay the debt.

There are times when people have to go through hard financial problems. It is at this phase collection industry comes into picture. Not all the people try to escape their debts and not all CAs are doing fair business. We have this discussion board on collection industry and it has large number of people agreeing to pay the debt. But they want to see their accounts in accurate shape before making any payment. Sadly, the CA is misrepresenting their debt and forcing them to pay an amount that is objectionable.

This is the 2nd call from these people in a week. I have asked them to send me a debit validation letter on their first call. They claim they sent it....I have not received it. Today this man called and said my employer would be notified tomorrow if I didn't agree to make payment...he also wanted the name of my lawyer. I explained that last week I had asked for a letter and had received nothing. He said they mailed it and are not responsible for th US postal service. I asked him again not to contact me at work and that he couldn't contact my employer. He just kept persisting and I finally hung up. I have had PayDay loans and have paid them...so I really am not sure what he is talking about. How do I go about handling this, since they don't seem to be listening to me

Donna,

If you have hired an attorney, file charges against Eliot James. He does not have any genuine reason to contact you and it seems hard to stop him unless you have taken legal aid.

Also, file your complaints at the FTC, BBB and the state attorney general office. They are regularly receiving complaints from many other consumers like you.

I'm being threatened by the same company for a payday loan that I had over two years ago. I got a call yesterday from a lady by the name of Renee James telling me about a check advance debt that I had out. I was given the name of the Marketing place but not the actual name of the payday advance company. She told me that I had until 6:00 PM to send 215.70 by Western Union or they would proceed legal action including fraud for not paying the loan off and not having this checking account open, anymore. I told her I would like something in writing but she refused. I'm willing to pay my debt but I have to make arrangements with the company. Since I didn't send the money, she told me I would owe an additional $700 and that I would have court papers sent to me in two weeks. She advised me to get an attorney. I'm more than willing to make arrangemnents to pay this debt but I haven't received any paperwork in the mail just harassing phone calls. She said that I could not have the address and phone number to whom I owed the debt to and that her company was handling everything but they want a lump some up front, not payment arrangements.

Welcome to the forums.

The fdcpa law forces any collection agency to give you the details of debt validation when you have requested for it. If the company says that they are not required to give you anything in writing, there is a problem.

Send a debt validation request in writing to the company's mailing address through certified mail with return receipt requested. The company will have to respond to your request and if they don't, you will make your case stronger. Check your credit report and see if they have reporting anything that is hurting your credit worthiness.

You can refuse to pay the account until your account has been put in writing. Do not get intimidated by the company. They are trying to scare you so that you send money to them without giving a thought. Make sure that you do all your correspondences in writing. You will have your basis covered.

If recording of the phone call is permissible in your state, start doing it. If it is not, you can inform the caller about your actions so that you can take a legal counsel. Be sure to inform him about the recording of the call, otherwise you might end up in troubles.

It is believed that Taylor James and Associates is not into legal debt collection practices. So, be sure that you have enough proof before you file charges on them.

I got a call yesterday from Taylor James and Associates. I made a Quick Collect pay of half of what I "owe" because they scared the life out of me. I don't have any outstanding loans, but I thought that maybe I had overlooked something from my past. I just sent a letter of intent to them this morning for the remaining half. What should I do?

Take my words, Taylor James is using illegal means while collecting the debt from people. Don't pay anything to them because they don't have your debt account. If they are having it, they should present you the complete details of it. Ask them to validate the debt so that you can get the latest standing of this account.

I understand that you might owe some of your debts. But you will like to pay the money only to that agency that actually holds your account. A legitimate company will have the complete details of your account before they collect the money from you.

Read the forum postings on Taylor James in this site. Many people have been scared to death as it happened with you. But getting scared and sending money to this company will not clear your debt account. Know your legal rights before you are contacted by any collection agency. It might happen that sometime later, another collection agency will contact you for the same account. You won't be able to prove that you have already sent the money because Taylor James will completely disappear from the scene.

If you have any queries, feel free to post it here. But don't send money to Taylor James. You will find lots of complaints against them at the local attorney general office as well as in the FTC and BBB.

roxette and ben and all who have been hurt by these payday loan lenders, i want to let you know that i looked up taylor james and associates after receiving a call from them on my e-cash now account. my experierence was much different than yours, infact i let them know about this sight and what had been said, i think this sight is good, but i do feel that your opinion about this company is wrong. i personally looked up taylor james with the bbb and the attorney generals office. they did have one complaint on file with the bbb which was settled in good standing and there was no complaints filed with the florida attorney generals office. i also called e-cash and they let me know that taylor james was representing them. they did ask me for the payment up front and i let them know that was impossible. they then set me up on a payment plan. i think that maybe you need to get the facts before jumping to conclusions. taylor james was not only professional but also vert polite

Just an FYI, several complaints have been getting processed by the BBB. If you look at the file that the BBB has created for Taylor, James, and Associates...you will notice that the first complaint lodged was created in November. Trust me, more complaints will start to file in, and that number will go up.

Also, please share more about your experience with the company. You said you mentioned this site. Perhaps that was a way for them to tone down their behavior. But it appears more harm than good is happening.

My collection agency made me aware of the postings, and I first want to express to all of you that after reading these complaints, your knowledge of the contract that was signed when you took out this loan may need to be reviewed. These high intrest loans are where they are because of debtors not paying them back. Just to give you some facts, 75% of the loans that we provide do not get paid back in accordance with the contract. Of those 75%, 30% take the money and run. Besides that I would like anyone that goes on this site that originally got a loan from "fast-cash" that Taylor James is legit and I do receive forwarded payment from them monthly. Everyone bashing this company that has not dealt with them directly should keep there oponions to themselves.

My dear Taylor James client, I think you should contact the Florida Attorney general and explain the facts you mentioned here. They have the proof of every consumer complaints. You might need to reconsider everything.

i got a loan ( Pay day ) through a company called moneyline ( well it shows up on my banking account as M L inc. ) i dont know how to get in touch with them to pay off my loan. Cant find nothing online about these people and was wondering if you could maybe help in locating a phone number or something to get in touch with them

After researching the post from the "Taylor James Client", it has been found that the post came from the offices of Taylor James himself.

"Taylor James Client"

It's odd that harassment still continues from Taylor James & Associates. You claim you're a client of the company harassing people, yet the IP address comes straight back to the person harassing people.

Perhaps we should get "fast cash" involved, and tell them they have hired a deadbeat who claims he is paying the money back to the lendor.

Mike, I could easily figure it out from the post of 'Taylor James Client' that it is coming from their office. Thanks for confirming it.

I guess they have lost all their reputation in the collection market. They are using ways to restore it. Guess, what happens when these people call somebody and the other person says, "hmm...Taylor James & Associates, I have read so much about your company. You must be calling me to make some money by using illegal means...." Let us all give these people tough luck each time.

MoneyLine will try to work with everyone who has short term problems and cannot pay thier debt. We choose to out source our collections because of the high fraud rate with the internet payday loan sites and it is more cost effective than for us to deal with hundreds of people who first never paid back their loans, but further simply closed their account after they received our money and think they found a new way to play the lotto. Mikeyindetroit has some good advice and knowledge but here is a bit of advice for all of you from a lender in the payday loan industry. If Taylor James & Associates contacts a customer who used your services, and is now trying to collect on that debt, then they should be able to provide the proof or validation of the debt.

I'm not defending anyone who has used a payday loan and defaulted on it, because I know everyones story is different. I'm giving them the benefit of the doubt, only because I was put in a position when I first used a payday loan, and it defaulted. The default WAS NOT my fault. Because of this, I am mostly on their side.

It appears that Taylor James & Associates are doing illegal business. They are threatening arrest, pretending to be officers of the law, and even pretended to be YOU! This of course, was proven to be wrong, only after tracing their IP address. The company has done nothing but lie and threatening arrest. Because of this, complaints have been made.

If the accounts have been turned over by your company, you are no longer allowed to deal with the customer; they must go through Tayor James. It becomes difficult to do business with them, when they are unwilling to provide receipt of payment, or proof of debt. Everyone is trying to go through the proper channels, and hopefully everything will end up all right.

After reading through the forums, you'll notice that certain Jacksonville collection companies are now ending up in court. Many people have made payments of outrageous amounts for fear of getting arrested. Only to realize later, that their account was then sold again, and the money never being posted. These companies are pocketing the money, and running. This is mainly why people are afraid of Taylor James...same scare tactics, same location, same crazy phone calls.

Perhaps you should think about who you have hired to do your collection efforts.
