Sub: #1 Taylor James and Associates threating legal action

I just received a call from Elliot Masters at Taylor James and Associates. He said he represented a company called Money Line and that I had taken out a loan and revocked my authorization at the bank and they were proceeding with legal action, namely a charge of fraud and providing a worthless check. They would be proceeding through my employer since I had applied for the loan on my work computer. He wanted the name of the manager so he could varify information the company would be requesting. He spoke very politely and said he would check with the loan company to see if they would allow me to make restitution in full today, before he proceeded with contacting management at my company. I ask for the name of the company that had provided the loan because I had not received anything from MoneyLine. He said MoneyLine provided the money and he was not sure which company the loan was from. I told him that he did not have premission to contact anyone at my place of employment and he said he did not need my permission to contact my place of employment. He said he had received information from my bank this morning that I had rescended authorization for withdrawal for the loan company, which is true. What do I do when he calls back? I only have 2 loans left to pay off but have not been able to get responses from them. I don't even know which company he represents.

As with any collection company, they have laws (not rules) to follow. When they break one of the laws, you have right to follow suit, even though you did default on the loan.

The next time they call, tell them the call is being recorded and that you want to cease & desist telephone contact and wish to only be contact through mail.

Once you receive a letter, mail them a request for validation letter. There are certain precedures they have to follow when it comes to debt collecting.

Mike

He called back. It took him a minute to figure out what name he had used when he called me. He said that if I paid the $673.40 by western union by 2pm western time he would pull the ciation. If I did not he would contact ???? (he gave me the name of the owner) to see if I had permission to use my company computer to commit fraud. I told him that effectively emmidiately

Hi Kathryn

Please handle this situation without getting scared. You do not need to feel nervous even if he gets your job info. The person is trying to collect a debt from you and you are required to get the details of the accounts in writing first.

Tell the person to give you the name of the company that is trying to collect this debt. You wish to send a letter asking for debt validation so that you can proceed further towards making the payment. If he won't give any company info, you won't be able to make sure whether the money is going towards the debt account or if they are holding it legitimately.

You might need to record these phone calls so that you have a proof of everything you tried to convey. Tell the person that you are recording the call for legal and fair reasons. If it is a legitimate company, they won't hesitate in giving you in the necessary details.

Did you pull your latest credit report and see if something new is appearing or not?

Regards
Roxette

Nothing is listed on my credit report from them. I know I had several payday loans but I also know which ones I did stop payments on. I called the 2 I still have outstanding and they said the accounts had been sent to ART. He said he could not tell me which MoneyLine company this account was for. So I don't know which one to contact. I have the contact information for the ones still outstanding. I am willing to pay the accounts off, but I can't pay $673.40 all at once.

I will contact the original lenders and will first verify if the accounts have been sold to outside collections. If not, then I won't pay much concern to this incoming call.

Even if the account is sold, then the lenders will be able to give the necessary details of the collection agency. I am suspicious of this call coming to you because it does not have any necessary information on debt validation. A legal CA should be completely armed with all the legal documentation for collecting debt. I hope you should contact the lender first.

He told me he represented MoneyLine. I told him I looked at my bank records and there had not been a deposit to my account from MoneyLine. He said MoneyLine supplied money to several companies and he wasn't sure which company I had used. Needless to say I didn't pay them. I contacted the 2 companies that I have outstanding loans with and neither was dealing with this company. One had turned my account over to Accounts Receivable Tech and the other 1st Credit. I haven't been contacted by either of these companies yet. Should I try to contact them?

I will suggest you to explain the complete matter in writing and send it to the mailing address of the collection agency. Since you have not received any loan from MoneyLine, you have no legal responsibilities to pay to the CA. Or they should have given you the necessary info before requesting payment.

Do send your letter through certified mail with return receipt requested. This will prove that your letter is received by the company on the specified date and later you will be able to prove it if the matter is taken to the court.

I just figured it out, 1st Credit is also known as Taylor James & Associates. Try asking them if they are also known as 1st credit and see what they say, and let me know because I had Taylor James call me and I called the number on the caller ID at my home and it was a company called 1st Credit.

1st Credit was the company JD Marketing said they had turned my account over to for collection. Is JD Marketing one of MoneyLines names? I only have 2 accounts to payoff but have not had much luck getting cooperation on making payments. Thank you for the help.

Hi Kathryn

Are you talking about First Credit of America?

Please have a look at this thread and see if this is the company that you are referring to.

I fell for it, sent the money, and now I found out they are frauds. I was in the same situation as Kathryn having several payday loans, not knowing who was calling me, I was scared of losing everything. If anybody else sees this, DO NOT SEND THEM ANYTHING, as a previous response I read says, there are laws surrounding debts - now, I know!!! By the way, I plan to see legal action through with them. They may also be using another problem company Ellis & Crosby - sound familiar? Also, does anybody have another Phone # or info on any of these people?

Do not send money, they are all frauds - get an attorney instead of an education from the school of hard knocks

I received a call today from David with Taylor James and Associates. He was very polite and explained that he had been made aware of my postings concerning the company and that he was calling to get additional information concerning the previous call I received from them. He stated that their company policy was to always follow fdcpa regulations. Additionally, he provided me with the information on the debt I had requested during the first phone call and he set up reasonable payment arrangements with me. He requested I send a letter of intent with the payment arrangements. This was a much different call than the first one.

Kathryn

How many calls have you received pertaining to this debt? Chances are, they were all trained the same. He just realized that people are aware of the business practices of their company, and under careful watch.

Only twice. The first call on Nov 21st was the reason for my posting and then the call from David today.
