A few weeks ago I recieved a letter from these guys saying I owed them money for a bally's account. I never was a member there so I sent them a dispute letter asking for validation and all the documents required for proof of the debt. Today I recieved another letter but I recieved none of the requested info except for a paper that said "last transaction date" with no date provided and the principle fee and interest, with no sign of how it was calculated or anything of that nature. Below my name and adress was listed with a partial S.S# that did not match mine. I'm not really sure where to take it from here. Any suggestions? Thanks in advanced

Asset Acceptance has recently gotten into trouble for doing this exact thing, trying to collect from someone who does not actually owe the debt. If you know for sure this is not your debt, I would take all the correspondence you have had with them and logs of all the phone calls, and if possible and allowed in your state, record the next phone call you have with them. Tell them that they have the wrong person. Then give all this info to the FTC or attorney general's office. This CA is famous for this. If they say you did not dispute the debt, they will make the debt valid, even though it is not yours...then it will end up on your credit report. If I were you, I would also obtain a copy of my credit report and make sure they are not already reporting it.Send all correspondence to them certified return receipt requested, and keep a signed copy of whatever you send them.

There is an article on Buddhibbs.com that tells about the current stunt being pulled by Asset Acceptance. These collection agencies will stop at nothing to make a quick buck at our expense.

Thanks for the responses guys, I did send them a dispute letter certified mail and recieved a reciept. I have also recieved a credit report and nothing from them showed up. I dont see how it could if they dont have my SS#. I am sending them another letter out monday stating they never sent me any type of validation. I could understand a debt if I had actually owed one, but I was never a member of ballys, sad so many others have to go out of their way to try and resolve something they never had anything to do with

jubei031, do not get too much serious on this issue. You must know for sure that you are not the person they are looking for. Since you never had a Bally's account, it is a case of mistaken identity. The collection agencies have a huge log of consumers' data and SSN# in errors. This mostly happens when data is received completely jumbled up from the credit companies.
You must be sure of not failing to dispute on anything sent to you. If you start ignoring it simply because it does not belong to you, the CA will get strong evidence to prove in the court that you are trying to be irresponsible in paying it. The judge will see that you are not appearing in the court in case a charge is filed against you. Not knowing the real reasons, he will make this debt legal and unfortunately, you will have to pay it.
Make sure that you have disputed and explained everything IN WRITING for proving the facts. Clearly mention that this debt does not belong to you since you are not the person they are looking for. If they still believe you owe, it has to be proven with your real SSN# and valid account details of Bally's. Send this letter through certified mail and keep a copy of it for proving the facts in court (if required).
