I just noticed a $9.95 debit on my checking account AND incurred a $30.00 overdraft!
I called the company 800-809-5986
I demanded the address:
USA Benefits
1 Millennium Drive
Union Town, PA 15401
Told the guy what a scam this was and informed him that I would be writing my congressman, state rep's and report to the BBB.
If everyone would do the same we might get some attention.

I want no part of usa benefits i didnt know i was even enrolled.
i woud like a refund of the monie you took from my account. Im calling the better business bureau and
reporting you for fraud.

I have been charged for a few months and I finnaly called my bank. You can fill out an "unauthorized debit form" at your bank and they will stop it and hopefully you will get your money back through the bank. It does not cost anything at my bank because it is not stopping a check I wrote or stopping something that was originally ok'd by you. When filling out this form you are basically stating that it is a fraudulent charge. Check with your bank.

I just realized i was getting the charge and i never clicked to receive any report or loan. I called my bank and they told me to fill out an affadavit for fraudulent unauthorized charges and i will get my money back and stop payment to them. it will not cost me anything either. I love Citizens bank.

If you file a police complaint at the same time, it will speed up your legal actions in recovering money from USA Benefits.

Have you already sent money to them? Then do what Kristy has said above. Call your bank and fill out the form to stop unauthorized debit. It will help you to stop unsolicited withdrawals from your account and can help you to get your money back through your bank.

First things first the employees that work for USA Benifits have not read the membership agreement. I to had a problem with them. It can be solved quick and easy. You tell them you have read their memebership argreement and it states this: At the end of the thirty-day trial period, we will debit your checking account in the amount of $9.95. The cost of retaining membership is $9.95 per month. You may cancel your service at any time by contacting our Member Services Department. If for any reason you wish to cancel during the first 30 days after your checking account is debited, you may do so and receive a full refund of the monthly membership fee.
Then what happened with me was the girl I was speaking to had to speak with her supervisor. She then got back on the line and said they would deposit my money back into my account. In about a week I received my money back. The only reason I was able to find the membership agreement is because I searched my hard drive for anything that had the words USA Benifits in it. It lead me to a page from a payday loan. I then copied and pasted it in to microsoft word and saved it. Hope this info is benifical to everyone.

I got my money back by going to my bank and filing an affidavit stating that i did not authorize the 3 withdrawals this company had made to my account. It took my bank one week to refund my money. Please Please Please, file with your bank so that eventually this company appears on the banking industry's radar.

No problem, I am happy to help. It is tough dealing with people on the phone. Nine times out of ten they work very hard to hurt you instead of help you. You ask for a supervisor and it is the reps friend. So you really do not get anywhere.
The first person I spoke with was very rude and refussed to put the money back into my account saying it was not their policy. He then informed me that they sent me an email confirming that they would start to withdraw from my account. I explained to the guy I did not receive that email and even if I did I probably deleted it because I did not recognize it. I explained to him I do not open emails that I do not recognize in fear of a virus on my computer! Eventually I hung up on him because he was very rude and just wanting to argue. That is when I found their membership agreement. And was like in your face!!!!!!!! Ha Ha I beat them at their own game. I wish I could post a website that will give this info, but I can't find it in my computer. If anyone would like to view the full membership agreement I will post it next!!!

MEMBER AGREEMENT
This Agreement contains the Terms and Conditions of
being a USA Benefits Member
NOTICE
NOTICE TO CARD MEMBER:
(A) DO NOT USE THIS SERVICE BEFORE YOU READ THIS AGREEMENT.
(B) THE COST TO ENROLL IN THE USA BENEFITS PLAN IS $9.95 FOR THE FIRST MONTH AFTER THE FREE TRIAL PERIOD, WITH A RECURRING MONTHLY FEE OF $9.95 (C) ANY HOLDER OF THIS CONSUMER AGREEMENT IS SUBJECT
TO ALL CLAIMS AND DEFENSES WHICH THE DEBTOR COULD ASSERT AGAINST THE SELLER OF GOODS OR SERVICES OBTAINED PURSUANT HERETO WITH THE PROCEEDS HEREOF. RECOVERY HEREUNDER BY THE DEBTOR SHALL NOT EXCEED AMOUNTS PAID BY THE DEBTOR HEREUNDER.

Fee for Returned Payments...$20.00
This Agreement contains information about the use of this Membership and explains the terms in which both you and we agree to be bound by. In this Agreement the words "You", "I", "My", and "Me" mean the Member. "We", "the Company", and "Charge Account" mean USA Benefits, Inc., located in Uniontown, Pennsylvania.
This Agreement describes the Terms and Conditions under which my USA Benefits Membership is issued. I certify that I am at least 18 years of age and the information I provided to USA Benefits in order to obtain this membership is true and accurate. I understand that my use of the membership constitutes my acceptance of this account in accordance with the terms of this Agreement.
RETURNED AND NSF ACH PAYMENTS: In the event that my membership fee or monthly fees are returned due to non-sufficient funds, USA Benefits may immediately attempt to collect the full amount by representing my ACH authorization to my original banking institution. Any subsequent withdrawal attempts by USA Benefits will not exceed the unpaid membership fee or monthly fees. Furthermore, I agree and understand that if USA Benefits is unable to successfully process my electronic payment, USA Benefits may cancel my membership. I will also be responsible for a $20.00 returned payment fee for each returned payment.
MEMBERSHIP: As a Member, you will receive enrollment into USA Benefits. Enrollment in your USA Benefits account requires activation. Upon activation with USA Benefits, you are bound by the User Agreement. You will be billed $9.95 every month thereafter in which you maintain your Membership beyond the free trial period. We will not debit your checking account for this service during your free 30-day trial offer. At the end of the thirty-day trial period, we will debit your checking account in the amount of $9.95. The cost of retaining membership is $9.95 per month. You may cancel your service at any time by contacting our Member Services Department. If for any reason you wish to cancel during the first 30 days after your checking account is debited, you may do so and receive a full refund of the monthly membership fee. After 30 days, refunds will be pro-rated based on the unused portion of your subscription. If you cancel your subscription and then later re-subscribe as a paying customer, USA Benefits reserves the right to deny you a refund for the second and any subsequent cancellation. This is not a credit repair service. Note: You must submit a valid email address in order to receive the free USA Benefits trial.
APPLICATION OF PAYMENTS RECEIVED: Payments received are always applied to any unpaid late fee(s) that may be owed first, and then the rest of the payment is applied to any unpaid balance.
DELINQUENT ACCOUNT: My account is considered delinquent if the Monthly Payment is not received by USA Benefits by the due date. If this occurs, a $10.00 late fee may be charged against my account.
DEFAULT ON ACCOUNT: I will be in default if: a) I fail to pay the monthly payment when due; or b) I breach any of the Terms and Conditions of this Agreement. If I am in default, then upon compliance with applicable law, USA Benefits has the right to: a) demand me to pay the entire unpaid balance on the account immediately; b.) suspend membership until the default is cured; c.) proceed with legal action.
REFUND OF MEMBERSHIP: You may cancel your enrollment into the USA Benefits within (30) days. To receive a refund of a pro rate portion of your monthly recurring fee, you must first contact USA Benefits to obtain a REFUND AUTHORIZATION NUMBER. REFUND GUIDELINES MUST BE CAREFULLY FOLLOWED TO ASSURE A PROMPT REFUND OF MONIES. You must allow at least 7 business days for any applicable refund to be processed
APPLICABLE LAW: The law of the State of Pennsylvania covers this Agreement.
SHARING INFORMATION WITH THIRD PARTIES: We may disclose any of the information that we collect to our affiliate companies. We do not share information with any non-affiliated third party except in select circumstances when a business partner refers you to us and you give us permission to share information with that business partner. When identifying methods of improving our products and services or if we think a product may be of interest to you, we may arrange to extend offers of goods or services to you either directly or through our affiliates. In addition, we may disclose all of the information we collect, as described above, to companies that perform services on our behalf such as the credit reporting agencies from which we obtain your credit report(s), credit card processors, email communications management firms or call center providers. We may also disclose nonpublic personal information about you to nonaffiliated third parties as permitted by law.
I certify that I have read, understand and agree to all the Terms and Conditions and Disclosures written in this Agreement. I certify that all the information I provided to USA Benefits is true, accurate and verifiable. The information about the costs of the membership described in this application/solicitation is accurate as of December 2004. The information may be changed after that date. To find out what may have changed, write us at USA Benefits, One Millennium Drive, Uniontown, PA 15401. If the Member does not agree with any changes in the terms and conditions of the account, the Member may close their account without incurring any penalty. Please note that the Member will be responsible for paying all outstanding balances in the event they close their account.
Terms and Conditions of this Program may be modified and Services and Benefits may be added or deleted at any time.
STATE NOTICES
NOTICE FOR CALIFORNIA RESIDENTS: California law requires that we inform customers that should they fail to fulfill the terms of their payment obligation, a negative report reflecting on their credit record may be submitted to a credit-reporting agency. If you are married, you may apply for credit in your own name.
NOTICE FOR FLORIDA RESIDENTS: You (borrower) agree that, should we obtain a judgment against you, a portion of your disposable earnings may be attached or garnished (paid to us by your employer), as provided by Florida and Federal law.
NOTICE FOR MAINE RESIDENTS: We may request a Consumer Report in connection with your request to be considered for some other USA Benefits Product. You may ask whether we obtained a Consumer Report and we will tell you the name and address of the Consumer-Reporting Agency, if a report was obtained.
NOTICE FOR NEW YORK RESIDENTS: A Consumer Credit Report may be requested in connection with this application or in connection with updates, renewals, or extensions of any credit granted as a result of this application. Upon your request, you will be informed whether or not such a report was requested and, if so, the name and address of the agency that furnished this report. New York residents may contact the New York State Banking Department to obtain a comparative listing of credit card rates, fees and grace periods. New York State Banking Department 1-800-518-8866.
NOTICE FOR MARRIED WISCONSIN RESIDENTS: No Agreement, unilateral statement or court decree relating to marital property adversely affects a creditor's interest, unless prior to the time credit is granted the creditor is furnished a copy of the Agreement, statement or decree, or has actual knowledge of the adverse position.

Good Morning Everyone,
Just wanted to let you know that after talking with a rep from USA Benefit and threating to go to the BBB, I received my refund today. They kept trying to tell me that I agree and I told them that I did not and had all my paperwork to prove it, then the rep told me she had to put me on hold to talk with her supervisor and she came back to the phone and told me that they would reimburse me, this was on 10/30/05 and my account was posted today. So don't give in just keeping trying and be very careful the next time. GOOD LUCK ALL
