update on the school debacle

Well I am going to have to hire a lawyer. This is so aggrivating. The school said that I should have purchased insurance from them to protect my child at school. WTH! Why would I have to protect my at school when by law I have to send him there.

I've spoken with an attorney today and I am expecting a return call to see if he will handle the case.

...for accidents caused by school negligence?? This is where your son slipped by the water fountain correct?

When I was in school we were not allowed to leave school grounds at lunch because the schools insurance would not cover it if we got hurt. Do they no longer carry insurance?

I just asked a whole bunch of Moms and they all say that the schools must carry insurance. I never heard of them selling it! I can't believe what I am reading here.

The school should have a general liablity policy for incidents such as this.

I agree with Volley!! Why should "U" have to pay for school negligance? That's ridiculous!!!!!!!!!!!
And school's ARE required to carry insurance for these such accidents!
Rolling Eyes I guarantee u, once they find out an atty is involved they will be more than willing to settle this matter quickly!

I remember paying for y kids school insurance in case they got hurt...like on the playground or in gym...definitely wouldn't be negligence on the schools part!!!!

If you slip and fall because there is water on the floor next to a drinking fountain...that's negligence and your health insurance regardless of where you bought the insurance...shouldn't have to cover it!!!!

She told me that the school will not cover it that if i had purchased the insurance then it would have covered it. I haven't heard back from the attorney yet I hope to hear from him today if he will take the case on because I am getting more mad sitting here thinking about it.

He wasn't even running when it happened. All I want the school to do is pay the bill and put out mats or signs near the bathroom for the water or to tell kids to excercise caution when walking there.

I didn't argue with her about it. I just said ok and called my husband and he told me to contact a lawyer.

That the best way FYI..no sence arguing with someone who probably doesn't make the decision anyway. Hopefully a simple letter from the lawyer to the school district will be all that is needed.

You handled it well. No sense in escalating it between the two of you. Let the lawyer handle it. Do you have regular health insurance just in case?

In all honesty I can't afford the health insurance my company provides. It's sad, it would take more than 1/2 of my check to be able to provide coverage for my family.

FYI, I am so sorry. Your child's school is crazy. I agree with ang. Maybe once they hear an attorney is "on it", they may change their tune. How sad. It's not like you're asking for a million dollars. Please keep us updated on what's going on.

I thought the insurance that the school sold was just a form of medical/health insurance in case the parent didn't have their own coverage ...

The school would definitely have some sort of contingent liability just by virtue of the fact that they did not exercise due diligence in keeping the floors dry.

Imagine if your landlord didn't put salt on the stairs outside, they iced up, and you slipped down the stairs because of it. Do you have to buy insurance from the landlord to protect against his own negligence? The answer is no.

I think this lady's response is just the school's 'first line of defense'. 8 out of 10 people would probably just accept her excuse and drop it. But the sqeaky wheel does get the oil. Keep at it and good luck!
