How can you deal with GC Services debt collection agency?

A lot of collection calls can be very harassing. Here is what you can do if a collection agency harasses you:

  • Dispute wrong debts:
Under the Fair Debt Collection Practices Act (FDCPA), a collection agency (CA) must ensure that they contact the right person when pursuing a debt. It is not a violation of the FDCPA if the CA makes a mistake due to an error in their record keeping. However, once the CA has been informed that they are calling the wrong number, under the FDCPA they are required to stop.
  • Expiration of the SOL :
Sometimes collection agencies keep calling about a debt even after the Statute of Limitations (SOL) on the debt has expired. If you know the debt you are being called about is yours and the SOL has expired, then you should remind the CA that they cannot sue you for the debt. However, even if the SOL has expired, you will still owe the debt.
  • Report misleading tactics:
Under the FDCPA, a CA cannot mislead you in any way. If a CA causes you any damage as a result of misleading you, or by violating the FDCPA, you are allowed to sue them for punitive damages. In addition, the CA may be subject to a fine for up to $1000.
  • Legal help for continued call harassment:
Once you have sent a dispute letter, the FDCPA requires all collection calls to cease until the CA has validated the debt. If you decide to sue the CA, you should have copies of all the written correspondence, including envelopes and mail receipts to present to the court as evidence. You may record the phone calls made by the CA but you need to inform them before you do it. Once this is done, you may contact your State Attorney General’s office and file a complaint.

GC Services or GC Services Collection agency seem to be born violators of fdcpa and FCRA .We go to them to consolidate our debts and hope that they follow the book, but they seem to be least bothered about reputation. They always have people to vouch for them.Their services are the worst but I have had no problems of harassment till now. If that too were added the picture would be complete.

Media attention might very well help to bring down the debt collectors who engage in illegal activity.

You should make sure that you keep good records of all of your contacts with these companies.

Take a log of when the GC debt collectors called. What threats they made during the conversation and the frequency of the calls.

This would help to bolster support for your claim of harassment.

And also, if the collectors start making threats, you should also consider taking legal action against them. because this is illegal under the fair debt collection act.

I've had two caller ID's from this GC Services phone number, listed on the ID as "Operations Division". I searched and linked the number to GC Services. I have no outstanding debt, no reason for a bill collector to call me. Got a call also from 877-290-8894. This is also another GC Services collection agency phone number. They've called but have hung up immediately when answering once, and didn't leave a message the next time. I've had a similar situation with other unknown numbers calling and there is no one there or there is a hang-up. I believe now these could be "phishing" calls - just checking to see if the number is answered/active. Beware of these types of calls. Any other information on this company is appreciated.

Beware!! I received calls from Mr. Suaez, Ms. White and Mr. Nixon. Mr. Nixon said if I paid what I could and explained my issues that he had connections to take of the problem. Ms. White called up and quotes Flordia law to me. If you callme in my state your are subject to my state laws...Ms. White said no she wasn't. The key is to submit a FTC request requesting contact stop (send it certified). Once they acknowledge the letter, they also aknowledge that further communications is illegal. If the call again, file a crimal complaint (list the name of the person who made the call) and a FTC complaint.

I just had the same experience -- these people called and didn't leave a message. I googled the number and ended up here. I also have no reason for debt collectors to call me, so I'm scratching my head. Is there a GC Services collection agency fax number where I can send them a written correspondence? Or should I send a letter through certified mail?

Sub: #19 Hi dr You have given limited information regarding this matteMon, 12/05/2005 - 16:08

Hi dr

You have given limited information regarding this matter and according to what I have understood, you should talk to your bank. They will verify this account with the company and if they fail to give the required details, the money will be credited back to your account.

If you are unable to get a refund from the company, you might have to consider closing the account in order to prevent future debits from this company.

Hope that you get positive results from your action.

Regards
Roxette
