How can you deal with GC Services debt collection agency?
A lot of collection calls can be very harassing. Here is what you can do if a collection agency harasses you:
- Dispute wrong debts:
Under the Fair Debt Collection Practices Act (FDCPA), a collection agency (CA) must ensure that they contact the right person when pursuing a debt. It is not a violation of the FDCPA if the CA makes a mistake due to an error in their record keeping. However, once the CA has been informed that they are calling the wrong number, under the FDCPA they are required to stop. - Expiration of the SOL :
Sometimes collection agencies keep calling about a debt even after the Statute of Limitations (SOL) on the debt has expired. If you know the debt you are being called about is yours and the SOL has expired, then you should remind the CA that they cannot sue you for the debt. However, even if the SOL has expired, you will still owe the debt. - Report misleading tactics:
Under the FDCPA, a CA cannot mislead you in any way. If a CA causes you any damage as a result of misleading you, or by violating the FDCPA, you are allowed to sue them for punitive damages. In addition, the CA may be subject to a fine for up to $1000. - Legal help for continued call harassment:
Once you have sent a dispute letter, the FDCPA requires all collection calls to cease until the CA has validated the debt. If you decide to sue the CA, you should have copies of all the written correspondence, including envelopes and mail receipts to present to the court as evidence. You may record the phone calls made by the CA but you need to inform them before you do it. Once this is done, you may contact your State Attorney General’s office and file a complaint.

I called these same people just now and explained to them I do not have a Capital One Card. They at first told me that the only way to stop these calls was to be home when they call. I am at work when they call. I got a supervisor and explained to him that I do not own credit cards because that is a way to get in debt. And that also I am rarely at home in the middle of the day. He took down my number and said that my number should be removed and if i should receive any more calls to tell them I am not the person they are calling.
I get call from 713-271-3899 on my home phone while I'm at work...now I just got one on my cell. I am not behind on any of my payments....wonder what's going on...I do know it's aggravating!
I have been getting calls for a month. on my CELL. so finally i answered, i mean i did at first the typical happened. this time i went insane on some guy yelling the words liar liar liar about nine times. He ended up getting his manager Lina 877 290 8894 i yelled at her too and questioned her ability to be merciful to americans and humans. I offered to call her night and day. she said the whole collection agency bull and i then told her i want my name off and that if they call again i will find her and meet her in person and show her how disatisfied i am with GC Services. One thing for sure who ever owns that company if i get his name im gonna put it on a ***

my advice call and ask for your number off the list, whats the worst that can happen
I got the 877 # from one of the above replys and I called them to complain about being constantly called by the famous 713 # and I asked her to remove my 13 year old son's cell phone # from the list... She said she would do so(yeah right) and when I asked who to call if the calls persisted, she said they should stop. We shall see. Not counting on anything here, but it's a start!!! anyone have any other suggestions, please post them!!!!
GC Services began calling me about 3 days ago. Their purpose to collect an ATT long distance bill I had validly disputed for long distance calls billed to my credit card. After the calls I got a GC "bill" in the mail demanding payment of an amount more than the disputed amount. After my successful credit card dispute ATT had the balls to recharge me so I had to again dispute the charges. After that was resolved ATT continued to bill me and even had a rep call me. I explained the situation to the rep and she told me to put it in writing so I did and the response I got was call us to discuss--definitely a circle jerk. After this is when GC Services began harrassing me. The ask to verify my address and I ask what is the nature of the business and they refuse to state what their purpose is. When I insist they then hang up. I get calls 3 to 4 times a day that say "Operations Division." Apparently, they have many numbers and the Houston BBB has a list of those numbers. Their web site is rather slick but their practices typically agressive and in violation of the law. Write a cease and desist letter that states you are contesting the charges w/in 30 days to protect your rights. They also buy debts from other collection agencies that are satisfied and try to collect a second time. Just document and complain to the proper authorities to stop this racket.

Just an FYI...they have so many numbers because they have over 30 calls centers, and they handle a lot (I'm unable to quantify) just how many different accounts. They collect consumer debt in addition to various government debts.

Demand an Address and send a cease and desist letter under the Fair Debt Collection Act. Creditors and their collectors don't have a specific right to contact debtors or others by telephone, even though they will disagree thats what the law says. Google FAIR DEBT COLLECTION ACT
It appears that Capital One is buying a lot of deliquent accounts from other credit card companies and converting these old accounts to new Capital One accounts and therefore, making it look like you were delinquent with a Capital One credit card. This makes it easier for them to try and collect the debts as Capital One. hope this helps. One of the most popular companies they bought out was fingerhut credit cards through axsys bank.
I use an automated attendant on my home phone, which saves me a lot of annoying calls, I have special box for bill collectors and sollicitors and the rep, named Jim was sure to mention " Oh and I am, Not a solicitor but I must talk to you immediately." he then left 1-877-871-7717 x4709 as his contact number. If anyone else is interested, they now have automated attendants programs that with the right voice modem and caller-id actually block any number you place on the blacklist, you can even setup special messages for those numbers if you want to really aggravate them.
I have a student loan with GC Services and I????????ve have been trying to resolve it, But financially it????????s been very hard for me. I made an agreement with them a while back to pay them $50 a month. Well needless to say I only made a few payments, because of my finances. I only can work part time. My son is autistic and I do have many doctor notes or legal documents to prove that he needs constant supervisio ,which means I can only work part time.
They told me I could get into the hardship program; as long as I sent it all my information and I did I even faxed it. I called them this afternoon they told me I could not qualify for the hardship program because I work, yes I do work, but part time and bring home $115.00 a week. They should know this I sent them my pay stubs, and all my other information. I don????????t even make $17,000.00 a year and they want to garnish my wages. I said I could pay them $50.00 a month like before, but they said they could not take it, and that they would take it from my pay checks. They won????????t even get close to 50.00 on my paycheck on 15%.
Ya, I do get help from other sources but that????????s for my son and this keep a roof over are heads etc, he????????s only 10yrs old. I do get help from my family but very rarely is it money not big amount $20 for food or to do laundry etc???????
What I really mad about is they said no on hardship program, I don????????t want them to garnish my wages. I was hoping to get the hardship so I could pay them off but at a lower rate.
They also told me to get back into good standing with the account I had to send $300.00.
I did talk them down to $180.00 but that still to high monthly for me. I didn????????t give them anything ,because one reason they kept pass the phone to different people, I talk to 4 different people on this one phone call ,and another thing when I told them $180 was still to much for me he started rambling off their debt preamble. You know; This Is an attempt to collect a debt etc??????????????then they hung up.
I just don????????t understand them, after sending all the information in and all my financial stuff, how could they think I could pay this amounts.
