Luke,

Since you had placed a fraud alert before this account was reported, I think you are in the safe side. So don't worry. Contact the credit bureaus and ask them to remove these fraudulent entries from your report. Send your letter through certified mail with return receipt requested.

Hope it helps. Always feel free to ask your queries in forums.

GC Service people are driving me insane. I may have an account in collection (I was an irresponsible college student at one time unfortunately) They call all hours of the night and day about 10-15 times a day. I never talk to them long enough to see what account they have for me. They are just so irritating that I can't stand to talk to them that long. I hang up on these people and they just call right back.

I do have an old student loan and want to make good on it but have no idea how to go about it. I for sure do not have the entire amount. Of course, this may not be the account they have as I am doubtful that the government would use such a shady operation to collect.

Ordered callblock and privacy manager from the Phone company today and I am hoping it will help.

Heather_dw,

Ask for debt validation. Also inform them that you would prefer to be contacted through mails. You may contact them at the GC Services address or may call them at 877-290-8894.

Always use CMRRR while corresponding. It will give you immense support to defend their unfair claims in future.

If they continue calling you after receiving your letter, you can report against them with FTC, BBB or attorney general's office of your state.

If you have any trouble in repaying the student loans, try to consolidate it. Student loan consolidation opens a treasure of facilities for the debtors. Review the benefits of student loan consolidation.

Feel free to discuss your problems in forums.

GC services sent me a letter concerning a cell phone account I have. I was aware that I owed on the bill but when GC sent me a letter the amount I owed was much different from what the cell company said I owed. I was at work one day and my daughter took a call from one of their reps... someone who identified hismelf as CARL. He was very rude and profane with her. Threatening her if she did not put me on the phone and talking about how he was not selling cookies. She told him I was not at home and asked who he worked for. When he would not tell her she asked to speak to his boss and he said he was the boss. She then told him not to call back again and he said he would call every day if he wanted to. I read the back of the letter GC sent me and saw that I had 30 days to respond so I typed up a letter saying I had contradicting amounts owed and would not be paying until I got some kind of written proof of how much I actually owe. I mailed that to them certified mail along with copies of their letter with the total highlighted and the bill from my cell company highlighted. According to USPS tracking the letter was received but I have heard nothing back. Today I got another letter from them saying I owe $1300 when my cell company says I owe $500 and that if I didn't pay they would take legal action. What should I do next?

Srv80,

Did you send the first dispute letter through certified mail? Then you can file complaint with FTC or BBB against them because they are not attentive to customers' queries and problems.

Now, as per as the second letter is concerned, send them a dispute letter through certified mail with return receipt requested. Give the reference of your previous letter. Tell them that you are ready to work with them but they have to show how $500 can pile up to $1300.

Keep the records of your correspondence. It would help you to prove that you tried to contact them; it's their fault that they did not reply.

Yes, I made sure to send the first letter through certified mail and I kept the receipt. I checked online and it says the letter was delivered.

I kept a copy of the first letter as well as copies of the bills I sent them to show the two different amounts I was receiving.

I have been ignoring any calls from the GC Services phone number since I sent out the letter as I don't like dealing with the rude man who seems to be in charge of my account. Should I take his phone call next time and ask him about the first letter? I am not sure if I should tell him not to call as I do owe money but the amounts aren't matching up.

Thank you for your reply

Srv80,

Did you add a paragraph in the first letter requesting them not to call you any more? If yes, then just complain against them with FTC because they cannot call you any more after receiving your letter.

Otherwise, send them cease and desist letter stating that you do not want any phone calls from them. So they should contact you through mails in future. Send it CMRRR as usual.

You can definitely pick up the phone. If your state laws permit you to record your conversation then record it. It will help you prove them rude. They cannot use profane language and abusive words to a consumer. Go ahead, fdcpa is with you.

No, I did not send a letter about not calling I thought telling them via phone was good enough but I will include that in the second letter. I just spoke to them on the phone and they said they are not required to verify anything because I did not contact them within 60 days of my cell phone being disconnected. I told them that they didn't even have the account within 60 days of my cell phone being disconnected. They also said that cingular would not provide them with verification of the amount due. That if I did not pay them by Feb 19 they were reporting me to the 3 major credit bureaus. I told them to go ahead I would be reporting them to BBB and FTC but he said I have nothing to report against them to FTC. I told him I would call cingular myself and deal directly with them and he said cingular would want nothing to do with me. He told me to just pay the $1300 to them and dispute it later. I said I would not be paying $1300 when there is no proof that I owe the money. He claimed their letter is proof so I offered to send them a letter saying they owe me $1500 and he said that's illegal. I said well that is exactly what you just did to me. I called Cingular and explained the situation. The routed me to a supervising manager who was very nice and said she would help me with the situation. She looked up my account and told me how much I owe. I then asked her if she would have provided the GC with that information and she said if they had requested it yes cingular would have provided it to them. She did not know why they told me the things they did. I also asked her if I could pay the total amount owed directly to cingular so that I do not have to go through GC as I am very unhappy with them. She said that as long as I pay the full amount cingular could accept the payment. I think that is what I am going to do. I am going to write a letter to GC telling them not to call and I will report them to BBB. Is it true that I cannot report them to FTC?

Every consumer in the US has his legal rights protected under the federal laws. You have the rights to report any mischievous activities of the collectors and creditors to the FTC and the BBB. You can also report them to the AG's office. Go ahead and place your complaint against them. The authorities will investigate the matter and take necessary actions.

So I can report them for being rude and for lying to me about not being able to retrieve verification of the debt? Do I need to obtain proof that they said they could not get verification from the creditor?

Srv80, if you have the proof, your case will become undoubtedly stronger. Some states allow recording of phone calls of the collection agencies. If it is permissible in your state, re-arrange a conversation with them and record the call. If it is not permissible, let them know in the beginning that you are recording the call and if they continue talking to you, they are giving their consent to do so.

Clairissa,

GC Services is a collection agency that works with student loan. Any third party debt collector is subject to fdcpa; hence they should provide you the past records of your loan and they should respond to all your queries.

You must be more careful before disclosing your account details. Watch your account statement regularly and if GC makes some withdrawal, ask for receipts.

Ed. Werfel,

Why don't you contact OC and explain what you feel about this collection agency. Perhaps OC will recommend something better. Do keep us updated on what is going on.
