How can you deal with GC Services debt collection agency?

A lot of collection calls can be very harassing. Here is what you can do if a collection agency harasses you:

  • Dispute wrong debts:
    Under the Fair Debt Collection Practices Act (FDCPA), a collection agency (CA) must ensure that they contact the right person when pursuing a debt. It is not a violation of the FDCPA if the CA makes a mistake due to an error in their record keeping. However, once the CA has been informed that they are calling the wrong number, under the FDCPA they are required to stop.
  • Expiration of the SOL :
    Sometimes collection agencies keep calling about a debt even after the Statute of Limitations (SOL) on the debt has expired. If you know the debt you are being called about is yours and the SOL has expired, then you should remind the CA that they cannot sue you for the debt. However, even if the SOL has expired, you will still owe the debt.
  • Report misleading tactics:
    Under the FDCPA, a CA cannot mislead you in any way. If a CA causes you any damage as a result of misleading you, or by violating the FDCPA, you are allowed to sue them for punitive damages. In addition, the CA may be subject to a fine for up to $1000.
  • Legal help for continued call harassment:
    Once you have sent a dispute letter, the FDCPA requires all collection calls to cease until the CA has validated the debt. If you decide to sue the CA, you should have copies of all the written correspondence, including envelopes and mail receipts to present to the court as evidence. You may record the phone calls made by the CA but you need to inform them before you do it. Once this is done, you may contact your State Attorney General’s office and file a complaint.
