I received a call at work from a woman named Alison Potter at Bass & Associates in Jacksonville. She called my work at 3pm on Friday and said they were downloading affadavits to the county office at 4 pm. This was for bank fraud and interstate transfer of funds(?). Honestly, I did have a pdl I lost track of over the summer, so I knew I had an unpaid pdl. She could not give me the name of the company, only the parent company, US National Bank and the pdl was Premier Co., which I was not familiar with. She said USA has 30-40 pdls they own. She told me I would be issued warrants at work, asked for my bosses name, and that since it was over $200 it was a felony. Then asked if I ever committed wire fraud, check bouncing, been on probation. She was well spoken, courteous and businesslike. She also said that the Bank was not interested in getting their money back, they wanted me to suffer the consequences of my actions. I was really scared and asked why the 1 hour lead time if this was going on since June. She said "the Co" had tried to contact me via phone & mail. Now it was too late they were going to process me legally. But she said since I had no priors she put me on hold, spoke with the co, and they could permit to pay up and be released from my obligation and legal matter would be dropped. BUT I had to do it within the hour at Walmart. I took my last $500 and paid the account. Now I can't pay my car pmt. I thought her putting me on hold and talking to the client a little fishy, but, it was so intimidating. Now that I found your site I am wondering if I could have asked for more time or split the cost into installments. Also, in Florida, is it a criminal or civil offense to default on a pdl. As I stated, I wanted to pay up, just not be scared and stongarmed into.

So does this mean in FL you cannot be criminally prosecuted for defaulting on a pdl. Its after the fact now, but I want to file a complaint and want to know how much of what she told me was a lie. Thanks for the info.

You are right Neensie, you can not be criminally prosecuted for defaulting on a pdl loan in FL. This company banked on the fact that they could scare you out of your money and that you didn't know your rights.This company I believe is under investigation, I'm sorry to hear you lost your $500 to them, definately file your complaints with the AGs office.

Thanks for the information. She said the orignal amt of the loan was $250.00, I paid them $535 which she said were for interest, NSF fees, etc. Which means I definitely overpaid them. Dang it! I have no idea who this PDL is, my fault I know. I cannot find Premier Payday anywhere.

Thanks for that information. What do I do at this point. Call them to verify the amount of the debt, tell them I paid Bass. Or should I send them a letter with all the information? I am sorry for all the questions, but this was so wrong, and I want to make sure my account really does get credited and maybe get a refund. Thanks again.

Hi neens, I am going to comment on these companies scare tatics for you and anyone else that reads this thread, they will use everything and anything to scare you and they will SOUND so professional that you KNOW that what they are saying is true but fear not all it is is hot air and scare tatics, there is no debotrs prison. Don't ever wire money or gove out new account information to anyone until you have an actual agreement or documents to back up any claims. Good luck and keep posting

Well now I feel less stupid, now I am just angry for falling for their script. I'm usually not that easily intimidated. She said Roth would send out a letter of full payment & release within 5-7 days. At this point do I contact Premier or Roth or both with a letter? I am filing a complaint with the state of Florida tomorrow, I already printed out the forms. I see that you need to put everything in writing with these vultures.

I filed a complaint online with the AG last week about Bass and their illegal tactics, ie. jail time, coming to my place of employment, etc. I foolishly paid them $535.00 on a $200 pdl. Today I received a letter from the financial investigator who is checking out "Ellis Crosby & Assoc/Bass & Assoc". She stated they are already under investigation and sent me a detailed affadavit to complete, have notarized & return. PLEASE, anyone else who has been victimized by Bass, do file a complaint with the Florida AG. She said after they review my complaint, she will advise me of any action take by their office. So, this is being taken seriously. If you need contact infoamtion let me know.

I am glad you filed a complaint with the Florida AG, Ellis Crosby & Assoc/Bass & Assoc should know better than to use that scare tactic, they think that nobody will look up the Florida Laws..little do they know..I am glad you did that

I had a message on my voicemail from Bass a couple of weeks ago. The message just said to return the call and ask for Division 320. What the heck is "Division 320" supposed to be. It was really just an extension, and when they answer the extension, they answer it with "processing." I asked the man what "processing" was and he had told me, that it was the processing dept for processing charges. I guess I was supposed to be scared. These idiots do need to be shut down

Don't let them jerk money from you. I paid them $820.00 on a $300.00 loan from Aarowhead Investments. I filed a complaint with the FL AG's office as well as the fdcpa...
