Hello all, I'm new. I'm a 22 year old daughter posting mostly on behalf of my parents and out of concern for what they got themselves into. I believe my parents got themselves scammed by some group (?) of people who promised to modify their mortgage. I just learned most of these details today which raised some red flags for me. Also, this takes place in SF Bay Area, California.
My mom answered an ad that was in the Pennysaver about loan modification, the company was USMAC Financial Services and the person who helped was John Rapp (ph # 1-800-485-8055 x5034).
They made my parents sign a contract and pay $3,500 (by credit card) up front to John Rapp I believe. They assigned a lawyer named Christian M. Dillon to our case, and some documents we received from his office were very unprofessional and had no signature of his on any of them. Also, one of the documents were supposed to be signed by his case managers named Melissa Holland and Lori Fitch, but it's a fake cursive computer font.
John Rapp also instructed my parents to be delinquent on their mortgage for 2 months, and one of the people in Dillon's office denied anyone ever saying that. It's going onto the 3rd month now, and someone from the Dillon office now instructed my parents to pay $1000 for the mortgage (which probably isn't possible since the mortgage company wants the full sum due, our monthly mortgage is around $2800). These suggestions seem very shady to me, and I could foresee losing the house if they'll lead us on like that and do nothing about it.
Some other details are that the Dillon office was instructed by my parents to call their cell phones if they want to contact them since they're almost never home during their hours due to work. However, they keep calling the wrong phone number and it seems like they're trying to avoid contact. And once my mom actually does manage to get in contact with them, they're mostly clueless. For example, she was told that another person had her file, so she had to call that person, then that person said another person had her file, etc.
When I heard of this today, I checked on the internet about this and found some writings by people that seem to indicate that this whole thing is a sham, and that this Christian M. Dillon lawyer seems to be involved in a lot of these companies. I checked on the BBB website on his company's rating and they weren't good, so I wonder if he keeps making new companies until their ratings get very bad or what.
Anyway, my parents are now treating this as a scam and are going to call the mortgage company tomorrow to find out if this lawyer's office even contacted them or anything. The problem with that though, is that the Dillon office warned that our mortgage company will deny having contact with them and try intimidating us which is believable, so it's sort of hard to know who to trust. I'm also contemplating whether or not a charge back for the $3500 will be possible if the contract is as unprofessional as the rest of the correspondence and has no real signature, but I won't know about that until tomorrow (Also I'm wondering if it is lawful for a person such as John Rapp to accept the upfront payment on behalf of the lawyer, since I don't see him on the DRE directory).
I'd appreciate any opinions or thoughts on this matter. I apologize if this is long and confusing too, it certainly is for me. Also, who should we trust about this and where can we report this if it is a scam? I mostly think we will need to consult a lawyer about this too, so if anyone knows someone who deals with this in the SF Bay area, California, that would be great. I must be very fortunate. I retained USMAC Law Group last January to represent me for a loan modification simply because I could not get anywhere with my lender. Not only did I personally meet with one of their Attorney's, but I dropped in their office on numberous occasions only to be treated with the utmost courtesty and respect. I was 3 weeks away from a sale date when my modification came through. Don't think I wasn't sweating it - I was. USMAC helped get my monthly mortgage payment from $1860 per month to $1200 per month...do the math thats a savings of $660 per month.

I paid USMAC Law Group $3500.00. It took about 2 months to get my modification completed. I spoke to the Attorney A. Dodge. He was great. I am saving $842.00 per month on my mortgage. I was late and behind a total of $16,742.00. This was placed on the back of my loan and I got a fresh start and I was in a mess, USMAC straightened me out....A+Reason for Editing (Minimum 15 Characters)

My brother and I brought a home and recently my bro got unemployed. I was in a hardship with the mortgage payment and saw usmac commercial on tv, I called them for assistance. I got usmac for assistance, acccording to the aggreement I signed, it over 120 days since then and I have no result in my loan modification. During that time, I have over 3 different case managers. I have to called them to check on my case for the loan modification, now its over 120 days , I try to call my case manager, only voice mail. I also have a processor, he no help too. Now I just get voice mail or get someone else voice mail when I call there number. If I have a choice, I would not paid for usmac for services. I now loses my payment with usmac and my home is in the process of foreclosure. You can said this service is a scam. Don't use it if you haven't.Reason for Editing (Minimum 15 Characters)

I saw a info commercial on TV and called the 1800 989 3704 number and spoke with Greg Moeller. I asked him for Goverment lic. numbers or Bar Licance #s. He said the USMac is owned by Leonidas Miras, Bar#237572, law partners are Paul Reza, Bar #113512 and Nicholas Grafstrom, bar # 257069. Their fee to do a loan modification would be $2995. Greg would email me the requirement information and their process to do the work, I would fax the signed info to him with a payment by a bank check or charge card and then their ULSMAC law group would fed-x the paperwork to fill out and they would contact Bank of America and get back with me as to how to proceed with the modification process. Greg said that sometimes there is a step mortgage offered where you pay a low fixed rate for one year, than the next year it would go up a point and than the third year another point added and than a balance of the (30 year fixed) modified to 40 year fixed mortage would be establised fixed at 5% for the balance remaining. This was one way to do it he said.
I am thinking, that if it were possible to help people, why not ask the customer for a retainer and if they are not able to follow through with helping them they would not owe anything or else a small fee for trying to see if they could get the modification for them. It seem risky giving out our SS#s and private info to strangers and how they could use the private information against us.
I have not proceeded to sign the paperwork email to me as of yet because of the complaints mentioned here at your site. I hope the info of names and licance numbers are of some help to those who are having problems.Reason for Editing (Minimum 15 Characters)
