I was reading your post about people wanting you to help them with credit repair. In addition to FDCPA and FCRA, you really need to be very familiar with CROA (Credit Repair Organizations Act) because I believe you would be considered a CRO and your activities would be regulated under CROA. Not acting by the letter of this law could spell big trouble. There may also be state laws and requirements, so you should check to see if there are any. | |

The attorney that is requesting full payment is in same office as the attorney that is sueing for CACH, LLC. I called the courthouse young lady I spoke to says that it can take 2 years before it comes up in the court. The SOL would have been over in Feb. 08. But since they sued, the SOL can't be considered now from my understanding. The lawyer I hired just answered the discovery that CACH attorney was requesting, because deadline was coming to and end for us to answer and we were just trying to get some time. The debt is ours, we just couldn't continue to pay so Chase sold it to CACH and when we refused to pay them (because we knew they bought it for an ungodly low amount) but yet they wanted the full 10,500.00. We sent the validation letter, they sent us a note from Chase saying they sold the note to catch for collection, so Chase had written it off according to the credit reports all (3) chase shows that Cach is owner. But Cach lawyers won't tell you how much they bought it for, nor do they want to settle for anything less than full original amount. I would like to send a letter telling this lawyer that he should check with his fellow lawyers about this case. That it's still waiting for a court date. Any info you have would be greatly appreciated. | |

You must demand validation during the discovery process. When they do not provide it, you can then motion to dismiss. | |
