No Debt Collection agency can have you arrested period.... Nor can they threaten you with a legal action that is not enforcable or well...legal. These are just scare tactics to get money out of you.

Direct from the Fair Debt Collection Practices Act:
Creditors and third party collectors may NOT: * use false, deceptive, or misleading representations or means; * harass, oppress, or abuse any person while seeking payment; * use any false statements or engage in unfair practices. Debt collectors may not engage in unfair practices while attempting to collect a debt. For example, they may not: * use threats of violence or harm against the person, property, or reputation; * publish a list of consumers who refuse to pay their debts (except to a credit bureau); * use obscene or profane language; * use phone calls to repeatedly harass you; * fail to identify themselves on the telephone; * advertise your debt; * threaten arrest if you do not pay your debt; * say they will seize, garnish, attach, or sell your property or wages, unless the collection agency or creditor intends to do so, and it is legal to do so; * indicate that actions such as a lawsuit will be taken against you, which legally may not be taken, or which they do not intend to take; * collect any amount greater than your debt, unless allowed by law; * deposit a post-dated check prematurely. I received a call today with a nasty and mostly inaudible message but I got the CCR and a demand call back to get extention #1 at the number 1-866-845-7811. States they are reps of and/or attorneys. The voice level was atrotious and never heard such a message from any legit debt collector. When I returned the call (out of curiosity, since I could not fully understand the loud, screaming message clearly) and got the option to get the attorney "you are working with" by name (but I have no such atty) or just press 1 to speak to a live person. After pressing 1 it says no one is available to take your call so plz leave message and then immediatly does not allow for a message because ext. 1 message box was too full... imagine that.. I too will call the attry general because I have never in my whole life been inside or used any payday loan facility. I dont beleive in them...no advanced pays from any type of company ever. As far as my debt...all has been paid in full save one credit card with owing less than $3000.00... so they may take me to court or whatever they want, but they will hopefully end up in jail as a result of their tactics and fraudulent practices.

This company contacted me today. Similar message as everyone else. I may have something from years ago, not sure. But isn't there a statute of limitations on trying to collect on these? It's been a good 9 or 10 years. I have nothing on my credit report and nothing on chex systems.

This collection agency, for a payday loan com. called one of my brothers house and left a message for another brother saying they were attorneys,that they were going to file charges against him, if he did not call them. Tell me how someone who has been in prison for the last 4yrs can get a payday loan ? Here is a number: 1-888-872-7992 ext 1(591) I called this number no one answers , the message says the person at this mailbox cannot rec. a message the box is full. If its not you, tell them to kiss where the sun dont shinnnnnnnnnnnn In Dallas Tx

Just look at half the names they use...Mr. Brown...Mr Black. This seems extremely fishy to me. I talked to an attorney friend of mine, he told me it was either a scam or a debt collection agency, either way they can not have you arrested and have no real power. They use the tag that they are attorneys just to scare you into paying....do not give them any money!!!! They buy debt off companys in the hope they can scare you into paying. These people have no real power to do anything but to annoy the hell out of you. If you have any questions about these bottom feeders call a local law office, most will give you a free consultation and all will tell you not to worry about CCR.

My family is being bombarded with this also the recording when you call them back is laughable and do you ever get a real person anyone? Time to turn tables on them! Here is the company name they told us was involved and that we had to contact them to rectify 1-866 680-7524 Southern Tier Agency. Now does this sound legit? Can you guess what happened when I called? You got it no such business or at least no answer!

I have also received several calls from this scam. The latest provided a family member's name stating they were a person of interest and for me to hold on for further info. After a brief wait, I was disconnected. When I redialed the number, the recording stated it was CCR and Associates providing an extension which when connected stated the voice mailbox was full. This is annoying and needs to be stopped! Do they not understand harassment??

This CCR & Associates called my elderly mother today and threatened charges of fraud on me. They were trying to get my phone # from her. She did not give it to them, but did take down all of their info for me to call them back. She called me in a panic stating that there were fraud charges against me. They upset my mother tremendously!! I believe this payday loan company was one from over the internet and I don't believe they are even in the U.S. I don't know if they have to follow our laws regarding the collection agencies rules and regulations or not.

Yeah I got a phone call left with my sister about them filing a court hearing. I make no payments to anyone besides my landloard and the utilitie companys. I know that I owe nobody and I have recieved no other notification regarding this matter. What is reall going on besides a bunch of bull crap. Im calling them right now to find out whats going on.

I received a call from a relative today who stated they got a voicemail from CCR & Associates "Grant Gardner". Claiming they were attorney's and would take legal action if I didn't call them back. Here's what I found out. This debt is 10 years old (Jan 2000) which was already paid, it was from a cash advance company located in Columbus Ohio. I called the company back after several attempts to voicemail full i hit option 2 and spoke to someone in legal. Mr. Gardner got on the phone and told me I needed to make a payment in the amount of $948 to avoid legal actions. I asked him what the debt was for and who initiated the collection. I asked for a collection letter and he said he couldn't provide such information because he was an attorney, I told him that I wouldn't pay the debt unless I had something in writing, he told me I'd be hearing from the judge. I also told him that I would be happy to pay any balances owed on my behalf if I had something in writing and he asked for my address. You're the lawyer do the job you're being paid to do and tell me where I live.
Additionally I called the loan company and found out that I have paid the debt in full in 2002 (two years later) and nothing was due. What I was told was a bit disturbing, loan company sold my debt to a collection agency / or portfolio management company then after a few attempts they pass to the next agency then to the next and next, they have no way of recalling the account because they no longer own the account. I called the lawyer back and told him it was paid in full and he told me it was to late and he filed the judgement. I told him it was a complete waste of time and I hired a lawyer to go after this so called "law firm". I called |
