I called the FTC and by defination-United Cash Loan and turned my account over to Pinion Managment, regardless if they are in-house or payment and processing center, they are still considered a third party collection agency and are still required to validate the debt. What I find interesting is they when they called my home last night, telling me this was my last chance to settle before they sent the paperwork to NJ for processing, my caller ID was showing a name of a person and a phone number, did not recognize either the name or number, and when I heard the message they left is when they told me who they were, etc.and gave me the office number to call.

Hey, thank the lord for this website. My sister received a call today from a Kyle Watson saying he was with this company and that she needed to wire 802.00 within the hour or she would be arrested. She luckily didnt think he sounded legit so she hung up. When he called back I spoke with him, he wanted my name and i refused to give it to him, when I started questioning him he got very defensive and hung up. I called them back at the 904-483-5040 number and spoke with a lady named Angela Rodriguez, she refused to tell me what business the company dealt with unless I gave her my name. I refused and she transferred me to a Don Freeman, he is the supposed director, he too got very rude and defensive when I started questioning him about his company and he refused to give me any information. After reading all these responses we agree that they are a fraud....

Also try to figure out if any of your accounts is with them or not. In that case, contact your creditor and pay the due directly to them.

Collectors cannot behave rudely with consumers. This is an offense and you should file complaint against them with FTC, BBB and AG's office.

People do say that. Many postings in this forum state that these are the alias of the same company. You are right, once huge number complaint is filed with AG, these companies will surely undergo an investigation. Anyway, thanks for the info friend

The statute of limitation in New Jersey is 4 years from the date of last activity on your unsecured debt account.

Thank for the information. Let me ask you this, I recieved a call from Alliance One. A person claiming to be Linda Baker left a message, that this was not a sales call this was a bussiness matter, it would be in mybest interest to call. Did return the call to find out that this was an automatic dialer and no Linda Baker at this number, just some lady who I could not understanding very well tellimg me that PNC has given them this account to collect for bank fees and that this account was open in 1998 which I do not remember opening, never recieved anything from them in writing/phone calls all this time, nothing has ever showed up on chex system when I opened a new checking account in Aug of last year. They claim the amount owed is $400 for over draft fees. How should I handle this. They gave me a mailing address in Southeasten, PA 19398.

Ask Alliance One to give you the details of the account in writing because they must follow the fdcpa law. Moreover, this account is past the SOL period. You just don't have to pay anything even if they can prove it to be your account. You must be sure that you never made any sort of payment in this account within the last 4 years.

Use your legal consumer rights mentioned in the FDCPA. Calls can't make them get money from you. You can expect them getting harsh on you as they often do. You can take legal advice from your attorney.

Since you are sure that this is not your account, send a cease and desist letter to stop all communications with you. They must not call you over the phone or in your job. If they have to communicate with you, it should be done only through mail. Once this letter is received by them, they must not call you further. If they do, you can file charges against them for violation of the cease and desist law. If your state laws allow not taking permission from the other party, you can record the phone calls secretly.

Since the account is past SOL, no one can legally force you to pay it. Moreover you cannot remember opening this account too. Send them cease and desist letter and state clearly that as the SOL has expired for the said account, you are not going to pay it. So they should stop all collection activities.

Hope this will stop them, if they don't you can file complaint with FTC, BBB or AG's office.

I received my first call back in January (Karen @ 866-201-4603) relating to a payment due to Arrowhead Investments on a payday loan. They request a moneygram from Walmart in the amount of $565. Receiver code was 4192 - company name Interstate Wire Compliance Bureau. I never sent this moneygram because I felt I did not owe this money. Yesterday, I received a call from a Russell Crenshaw - 866-201-4603 ext. 208 stating that I had better get an attorney because they were going to file criminal charges for various charges and would be serving me papers as soon as they verified address, etc. Is this legit or a fraud?

Sent them a validation of debt letter- todate have not recieved any thing back from them. They went and debited my account for $$. Filed a complaint with FTC
What else can I do? This arrangment was made before I sent the letter because I was scared of what they said over the phone.

Do you have your bank statement for this transaction? If yes, you can prove that they received money from you.

Have they updated your credit report accordingly? If not, contact them and ask to report latest updates of your account. Also claim some proof of your payment to them.

If they cannot clear up the credit report matter, dispute the issue with credit bureaus. Keep us posted.

In the validation letter it states all collection activity must cease and desist(which I underlined and bold)and have not recieved any information from them since they recieved my letter. I used the sample that was on this site and outlined what I wanted. They have not answered my letter so how come they can still debit my account. Don't understand - they never sent me anything after the first phone conversation with them. If if heard the FTC customer service rep - and she aked me that quetion - that is also a violation of the fdcpa. Unless I am not understanding something.
