Hi,

I had a credit card from a bank, had problems with the account, never put anything in writing, the bank changed hands and now I have been contacted by an attorney for collections of this account. How should I handle this matter. Never recieved any type of call or letters frim them until now.

First, send a debt validation letter to the attorney requesting for the details of this account. This should clearly itemize the amount that you owe in the credit card account. Through this validation process, you will also come to know if the attorney is authorized to collect the money from you.

After you have received the information in writing, make arrangements with the company. Prefer to have a written statement that after the account is paid in full, the update will be done in your credit file. You will sure of handling the matter in the proper way.

In a letter I got from the attorney, I noticed that the creditor is CACH,LLC and the orginial creditor was Fleet Bank. Who is CACH,LLC and Fleet Bank was taken over by Bank of America. This attorney is from MA. Will be sending a validation of debit.
I don't understand this one at all - confused

Fleet Bank is an alias of BOA and CACH, LLC is a collection agency. Seems your account has been transferred to collection agency. Ask for debt validation, collection agencies are supposed to send you debt validation according to fdcpa.

Recieved a call from United Cash Loans,from a Ms.Robison. I have sent them a validation of debt leter the end of February, no response. Changed me bank account so that they could not make a withdrawal from my account nad had the previous one reversed by the bank. They called me at work, and told me I had 48 hours to return their call. Never recieved any response to my validation letter now they are calling me, in letter they were to contact me by mail only. What should I do?

Have you sent the debt validation request to your lender or to the collection agency? Original creditors are not abided by fdcpa laws.

If your account is still with your creditor, work out some payment plan and try to get it settled with them.

United Cash Loans is very difficult to work with. I have been dealing with them. They are liars, not licensed to lend in Nevada and have several complaints against them with the Attorney General and Consumer Protection in Nevada. Also, their Carson City, Nevada address is a mail forwarding only. If you would like more info, pm me and I will give you the low down.

I sent it to Pinion North Management who is the collection agency/department for United Cash Loans.
It is the collection department who is calling me and who I sent the letter of validation too.

Pinion Management is inhouse collections for United Cash Loans and they are as difficult as United Cash Loans. I was told by Mike Tank that the address they give in Miami, OK is a false address and he works for United Cash Loans.

The address I have for Pinion Management which I got off the e-mail they sent me in December which was there first and only notification to me is listed as follows:

United Cash Loasns

Albuquerque, NM 87110

According to the FTC they are a third party collection agency because United Cash Loans gave it to Pinion North Collections get collect the debt.
When I called the FTC - they told me I should have had some kind of correspondence from them within five days after I made the orgiinial call back in Dec and never dot anything and I have the certified mail returen card signed by someone in that office. Does the fdcpa stop them from doing anything since I have not recieved any validation from them, They recieved my letter the end of February over a month ago. Again do I pay or tell them to go fly a kite until they validate the debt

Make Pinion Management validate before you pay. Let United Cash Loans know that they are not licensed to lend. They will deny, but if you need proof, I have proof of them not being licensed. You are to receive a letter within 5 days of initial contact from a collection agency and I think that includes inhouse collections also.

I received a call from pinion also back in October 2005. the guy told me he was from pinion and then said he was from oneclick cash. I told him to validate the debt and to send something in writing and he put me on hold and said at this time they are not willing to send anything in writing. Then I told them well at this time I am not willing to make any arrangements with you until I see something in writing. He hung up on me and I havent received a call or any validation letter. They wont send you a thing.

Pinion Management keep claiming they are not a third party collection agency only a payment and processing center. I have not returned their call after their call to my work telling me I had 48 hours to return it. They did recieve my validation of debt letter, I have the certified card and have blocked my home phone number. In New Jersey payday loan companies are not licended.

Place debt validation request through writing. Make it CMRRR, so that you can use it as evidence in future.
