Don't let them intimidate you! Others' have been told this and that they were sending people to arrest them, they were going to "download" them, etc.!!

I was told that by another collector, and I said, do what you have to do- I know the Chief of Police, and I'll be waiting!!

Have you had them validate your debt yet? Be carefull what you say to them on the phone. Take notes of what was said and keep copies of everything.

If you have questions,. please ask..KAren

In January 06 I took out a payday loan, shortly after that, the company closed the office and left no phone numbers or any way to contact them. I let it go and waited for them to contact me. June 07 I was called by LMP and told that I would be arrested at my job if I didn't pay within 24 hrs. I did, but now I'm being contacted by a collector from the payday company saying that the debt was never paid. What do I do... I got tired of looking at the receipts and threw them out a month ago.

I just need some advice from someone. I received a call from a stephanie at legal mediation practice saying that i need to pay 600 dollars on my loan and my loan was only for 300 and i asked why it was so high and she just said it was fees. Anyway i got sick and didn't work for 2 months due to surgery and i know i am responsible for paying for it which is no problem but i don't have the money to pay everything i can do it in payment but she won't except it. She said that if i don't pay it today that it will be forwarded to court. When she left a message she even said to have myself or my lawyer call her. Can someone please give me advice on what to do?

Thank you

First off Amie, don't get stressed over LMP's threats; that's all they are: threats! The very first call I received from LMP, I did a search on them and found this website. You will find lots of helpful information, helpful people, links to useful information, and above all, support! I have been unemployed since February of this year, due to medical problems, and the first call I received from LMP scared me so bad, I was contemplating suicide! No joke.
Secondly, send out a debt validation and cease and desist letter to LMP, certified delivery/signature required. There are examples of these letters all over this website, someone can post a link to one, or you can just do a search for debt validation or cease and desist. In the Validation you are supposed to receive from LMP, they are supposed to show how they came up with the $600 they claim you owe. Like me, you will probably never get any response from them. To this date I have never received anything in writing from LMP. That is a violation of the fdcpa.
Third, keep a record of phone calls you receive from LMP. Somewhere on the Internet, I found a handy log someone created that allows you to write down the pertinent details of the calls (IE name of company, phone number called from (get this from caller ID), time of call, name of caller, details of call, etc). Keep a record of all calls received. If you have a digital camera or cell phone with a camera, take a picture of the caller ID right after they call and keep it. Make a recording, if you are able, of the message she left you advising you to have your attorney call you. If you are able to record all your phone calls with LMP, do that also. Make sure to check your state laws on whether or not one or both parties have to know and agree to be recorded. I'm in Florida myself, so both parties must know and agree. All of this is evidence, so that if LMP keeps Harassing you and violating the FDCPA, you can retain an attorney and sue them for this. You can go to www.naca.net to locate an attorney in your area that can help you.
Fourth, If you know the name and contact information of the original loan company, you might try contacting them and working out some sort of payment arrangement. Be sure to tell them how LMP is harassing you and violating the FDCPA. As I understand it, they are not obligated to accept a payment arrangement; however, I would think they would if they want any of their money.
And lastly, please don't stress. The message and phone call from LMP was meant to scare you into paying; which it partially succeeded as it did scare you. It also prompted you, as it did me, to do some research on the Internet about LMP. I'm glad you came here before you sent them any money.
I'm sure if I'm missing anything or gave any incorrect information, someone will be along to clarify. I would recommend you do some reading on this site so you can better education yourself and be armed when dealing with CA's. I learned a few things and am suing LMP, myself, for violations of the FDCPA.
Oh, and before "guests" come on here and make comments about being "deadbeats" and "paying your bills", Amie did say the loan is hers and she plans to repay it. She doesn't, however, deserve to be intimidated and harassed by LMP or any CA.

How am i suppose to make a payment that big when i dont enough funds, i work part time at a theater and right now my monthly income is 250.00 or even less, and trying to find a full time job is hard in California. What advice can you guys give.

Rosa, It is not very wise to put your personal e mail on a public forum. Being that you have registered you can use our messaging system. Either a quick message to the left of someones post or a private message, the PM button under someones post

Javeri, read the entry I posted in response to Amie. Long story short, if you don't have it, you don't have it. That was exactly my situation.
I would, however, highly recommend going through the process of requesting IL-Legal Mediation Practice to validate the debt and requesting they "cease and desist" communication with you by phone, only by USPS. Make sure you send this to them certified mail/signature required. You could even try faxing them the letter; if you don't have a fax modem on your PC there are some very good online fax services that allow you to fax PDF or MS Word format letters. I don't think we're allowed to give actual company names; however, if you PM me, I'll send you a link to the online fax service I used. Make sure you keep a copy of the letter along with proof of either delivery by mail or fax, for your records.
If you just do this, you might be surprised at how quickly you never hear from them again.
Also, make sure you file a complaint with the FTC, your state's attorney general's office, and the BBB.
If, however, they continue to contact you by phone after you send them the DV/C&D, *BAM*, you got them for one violation of the fdcpa. I'm willing to bet you will never receive anything in writing from them by mail, ever. So, *BAM*, another violation of the FDCPA. Once you've had enough of their chicanery, go to www.naca.net and look for an attorney in your area that handles violations of FDCPA cases. When I looked there, I saw there was an attorney at my local legal aid's office. Very convenient.
But please, and I can't stress this enough, don't let these Bozo's intimidate you! Read, read, read, this site so you learn about the FDCPA and about the shenanigans of CA's, and most of all, about your rights!
And if anyone that has read any of my previous posts regarding LMP thinks I have a personal vendetta against them, you're right. IL-Legal Mediation Practice pulled their foolishness on me at an extremely low point in my life, causing me to almost make a very irreversible and permanent decision that would have traumatized my family. I have made it a point to make sure no one else has to go through what I did, at the hands of LMP.

Yes, that is great that you are going to pay the debt. But on whose terms ? You just do not go out and get credit then change the terms of the contract that you signed ? You need to skip the cable tv, skip a car payment, borrow the money from a relative or a friend.....just get the debt paid. On their terms, not on yours. Everyone has an excuse and the debt collectors hear them all.

When they first called I am sure the collector was nice, because they want you to pay. When they call it is for payment IN FULL. All the games have already been played. Grow up and pay the bill. DO NOT blame the debt collector for what has happened to you in your life, they are trying to help you get it cleaned up.

debt collectors, professional agencies....need to send out a confirmation of the debt in writng and then you need to address it then in writing, but ost people do not...they just do not even open it up. Then they can call you, but if you continue to ignore them with answering machines, not returning calls, just plain old ignoring the fact that you owe the money....then what do you expect.....they are gonna call you at work....if all else fails....the creditor has complete control of the situation.....then they might just sue you and then the judge will order payment of the debt and then court costs. They add up. PAY YOUR DEBT. SPEND WISELY.

If I loaned you $600, would you skip your car payment or mortgage payment to pay me back?

Yup. I'm sure the debt collectors hear all the excuses. There's something else that an increasing number of debt collectors are hearing. That's the sound of a judge telling them that they just lost yet another case under the fdcpa and other federal and state laws, for illegal collection activities. To the best of my knowledge, nobody here is trying to get out of paying a debt they actually owe. We are getting pretty tired of being dunned for debts that aren't ours, being lied to, being gouged for bogus fees and exhorbitant interest. You know... All that stuff that makes collectors so warm and cuddly. Take a hint, huh?

Good thing it's the holiday season. Because you, sir, are as full of sh*t as a Yuletide goose.
