Hi

They are a collection agency out of FL. They have an unsatisfactory report with the bureau due to unanswered complaints. While you are in contact with them, get the details of your accounts in writing. The federal laws force the collection agencies to validate the debt in writing. The CA must identify the creditor for which they are collecting the debts. Along with it, you must be given proper calculation of the interest and fees attached to the total debt.

Do not make any commitment before you have reviewed the debt account. You should be proactive while dealing with a collection agency. Do all your correspondences in writing with them through certified mail with return receipt requested.

Hello David,

Thanks for your response. I could not find anything about them on the web. They are suppose to be representing a paydayloan company(PDLC) that I have not repaid as of yet. They threaten to file suit and told me that I needed to get an attorney, they told me that the PDLC told them I wrote a bad check and closed my checking account, which I did not, I just don't have any money as this time, I told them and the PDLC that i will have the money at the beginning of next month.

When I told them that i could not pay them today, they said they are filing suit against me according to my state laws, I live in MD but got the loan in DC.

Do you or anyone know the laws in DC and/or MD for an unpaid check. Oh and the amount is under $1000.00

WOW! they are really nasty, I just called to confirm the address that you gave me and they REFUSED to give me the address.

Don't get intimidated by the collection agency. They are famous for their scary collection tactics. If they are performing fair collections, they should not have problems in putting the details in writing. Moreover, they are hiding their business address. It sounds fishy.

If they are collecting for PDLC, I will like to get in touch with them and request a statement before making any payment. I need to be sure about the company whom I will send the payment. There are many companies using illegal means of doing business. Be proactive in the first place.

They said that my bank sent me 2 statements and Ace Check Cashing (the PDLC) sent me statements. I told them that I did not receive anything from THEIR agency and since they are the ones representing and bringing suit I need something in writing from THEM!

I just got the varification letter off this site and addressed it, I will be sending it out first thing in the morning.

OT: how do I create a profile on here?

Anyone know what is next for me?
I set up a payment plan over three months. I paid one payment and today the second one is two days late. They refuse further payment and say they are "moving forward" with my "case". They already threatened to pursue me over "intent to defraud Ace Cash Express"? Anyone know if they really do pursue legal recourse?

America

Notify Amex about the call done by the collection company. If they are accepting payments from you, you won't have to deal with the CA. They will pull your file back from the CA hired for the purpose. You need to do your correspondence in writing for records.

Just found this forum and I am impressed. I am an attorney currently bringing an action against Legal Mediation Practice for violations of both state and federal debt collection violations. I have been trying to dig up some dirt on them and this site has been quite helpful. Keep up the good work!

I found this site after doing a reverse phone lookup on the number they called from. I kinda figured who they were being that they called from a number with a 904 area code. I said i wasnt home. Anyway they said that I needed to have my attorny get ahold of them as it was a legal matter. The thing is I dont have any idea what would be in collection. And I am afraid to call back and ask because I noticed that as soona s you do that they tend to call at all hours. And thats one thing I dont want. I dont know what I would ahve in collectino tho, I have paid off all my pay day loans from like three years ago. And never once received anything from this company or any other for that matter.

I took out a PDL from Ace Cash and within a few days, I went through some sort of identity theft where I lost almost everything to a company out of Brazil. Bank of america was able to give me temp credit till they investigated and took care their end. Now all this took sometime and mean while Ace Cashing turn my debit over to a CA(legal mediation practice). They gave me a three our deadline to pay back the loan or I will be arrested at my job and will face more legal issues from the military.
So JediMistress, once I request my debt information in writing, what can they do in the mean time?

They legally cannot do anything until they validate. This company is not known for having a tendency to follow laws. Please read the web links in my signature. Those laws show what they can & cannot legally do. Since you have an exposure with id theft,go to www.ftc.gov and click on the id theft link. It will give you some very good procedures to clean up after this.I would insert fraud alerts in all three of my bureaus just to be on the safe side.
