I was contacted yesterday by an agency hired by a payday loan company (my cash now) to sue me in court if I don't cough up $1100 by this Friday. I have learned a hard lesson about payday loans, and had several. All of these companies except for this particular one were willing to negotiate a settlement/payment of sorts. They are now threatening to have my wages garnished. I found out since I originally took out the loan that my state (Louisiana) limits loans to $350, yet I was able to get $500 from them. Will that give me any leverage in court? I am pretty freaked out right now about this because this just couldn't come at a worse time for me financially.

Have you been served court papers yet? I would file a complaint with your state about this payday lender. ANd aslo tell them that they are threatening you with court if you don't pay by friday. But this is usually a scare tactic that they use to get you to pay.

my cash now is an internet based loan company. I have not been served yet, but I was told I would be served on Monday 12/17.

I dont think that a company will alert you to the fact that you will served . It is a scare tactic to get you to pay them . chances are that this company is not even licensed to lend in your state. If I am not mistaken ( and someone jump in if I am) I dont even think that this company is in the US. I think they are in Canada. They will not, they can not do anything to you.

Thanks for the info. I didn't realize my cash now was in Canada. I'm guessing the agency hired for their civil suit might be located here in the US? I was told I'd be served Monday either at my job or my home. I was told to call back this evening to let them know if I am able to come up with the payment by Friday. I had been left a couple of phone messages by a guy named Tommy Schwartz to call him regarding a pending civil suit in Louisiana. When I returned the call, I spoke to someone named Donna Fox, (it was a 1-800 number). When the phone was answered, they did mention the name of the company, but I don't remember who it was.

I seriously doubt that they will come from Canada to serve you with papers. An illegal company can not get a legal court to do anything. They will say anything they can to scare the hell out of you. Just know that it is just a tactic and that you are safe. I think you said you loaned 500.00 . How much have you paid them back

The phone number is: 1-800-801-0065. My original loan was for $500, and I did make at least one payment that I can recall. I was really trying to handle it, but unfortunately, everything else caught up with me at once (other payday loans, plus right around the same time, my cat was diagnosed with cancer, I had vet bills to take care of). I guess the reason they are asking for so much money is because of interest and late fees. The actual amt of money they say is owed is $1675.45, but If I can come up with money by this Friday, they'll knock off some of the interest and I'll "only" have to pay $1154.00.
