I have been in correspondance with Payday One and the last email I sent stated that they were not following the laws of my state (Louisiana). They sent me a "snappy" email back stating that I had to follow the GOVERNING LAWS of Delaware (yes, they used caps in the email). So does anyone have any advice on how I should repond to this?

dont expect some positive emails from them..If you cant pay, you cant..I would just search for them at the BBB database, and certified mail them..put a hard block on your account until they settle.

Whitenan, you contributed to the LA thread on State PAy Day Loan Laws made simple, so you know that Internet companies must comply with LA law.
and
Internet based lenders with no physical location can't have a license from LA. They are all illegal unless they also have a physical location in LA.
I hope you have included this in the correspondence you are sending the PDL.. ... Keep sending this in. As long as you are following what your DFI said, you are ok. They are going to insist differently and let them. Just keep sending the same response. Also, file with your state regulating agency and include what ever correspondence you have received from this company.

I did the research, and I know what they are suppose to do. I just didn't know if I should continue with the letters or just wait for them to make a move....which I am sure they will

You did excellent research and it is appreciated greatly. I have been sending the same e-mail to one of my pdls every tuesday since August....there is not much else you can do...you are not going to give in and apparently neither are they. Eventually mine sent me to collections and I dealt with them and so far nothing. Like I said just keep sending the same information, stick to your guns and keep everything they send to you.

I am not having that much of a hard time with them yet. I sent emails and certified letters out to all my IPDL's revoking ACH authorization and here is the response I got from them:

I'm actually a bit confused on this one. The more research I do, the more I'm finding that I may be wrong, and that internet based companies may not need to be licensed in LA. Several very legal companies do differently, and they are legal and follow the laws of every other state they lend in. Why would LA be different? There is a piece missing here . . . .
