Read the full FDCPA disclosures in the FTC website. Chances are that first collection company tried to collect on your debts. When they didn't get the money from you, they passed on the file to other collection company.

LoL! How can they collect on a debt that I didn't create?????? I have proof of *all* of my debts ... even the ones that have been paid off ... the only thing that is outstanding is a voluntary repo of my car ... three years ago. And that's for a little over $10,000 ... The only thing I have left is Student loans, through CitiBank ... if they wanna take 2 for the 15 I owe ... that'd be fine with me But IMO ... I think someone has ganked my identity and runnin up charges ... how do I fix that??? I can't "close" my SS# ... :?

Have you asked the CA to validate your account? Throw the ball in their court. They are legally required to prove that the debt is legit. Until they give you anything in writing, they can't do collections on you and cannot report anything in your credit copy. Be ready to file a legal case if they try to do something suspicious in your credit copy.

Is there any suspicious account in your credit report? Dispute the item with the CRA. Make them investigate the item so that you get confirmed about the reporting. If your dispute is correct, they have to report the item from your credit file.

Default Debt Verification Proof of debt

HI Everyone, when you request proof of debt from a collection agency or creditor and all they send you are copies of statements with your name on it, does anyone know if this is sufficient proof? LVNV has sent me this and this is not my debt. I'm just wondering what the law says abut sufficient proof, and I haven't been able to come up with anything.

Kay- that is not sufficient validation. There are sample letters to the side of your screen you can use to fit your circumstance. But don't expect LVNV to validate, they haven't mine for a year. And they DO share info. LVNV callled Wells Fargo, who in turn called me, and said they heard I need a loan and was in finfancial straights- I had never even heard of Wells Fargo before!!..Karen

The best way to handle to LVNV is to realize what you are dealing with-- a VERY CORRUPT junk debt buyer. They don't care at all about your problems, they just want your money and will do anything to get it. They will try to hide behind one collection agency after another. For example, if you send a letter disputing the validity to one of their collection agencies, they will stop using that one and send your account to a new collection agency to start up annoying phone calls all over again. And when they do send what they call "validation" it is nothing but a very small paragraph written on their own letterhead stating that they hereby validate the debt, which is meaningless and won't hold up in court because it proves absolutely nothing and a judge would laugh them out of court if they tried to use that as evidence. So, what I found to be effective with them is to send the letter disputing the validity of the debt and alleging credit fraud directly to LVNV by certified mail. Tell them that you are the victim of identity theft and that you believe all of the charges are the result of fraud and that you refuse to pay the fraudulent bills of someone else. Demand that they send you the actual credit card bills and receipts showing who signed for them, and what was purchased and where it was purchased. They have to respond to your letter by going back to the Original Creditor to get all of these records which costs them some money and gives you a huge amount of time before they will resume collection activities. In some cases they won't be able to find the information or the Original Creditor will not cooperate with them, and then if they try to take the matter to court, you can bring this back up in court through the motion for discovery, and win against them. If they can't get a judgment against you, then they will never be able to collect anything through legal means.

I'm well aware of the collection tactics of them!! Been dealining with their MANY agencies now. The only problem, it's not identity theft. It's an old cc opened up in 1982, no charges for 12-15 years, and we have been paying Sears all these years, stupidly. I feel we have paid 10x over what we charged in payments for 20+ years..Karen

I wish I could spend more time on this forum. Between working full time, and I'm in my second quarter at school, well it's online, I thought it would be easy but it's hard, it is so hard. I have to take 2 classes at a time, otherwise I don't get financial aid. It's for the better of my family.

I have told a lot of people about this website and how informative it is. It's just a great support.
