LVNV Funding LLC - why is it appearing in my credit report?

Can LVNV get a judgement against a debtor with a signature card, on file, showing his real social security number and signature?

Maybe they got the card from another old credit file and it is not actually related to the account they are collecting?

I JUST GOT COURT PAPERS HAND DELIVERED(WITH NO SEAL ) SAYING THAT I AM GETTING SUED FOR 15000.00 FROM LVNV FOR HSBC FOR A BIKE I DONT HAVE

Welcome to the forums Seafood, to better assist you could you please answer the following questions:

1. Is the account yours?
2. When was the last time you made a payment on the account if it is yours.
3. What state do you live in?
4. Was this on a line of credit, credit card, or was it specifically a vehicle loan for the bike?

Well, unfortunately the SOL for FL is 5 years. Which eliminates using that as your defense. However there is another defense that you may be able to use. LVNV is known for their record keeping, you may be able to request validation during discovery. If they can't you may be able to get the case dismissed as they cannot show cause for action. I would suggest going in this with legal council. You can start with naca.net for a good place to search for a consumer protection attorney.

LVNV Funding had contacted us we never paid as we never had money to pay it.
Well this last summer we started paying on it 50.00 a month I never questioned it as at the time they said it was Wells Fargo and we had a pick up repoed with them so I knew it was our debt. Now they are threatening sueing us as it is causing our account to go up. I asked for letters showing that they have the account ect and when asked I got hung up on so I called back and got hung up again. My husband called back we got a supervisor and again got treated nasty. When asked for information on LVNV I got told they don't have the information, I am dealign with Drs bondage. And that all of a sudden teh account is Wachovia well we never banked with wachovia they said they don't have to talk to me because I am not on the account. Well how is that possible when I am the co signer. Do we have any legal leg to stand on with this.

My husband is in the military this is a prior service debt. So the military said they can't do anything to his career wise.
I just don't know what to do I am so frustrated and ticked. I am just lost on what to do now. any help would be appreciated.

Default my credit report

this company showed up on my credit report stating I owe $103 for Hsbc account. I am not aware off this outstanding balance. I need to know the details off this amount so this balance can be paid off. I also need an account or reference number for this item.

VAlerie, this site is not connected with LVNV, it is here to help others with debt and credit issues.

Do you know what the money is for they say you owe? Some CAs do this and athere is no account.

You can dispute it with the reporting agency and also send LVNV a debt validation letter to find out what it is for, if you don't know.

Before you pay any one off, be sure and get something from them saying it will be paid in full before you send the payment. Or you can write a letter stating that, you paying xx dollars that they say you owe, will be considered paid in full. Send money orders or something that doesn't have your bank info.

Please be sure that this is your debt and it is valid before you pay. If you need help, feel free to ask questions..karen

The brady bunch of Sherman Companies: Sherman Acquisition Limited Partnership, Resurgent Capital Services LP, Sherman Acquisition II Limited Partnership, Sherman Acquisition LLC, Credit One Bank, N.A. Sherman Acquisition TA LP, Ashley Funding Services LLC, PYOD LLC, Ascent Card Services LLC, lvnv funding llc, Ascent Card Services II LLC, Anson Street LLC, SFG REO LLC. If you opened an account with any of the companies listed above, that's how they got to you. For our case, I was able to trace it when I opened a credit card with Credit One Bank last year. Then recently, LVNV comes into my credit report trying to collect a debt for Best Buy which I have already paid off 2 years ago. The funny thing is Best Buy also reported it as paid way back in 2006. I just sent my letters disputing the claims at the credit bureaus and LVNV - furnished our state general's office as well since it appears they have a branch in our area.

Default LVNV Also buying "settled" debt

A few years ago - I decided to erase my credit card debt with a debt negotiation firm. I was often late or didn't send payments and was up to about 24,000 in debt between several cards. I sucesfully completed the program (if 800 a month for over two years is succesfull, along with a suprise forgiveness of debt tax document here and there...). I have letters from all of the credit card companies saying the amount I had paid was sufficient to fulfill the obligation of debt (with forgiveness of around 25-45% of the total amount). Now - LVNV has items in my credit report for two of the credit cards that were sucesfully paid off - Discover and Sears. I imagine my best course of action would be legal counsel that deals with these sorts of problems.

Send LVN a copy of the satisfaction letter from Discover and Sears and ask them to remove the trade line from your CR. Also send a copy of that letter and the satisfaction letters to the Reporting agencies asking that it be removed.

you guys are all idiots. its perfectly legal to purchase bad debt to collect on and make the money. once you own the loan you can report it to your credit. only way to prevent this is to pay your bills. technically lvnv is not a debt collector, they own the loan/account you defaulted on. take responsibility dont blame others

Ryan,

1st LVNV IS a debt collector, regardless of their purchasing of the debt they were not the credit grantor therefore by federal guidelines they are a debt collector.

2nd, the original creditors (Sears and Discover) settled the account with the OP and sent letter to this fact. LVNV does not have anything to collect on. If the OC's sold them the balance erronously then that is not the fault or reponsiblity of the OP.

As to regards to pay your bill, he did and received a letter of satisfaction from the OC.

In regards to "you guys are all idiots" small minds resort to insults when they are outclassed.
