Default Official communication with the lawyer representing MMG/RMP

A lawyer who represents Risk Management Partners/Miracle Management Group has sent a legal notice to debt consolidation Care. It is regarding a thread in DebtCC forum. They have asked us to impose some restrictions on the forum-
  • Remove aggressive posts and personal information.
  • Ban members who have posted against employees and staffs of MMG/RMP.
  • Revoke the power of posting in forum without getting registered.
  • Lastly, they have asked for the identity of the members who have made such posts which simply against our Privacy Policy.

I'm assuming that you sent that letter by email. If you did, did you ask for a delivery and read receipt? I would print it out, including all of the email date and time stamps and resend that letter CMRRR or with an affidavit of mailing.

I feel like it is very irresponsible of the DCC website to leave such malicious posts in existence, if in fact that is the case. Did DCC remove any of the posts that were mentioned in the letter? I personally read through the MMG thread from time to time and find it to be nothing but negative, malicious posts against a company that has not yet had its day in court. I have had no dealings with the group so I am not speaking in support of them. In fact, if what is said in the thread is true, then what they did was atrocious. That said, I realize that when posters make negative and threatening comments, they are probably just venting and do not mean anything by it, but what they are doing is completely inappropriate and unproductive. Therefore, the responsible thing to do would be to remove the posts; it doesn't matter that they are opinions or not. (remember "I pay my bills"?)

As far as disclosing the identity of the members making the posts, in my opinion, absolutely not unless it comes to a point where those records are subpoenaed.

Removing the posts or locking the thread altogether should offer some protection for DCC if this law firm is in fact seriously considering legal action. It would be a shame if this site ever got shut down (I see it help so many), but as with any other forum I have visited and been a member of, malicious posts and disclosure of personal info. are strictly prohibited and it is true that most cannot post without first becoming a member.

Did you happen to read through all the letters? Freedom of Speech? The only thing that could be considered an attack, would be the one speaking of the child. The rest is from the members, and of which they are all entitled to say what they'd like. It's kind of like protesting. As long as I'm away from the business, I can stand with my sign on the sidewalk for 24 hours a day, 7 days a week.

Mikey,

I did read carefully through all the letters and I am college educated so I am familiar with Freedom of Speech. (You had absolutely no reason to be nasty about it)

Freedom of speech does not mean that you can make personal attacks on people; i.e. making threats, contract out on the owners, etc. When that line is crossed it becomes assault and I'm sure there were some slanderous posts made as well. I'm sure that MMG's attorneys could use what is on the site and have it shut down or fined or restricted if they care to take on the fight. I love this forum and would hate to see anything happen to make it no longer accessible.

Vikas asked for an opinion and I gave it.

I was in no way being nasty about it. I'm sorry you took it that way. I'm just trying to give you a clear example about what DCC is trying to do. The post that Miracle is claiming to exist has not been brought to anyones attention yet. If such post exist, why not tell us where it's at?

Vikas clearly asked in his letter for Gerity/MMG to point out the offensive posts. I don't know if they sent the second letter out before they received Vikas's letter, or if they're choosing to ignore it and trying to make Vikas out to be a bad guy.

The posters in that thread have had thousands of dollars taken from them, and they understandibly want it back. Stress can make a monster out of someone, can't it? I'm not standing up for anyone who threatens someone's life or threatens harm.

I'm willing to help clean up that thread if needed. But I need to know where to start.

I think because legal action is being pursued, that we should let Vikas look at the thread first. Soon as MMG points out which areas are a concern to them, then I'm sure Vikas will take action.

That's what I'm saying, Mikey. MMG needs to let Vikas know which posts in particular. But they're not giving him that information. Sounds like they're just being whiners.

I just went through the thread looking for the posts he mentions specifically in that letter. I found that Mike had already removed those posts. When did you do that? Also the only thing I found was a lot of angry people voicing their opinions. And yes I did go through ALL of the pages.

I think you're right Jess. This company appears to be in so much trouble, that this is the only thing they can allegedly complain about.
I've read every one of those posts, and I feel for those people that have enveloped the trust of this company and now have lost their money.
If they have nothing to worry about, why then have they enlisted lawyer for help? Just because of a few negative posts? Any legit company wouldn't come on here and post, nor would they send letters to DebtCC.
This is a forum for debt management for cryin out loud.
I'll have to agree with a few things Rach posted, there's no reason posters on here should be personally attacking anyone or making bodily threats. It's understandable that they're upset and possibly regretted posting such things.
Vikas...you do what you've got to do. We are humble in your presence and this site has done alot more good than harm.
Just my opinion.

Has anyone seen Stanley's blog about this company. Apparently MMG made news in Arizona. The heat is on this company and they're scrambling. This is probably why you've got these letters, Vikas!

I Think the company got caught with their pants down,so to speak. Now they have to do something to try to get their business back in the positive light to get new customers. I read all the threads and I,too, think it was alot of really frustrated people venting. While I do not condone violence of any kind,I think alot of this talk is just that.Vikas,I am behind you and DCC,let me know if I can help....Karen
