Hi there.
I'm hoping you can help me. I came across your post about Gerald E. Moore. I have just been contacted by someone at his office. They told me I had 2 choices.. 1) pay in full or 2)pay in two installments. They also told me I HAD to do either a "check by phone" or debit. I told them NO WAY. I sent them a "validation letter" today (certified). My question is... I am also from New Jersey. I was wondering if you could send me any info you have regarding GEM not having jurisdiction in our state? I was totally unaware of this and I think this info will be helpful with my fight.

Though KittieKat is not around, but you can read some of her postings done regarding Gerald E. Moore. Read the advice given by VLD as he is a lawyer and knows the legal approach. In any case, the collector must validate the debt in the first place. Make sure that you have sent the letter through certified mail with return receipt requested. Keep the green copy in safe place as this is your proof of knowing the debt account for which they are doing collections.

The collectors are bound by the federal laws to present the account obtained from the credit company. As far as I know, Gerald E Moors is not licensed in New Jersey. I will confirm this information with the state licensing board or the Dept of Finance in your state.

I did some research and found that Gerald E Moore is not licensed in New Jersey. They only have a business address in GA

I think the term you are looking for is "licensure" rather than "jurisdiction" if you are asking whether Gerald E. Moore can sue you in NJ. A good place to look for information about attorneys and law firms is Martindale-Hubbell, Martindale.com, or FindLaw.com. After you have done a search, you can call the state disciplinary board or ethics board to verify admission to practice based on the information you found in a lawyer listing. For instance, in New Jersey, you can try http://www.judiciary.state.nj.us/oae/atty_disc/atty_disc.htm. Other states, like Pennsylvania, have an online listing of who is licensed to practice as well as a lawyer's disciplinary status. Check out padisciplinaryboard.org/ if you are interested in a PA attorney.

An attorney cannot threaten to sue or otherwise take legal action in a state in which he or she is not licensed. To do so may violate the fdcpa.

It has now been past a month since I sent GEM a validation letter and he has yet to respond.

I am sorry to hear he is harrassing my Jersey neighbors. If you PM me I have a attorney who is very familiar with GEM and is licensed to practice in both PA and NJ. They will be glad to help you out with this guy. Guarenteed that if you tell GEM to forward any further information to this attorney (GEM is very familiar with him also) you will most likely not hear from him again.
