I have stopped by here several times thinking that I should do something about my PDL debt. Today I finally decided that I have got to make the leap. So here I am and here is my story.....

First off, I will save you the backgorund story. I was horrible with managing money after leaving college and that is basically why I ended up in this mess.

I currently have 7 PDL. I live in NC. All are internet loans including Ameriloan, Ambassador, Emerald, GSF, Magnum, 1 Click Cash, and Paycheck Today. I have paid more than the principal on all of them. I plan to close my account with Bank of America tomorrow. Any help or guidance would be greatly appreciated.

First off, you have done the right thing by paying off the principal amount to all the lenders. This is good. Payday loans are illegal in North Carolina. This means that the lenders violated the laws by lending in your state that does not allow payday loans. Call these companies one by one and demand a paid in full letter. Keep the contact info of the attorney general of your state with you. You might need it in case the lenders intimidate you in paying more.

Just wanted to post an update.....

I just this week started getting calls. GSF is offering to settle the loan for $200. The others just keep calling and calling. I don't answer the phone and just have them sent to voicemail at work.

I have sent them letters demanding paid in full status, but they do not respond. I plan on sending letters to all of them again today.

Is anyone else out there in NC or anywhere else that has been through the battle with any of these places before that could offer some guidance?

Here is a link to NC's pdl laws, they are prohibited, you are only obligated to pay back the principal. File a complaint with your AG's office immediately.

And kota101 is right, e-mail them and e-mail them til they get sick of you. But you should only have to pay back the principal nothing else since they are illegal in NC.

Also, when you e-mail/call these PDLs, make sure to let them know that you are involving the AG in this. They hate hearing that, and it seems to make them more willing to make a settlement with you.

OK...here is the latest. Everyone has pretty much left me alone at this poing except for GSFIL who continues to be a pain in the back side. I finally called them back today after they called my work ten times in three hoursand asked for my supervisor. Here is how the conversation went.....

We were calling about your over due loan. How would you like to fix this?

I am willing to make a payment of $50 this week, but that is all I can do

HOLD ON PLEASE

We cannot accept a payment that small. Can we just debit the full amount from your checking account?

-No, that account is closed so it will not do you much good.

HOLD ON

Can you send a money order for the full amount?

-Nope, only $50

HOLD PLEASE

I will have to let you talk to my supervisor....

I understand you have a loan that you defaulted on.

-Yup.

Can you pay this from a checking or savings account?

-No, I don't have one.

Do you have a friends account you could use?

-No.

If you will open a new account and get me the information I will debit $200 from the account on your next payday (3 weeks away) and close the account.

-OK I can do that, but I would like that agreement in writing.

I will send you a receipt as soon as we receive payment

-No, I need something in writing before I am going to send you anything.

I will be turning you over to our legal department.

-OK, thank you!

These people are scum. If you default on a loan with them be prepared for a war. They will call you about 20 times a day at home and work. Has anyone dealt with them previously? I have paid these fools $800 on a $200 loan.

a word of caution - under no circumstances would I give them your new account info. I wouldn't trust them to close the account, even if you have it in writing. I would tell them you'll send them a money order or a certified check.

I am definitely not going to. I know that these people are one or the worse ones to deal with. After talking to them I trust them even less. I don't even think at this point I would send anything to them. I just got really frustrated when they called me at work bothering me and my co-workers today.

dbaker is right, no matter what they threaten never give out the new acct. info. I would stand firm and get just as harsh as they are getting with you. After all you have what they want, and if they want it, they have to go by your rules. Pardon me, but, screw their legal department, if they were any kind of legal dept. they would know that they are violating laws and in the wrong. So I would not give much weight to what they say or threaten.

Have you reported GSFIL to the Attorney General yet? I would definitely do this, if you haven't already. They are not allowed to be calling you at work and definitely not allowed to ask for your supervisor. This is between you and him. They're violating your privacy. Guys, what else can greenrhino do to keep them from calling at work?

I think alot has already been done. You can try sending a cease and desist letter. But because they are the original creditor they don't have to abide by it, but I guess it wouldn't hurt to try. File complaints with the FTC for violating privacy laws by divulging the nature of their calls to co-workers. They are just trying to humiliate you into paying them. Just hang up on them.

Okay, I would send them a certified letter with return receipt requested stating that you can no longer accept these types of phone calls at your place of employment. I would also fax it and e-mail it if you can. They don't need to be contacting you so much at work. You stated you paid what you owed in principal? Then you should be fine and starting slamming them with the complaints. Attorney general, BBB, Division of Financial Institutions. They will be more willing to mark you account paid in full then. Also, keep everything documented when dealing with any internet pdl. Welcome to the forums Smile

My letters will be going out today. So far (kepp your fingers crossed) I have received NO calls at all from these jokers. I did have a $200 loan with them, but I had paid almost $800 to them.

I know that I first came here just wanting to know what to expect so here is an update to help the rest of you. This week has been quiet I have had a total of only 2 calls including the above to my cell phone and no calls from anyone to work. WooHoo!!!!!

I will continue to post updates as time goes on to let you know how things are going. Thanks again for everyones help you guys are awesome.
