|
|
I filed a complaint with the Better Business Beureu (BBB) back in early january after NUMEROUS harrassing daily phone calls from this company. I subsequently got a letter attached to an email from the BBB with this company claiming they were ceasing all communications efforts after recieving my complaint through the BBB. Now all of a sudden they are starting to call me yet again! Its virtually the SAME number, only the last 4 digits are different. First time it was 775 319 1501,now its 775 319 1516. What the heck do I do?? I have NO knowlege of ANY debt with Allied Interestate. This most recent call wasnt even a person...it was an AUTOMATED message which I was told is illegal for Credit Collection people to use! Help!

I would call them back and ask what the debt is. Make them validate it in writing. You have a right to know. How can they expect you to pay for something you have no knowledge of? Make them validate the debt. KYSIDE38

I didnt get a LIVE person this last call. It was an automated voice message so I couldnt. I tried to call back and got NOTHING....not even a message machine. I think its a bogus number or some kind of scam. I sent my SECOND complaint to the BBB. I even made a copy of the letter the BBB got from an allied interstate company in West Palm Beach Florida.

Send a cease and desist letter to AI's mailing address that is nearest to you. Send it through certified mail with return receipt requested. This will prove their receiving your letter. If they still contact, sue them for FDCPA violations.

At this time they do not have my mailing address. Wont giving that to them in the cease & decist letter give them my address, allowing them to harass me that way? I just dont want them buggin me that way too. Or does the letter force them to stop communications with me period. Im also worried that when I do get a job that theyll garnish my wages to get this so called 'debt' that they claim I owe their 'client' via Allied. Thanks for any help.

What if I do not have this information --> Re: File #0000000 - ABC Lenders- #************
-For: $6655.55
They never told me who they represent that I supposedly owe money to, nor did they ever tell me an amount or a File Number. I got NO information other than daily phone calls telling me I owe them money. Should I get them to validate this supposed debt first?
I was told by a friend who is a Consumer Credit Counselor to ignore allied interstate and just keep filing a complaint with the Better Business Beurou (however its spelled). Any advice here would be helpful. the new calls are even with a different phone number...its only different from the first number by TWO numbers it WAS 775 319 1501, the new call is from 775 319 1516. What the heck is going on here?? Help.

It is not illegal to use an automated message.
Filing a complaint will not make the problem go away on a permanent status. You need to find out what it is about.
collection agencies can have several different numbers. If you keep getting a different number on your caller id then you aare most likely being called on an automted dialer which usualy has a seperate number from whan an actual collector dials it.

They called after agreeing to cease communication. I would say that is a violation of fdcpa as well as possible breach of contract since they agreed in writing to quit.Stand up for your rights and deal with them on your own terms.

I like cajunbulldog. Don't take any crap. They are asserting their rights. Assert yours.
Automated dialer use is not a violation. However if they agreed to cease communications or you sent them a cease call letter, then violations abound. But agreeing to cease communications due to a BBB complaint is probably not going to bind them to anything. They must receive real cease letter from you.

TexasLawyer, I cant send a Cease letter because i dont have ANY idea why they are bugging me. Ive only gotten a live person ONCE and they wouldnt tell me what Company they are supposedly trying to collect a debt for.
On top of it, they were extremely rude. I had never heard of this company until they started these harassing daily phone calls. Therefore how in the heck would I be able to deal with them?? How the heck can i send a cease letter when I cant get out of them who or what theyre calling about??
ps- i also do not have the address of the allied office that is calling me. it could be anywhere. the letter that the BBB got from them is in florida...but i live in california? what the heck is goin on?

Look on this site for an address closest to you. Also, there are cease & desist letters here you can adapt for your own use. I sent one last month & they did stop calling. I did not even sign or print my name, just the area code/phone number to stop calling.

Actually it is against Minnesota State Law for a CA to leave an automated message. Any automated message must automatically be followed with a live person.
