They have contacted people other the debtor, my wife, threatening them, today again stated my wife gave them the authority to contact them, however at the time she was in the hospital with "Broken-Hearted Syndrome", unable to talk on the phone and or make a simple judgement. (lookup broken_hearted syndrome) We have had so many calls and lies who cares, in MO we deal with companies like this, we have an Atty General

Just got an account sent to them, I called them to make them aware of a payment I had sent, and work out payment arrangements. I have NEVER been treated the way I was treated, threatened, insulted. They did NOT want any payments, only the amount in full. They also stated that they had proof that I had that amount in an IRA, CD, or elsewhere and if I hung up without paying, they would sue me immediately. I had to eventually hang up, because I did not have the money in full and was tired of them screaming in my ear. I then called my credit counseling company and added them to the list so they could deal with them for me. I then reported a complaint to the BBB. NES has had over 800 complaints filed against them in the last 36 months. And of course their rating is UNSATISFACTORY with the BBB

If you have given them your bank information because of their illegal "we are verifying what info we have tactic, you can call your bank and make them aware of whats going on. They can close out your current bank account and reissue you a new one. I did it with my financial institution. They were very helpful. I am in the process of reporting them to the BBB and the federal government.

I came looking online to see what what said about this company because today I had my first encounter with them and could hardly believe how rude and unprofessional these people are at this company. Like most of you wrote, they threatened me and told me to go borrow from a family member and wire my payment in full TODAY! and then hung up on me. I am filing my complaint today with anyone who will accept it and seriously thinking about calling the owners.

This company has been making harassing phone calls to our residence looking for someone with a similar name to husbands, but different middle initial, different spelling of the first name, different social security number, residing in a different state, on a complaint that with a company we've never heard of. After being hung up on several times when the party they were looking for was not home, my husband finally had the opportunity to point out the error in contacting us. Three hours later, I took another call from them where I explained that we had already cleared this matter earlier in the day, and I was told that my husband would have to "appear in court with his social security card". I asked what court that would be and she said that "we would be served papers shortly". We have had three more calls this week, and now I am leaving calls for THEM everyday to call ME back, so that I can get a letter from them acknowledging this error once and for all. And here's a surprise, they haven't called me back.

I have rec'd several answering machine messages over the past couple of weeks in which the caller would leave an 800 # and since I had no idea who it was or what the call was about, I just deleted. Today I got a phone call (I'm guessinf from the same place) from a guy who said that I was going to be named in a lawsuit but if I paid up $$ owed, I could avoid the lawsuit. I asked who I owed to and how munch. He named a wireless carrier and quoted $837. I said that I did owe $$ but not that much. He asked how much and I told him less that half that(actually turns out that it is really much less than that.) He decided he was authorized to grant a settlement in the amount of $419 if I paid in full today by 4:30 using a post dated check, Visa or MC (to which there would be an added $15 fee.) I told him that I would not give him ANY financial information over the phone, that I did not even know who he was. He then told me he was from Enterprise. (I thought that was a car rental place!). He proceeded to give me the Acct # of the original creditor as "proof" of who he was (not the same acct# I have). I asked for his name and he told me. I insisted that I would not authorize $$ until I verified that this was legit. Finally hung up telling him I would get back to him, though he wasn't happy about that. (I must say, contrary to other things I've read on this board, he was always polite and respectful during our brief conversation)
So, I've spent the afternoon online, trying to arm myself with information. I got a look at my 3 credit reports (first time ever for me and yes, I know, that's pretty bad). Turns out that this acc't has been hanging around since 6/02...which, near as I can figure, means that SOL in NYS is 12/08...correct?
At this point, I would be happy to settle for the $419 even though I would like it to be less as I really only owed around $100. But if I could get it to go away for $419, I would. (Zach from NES said that if I don't pay up by 4:30 tonight, the "deal" goes away...it's now 5:00, oops!)
I have used one of the templates for a debt validation letter and have it ready to go out on Monday. Zach didn't give me NES acct # for me....can I leave that blank? Do I even need to send this? According to my credit rept, both the original creditor and previous CA have closed out the account. It seems NES has gone fishing for info on my credit just ithis past October and November. Do I need to respond? Can't afford to pay them $800...and even if I could, that is an bill inflated with bogus charges, so I refuse to do that, as I have been, right along. But would like to get it gone and get my credit repaired. I know that I should have been more aggressive right at the beginning of this mess, but there were things going on then that made me just ignore it. Bad move, but can't change that, only deal with it as is now. Suggestions?

Ok here is my situation. I owed bank of america 1000 for a credit card debt. i just received a call today stating that i owed money for this card. They told me they would settle for 700 and that my credit will put back to 0 and that it would be fine. I thought this was the my bank or an associate or whatever. Well he asked to verify my checking number so me just waking up at like 7 am gave it yeah i know bad idea. well now after reading through 12 pages of posts i figure screw these guys i do not wish to pay them a dime but i need some advice on what i should do. any advice would be awesome. i was thinking about changing my bank account number and getting a cease and desist or i figure if i pay them i do not pay through "tina" the lady who i spoke with .. she can go to hell. this is madness these people are so shady..... anyways im open to any advice thanks guys.

If NES contacts you and says they cannot accept payments towards your debt they are LYING! I have been harrassed by them at home and at work, cussed at, and called names. Ater being asked if I could borrow money from someone to pay off the debt I asked him if he would lend me money. He then said to quit being a "tough girl". Unfortunately he didn't want to lend me the money. I called my Debt Consoladation company, Care One (which I highly recommend) and was informed that they receive 40-50 pecent commision from any money they collect from you that is why they are so ruthless. Well the mofo who called me will not be getting my money cause I have set up a payment plan through Care One. If they try to contact me further I am pressing charges. Know your rights and don't fall for their scams. They are not able to harrass you or not accept payments from you. Check the Fair Debt Collections Act for further info.

This company started to contact me on the 6th of December, calls to my cell phone at 8:01 am, 9:34 am, 10:16 am, calls to my home number at 8:05am, 9:41am, 10:21 am. I called them back and spoke to a 'Paul'- totally unprofessional behavior from this gentlemen. He comes out with he is from NES and they are a debt collection agency, collecting on a overdue/delinquent credit card balance I have with CitiBank in the amount of roughly $6,000. I explained to him my situation, I am currently unemployed, have many other bills, and simply couldnt afford the 700 a month payment Citi was requesting. So he says he can work this out for me, and offer me a one-time settlement opportunity 'without taking me to court' if i make an immediate payment of $3,200. I told him thats nearly impossible to come up with immediately. I am 24 and do not have that kind of money lying around. HE LOST IT- immediately started in with threats against me, 'we will take you to court, you will end up paying twice as 320, plus legal fees, plus anything else we want you to pay, we will garnish your wages, we will repossess anything you own, we will not stop until we get this money'. I asked him if he was done yet, and he started in again with the threats. After a good five minutes of him telling me how irresponsible and a bad person i was...he offers me another one time opportunity of making a $1000 payment. I told him again, I dont have $1,000 lying around. He says: '1,000 isnt alot of money nick, to most people today $1,000 is just like $1 (WHAT???), you're just not putting any effort towards helping yourself out' He says he is fed up with dealing with me, and transfers me to another associate. This fellows name was Kevin Johnson- he played to good cop routine. I told him, I want to pay this debt, but demanding I come up with 3200 dollars in a matter of minutes, I cannot do that, what can we do to make this right. He suggests that I speak with a bank to get a loan to make this payment. Me being a good-natured person, I thought this was something I should do. So Kevin tells me to do so, and then get back in contact with him. Monday morning of this week I went to a few local banks, and started the loan application process. Tuesday morning I get six calls within one hour (between 8 and 9 am, all left messages on both cell phones and home phone), all demanding I call them back immediately, none of which were Kevin. I call Kevin back and ask him whats with the calls, I'm working on this, why does your company continue to harass me? He says 'nick, we're just making sure you're taking care of this'. I told him one call is sufficient enough. I tell him the applications are being processed, and the two banks I applied at will be letting me know. Kevin turns into 'mr. helpful' all the sudden. 'nick thats great news, we're glad to hear it, you're taking the first step towards getting your life back on track' He tells me to speed up the process, he'll go ahead and schedule that payment now, but he will post date the check to today, leaving ample time for bank to contact me. Me, being such an idiot, gave them my checking account information. Luckily he did not give me any type of confirmation number for this payment, nor did he actually get my authorization to make that debt from my checking account. Wednesday Morning was a nightmare for me, received about 20 calls within a matter of hours from this company, again demanding I call them back immediately. I call them, and say I havent heard back from my banks yet. Wednesday afternoon I find out from my banks that I do not qualify (even with a co-signor, my dad). This morning the calls CONTINUED to come in at an alarming rate, I finally answer the 15th cal of the hour, and speak with anther different associate. I tell him unfortunately I wasn't able to qualify for those loans (even with a co-signor as they suggested) and asked him what other suggestions he had for me. He had no other suggestions, nor did he even answer my question. He says 'so you have no intention of repaying this debt' . I tell him well you're not leaving me with any options to pay this debt. You're demanding I pay $3200 right now, and arent offering me any type of per-month payment plan, so no, I have no options for paying this debt. I cannot produce $3200 at the drop of a hat and you're not willing to help so we're at standstill. He says 'we'll see you in court' and then hangs up.
I wish I had read this entire thread before even deciding to try and work with this company. Obviously i'm not the only person in the world with outstanding debt, nor am I the only person dealing with this company. I feel even dumber for trying to get the loans (which I realize now was just a temporary means to an end, why take out a $5,000 loan, place myself farther in debt, just to make this one company happy and stop calling me with their harassing ways) Given that this thread is over two years old, and still continuing to grow, I shouldnt have fallen for the scare tactics they are pulling. They have my checking account info, and I hope they make some type of un-authorized debt from my account. I will be keeping close tabs on my account!

you need to close that account and open a new one.also do not talk to these idiots if you can help it.also,check your state laws in regards to recording calls.if you can get these mopes threatening you that's fdcpa violation money for you.just take care of your bank account first.

OMG these people are beyond rude!The have called harassing and yelling at us.Finaly after 2 months my husband and I got a phone call saying they were willing to work and agreement and said the amount and we have agreed to it.So now we have a settlement agreement in writing and are actually going to pay it off in full cause we took a loan out and now they want us to give them our bank account so they can authorize the settlement!That's crap cause we already have the paper work stating we can send certified checks and where to send it to!So are we right for refusing to give them our bank account?

Send NES or any debt collector a certified, return, receipt, requested letter asking them per FDCP ACT, Section 809(b) Validating debts within a thirty day period. The collector shall cease collection of the debt or any disputed portion thereof, until the debt collector obtains verification of the debt of any copy of a judgement, or the name and address of the orginal creditor, is mailed to the consumer by the debt collector. And then respectfully request: the amount of the debt, an itemized statement, the name of the creditor to whom the debt is owed and proof that the collector is licensed to collect debts in your state. Then advise them that you are aware of your rights under the Fair Debt Collection Practices Act and the Fair Credit Reporting Act. (look them up on the web lengthy but worth knowing) and add they cannot add interest or fees except those allowed by the original contract and they cannot attempt to collect the debt without validating, that violates the fdcpa. Also, advise them that you are keeping accurate records of all correspondence from them and their companies including recording all phone calls. (this part keeps them from calling you because you have now advised them that you are recording them) and you will not hesitate to report violations of the law to your State Attorney General, the FTC and the Better Business Bureau. Also, the last line should read that you demand that the immediately send a copy of this dispute letter to the original creditor so they are also aware of your dispute with the debt. And if so inclined put in a paragraph of inaccurate reporting to the Credit Bureaus. This does work and then be ready to dispute any and all debts that might be yours in court if they go for a judgement; but in most courts today if you have done all this they find in your favor and either dismiss the debt or lower the payments to fit your budget.
Do not pay on the debt because you start the clock on the debt once again going, if you have not paid a debt for years and the SOL is gone by you might want to use that as well. Please read about your rights under the law and fight these vultures. They seem to get a mob mentality when times are tough! Keep the faith and know your rights.
