National Enterprise Services went to great lengths(all in one day) to get me to pay....

On 12/29/08 I was contacted at work by Tina Cache. She immediately identified herself as working for a law office and trying to resolve a credit issue with me. She stated that I was about to be served a summons by the sheriff for court to garnish my wages by Baker County (they do not have my actual home address, only work address). She stated that they had sent me several settlement letter in the last 6 weeks (none of which I received). She said they offered me to settled out of court for $1955 instead of the $5578 that I owe. I told her if I had gotten the letters for that kind of settlement, I would have definitely called them back and worked out the arrangements. She was very polite to me at this point and said she could still possibly get me that deal. I told her that I could get the $1955, possibly from my father.

When I questioned the summons for more information, she stated that she would need to see if she could stop the summons from being served by doing a conference call with Baker County. The 3rd party line rang and someone picked up and said "Baker County Court." Ms. Cache proceeded to ask the 3rd party about a summons and how we wished to halt sending out the summons because there was a possible out of court settlement. Ms. Cache provided a court case number (which I wrote down) The 3rd party person asked me for the last 4 digits of my social security number and I gave them. The "court official" said she wasn't sure she could stop the summons from being sent out because it was supposed to be served by the 31st. Ms. Cache assured the "court official" that we were attempting an out of court settlement and she (Ms. Cache) would get back to them about the summons. We then hung up with "the court." Then I was told that I only had 24 hours to reach a settlement or I would be served the summons. Ms. Cache had talked to my boss before I got on the phone and revealed information about sending a summons out to my place of employment and garnishing my wages.

After the 3rd party call ended, I consented to a 3rd party call with my father. He requested proof that if we gave them the money that they would not come back after the debt later on. They were unwilling to provide proof, but finally consented in sending over a faxed letter. The letter was a standard debt collecting letter, nothing in it stated that they agree to cease debt collecting and the settlement amount would be paid in full. Then they requested that my father give his banking information to them over the phone. My dad is no fool and baulked at this. He told them he was willing to send a cashier's check out immediately, but that was not acceptable to NES. Ms. Cache's supervisor got onto the phone and started to belittle my father saying that my father doesn't even care about his own daughter. The phone call escalated to the point that I was told to call back on 12/30 to settle the deal.

I proceeded to call my bank and was advised under no circumstances to give out our bank information. I did some research on the internet and called Baker County Court today (12/30). I was told outright by the real Baker county court office that the court case given was not theirs. I also found out that since I do not live in that County, a court case from the debt collector cannot be filed there.

I then called NES and Ms. Cache back. I told her that I was unable to get the funds. She asked if my dad was unwilling to help me. I told her no, he was willing to give me the money, but is wasn't going to go to NES under any circumstances. She attempted to say ok and hang up. I stopped her and I told her I had some questions about when the summons was being served to me at work and that I didn't want to be contacted at work again. She avoided the subject, so I asked for her manager. I was put on hold several times with her coming back on the line telling me all the managers were (convieniently) in a meeting. I told her I would wait.

Finally a Mr. Slade got on the phone. He asked why I couldn't pay and how I needed to find the money elsewhere, immediately. I told him, I was chosing not to pay that amount and would prefer court. I asked him about the summons and he pretty much said that there wasn't one. I proceeded to tell him that I was told on 12/29 that I had a pending summons. I repeatedly told him, I wanted the summons I was promised and I wanted it served immediately at my work. He started to get angry when I tried to interupt him and proceeded to threaten to garnish my wages and take everything that I have. He was very belligerent and very offensive. I interupted him one last time to tell him that I was recording the phone call and everything that had been said. He told me that I couldn't do that and I said, "Sir, legally in my state with one party's consent I can and I consented." He ended up flustered and actually told me he was going to hang up before he actually did.

I am willing to repay debts I owe, but I do not think the fact that they impersonated a county court, threatened to garnish wages, harassed me at work, and showed total disregard for my father and myself is something I should have to deal with to make ammends for the debt. I do not want to deal with a company that I feel I cannot trust and who lie continuously.I am not willing to give large amounts of money to someone I am not sure with stop harassing me once the debt is paid.

Well I was contacted by them about 2 weeks ago about a $2,700 credit card debt and they left a number. I called and the lady was actually nice and ofered a settlement reducing my total debt to $1,600 if I paid by the end of the month. I told her that I couldn't but that I would start making lump payments every 2 weeks and she agreed. I should be done with the debt in about 2 months and would actually save $1,100 in the process. Not bad I think...

Default Let's all call National Enterprise Systems for the next 30..

Why don't we all start calling them every day for the next 30 days and just ask for Linda, Bob, Sam...tell them they owe us money to reimburse us for the time we've wasted listening to their threats. Here's the phone number I called today....have at it folks. Maybe if they had 1000 people per day calling their offices on their 800 number, we'd at least get the satisfaction of running up the 800 bill. 800-882-9325

Under the fdcpa, it is $1000 per action, not violation.

I worked for NES for many years and yes they are liars and full of shit. No they cant sue anyone. collectors are just in competition to get a commission. The managers and supervisors are unprofessional and liars as well. I personally feel this company needs to be shut down. The owner and his sons run the company and they are extremely racist and greedy for money. Employees who don't bring in alot of money for the company gets dogged and or terminated. In fact no one uses their real names at NES everyone uses aliases..My suggestion to all who owes money and gets a call from NES is to not pay them and refer back to your original creditor and work out a plan with them. THEY WILL WORK WITH Y0U.. Hope this helps someone

AS A FORMER NES EMPLOYEE...IF YOU GET A CALL FROM THEM AND THEY THREATEN JAIL, OR SHERIFF OR COURT INFORM THEM YOU ARE RECORDING THE CONVERSATION I GURANTEE THEY WILL EITHER HANG UP OR CHANGE THE CONVERSATION AS THIS IS TOTAL VIOLATION OF THE FDCPA. EACH COLLECTOR IS COMPETITION WITH THE OTHER TO SEE WHO CAN GET THE MOST COMMISSION FOR THE MONTH. AND YES ITS TRUE THEY USE ALIASES.. I WOULD NOT FEEL COMFORTABLE GIVING MY CHECKING INFO TO SOME ONE AND I DONT KNOW THEY'RE REAL NAME..EACH COLLECTOR HAS A DIALING SYSTEM THAT CALLS PEOPLE.. AND IF CONTACT IS MADE THEY WILL PUT DEBTORS COLLECTION SCREEN INTO A "HOT STATUS" IN WHICH THIS ENSURES THAT ONLY THAT COLLECTOR CAN NOW SEE THIS ACCOUNT.. THEY TELL ONE LIE..BUT IF THEY DONT GET THE MONEY THEY GET NO COMMISSION.. SO THEN THIS ACCOUNT GOES BACK INTO A OPEN POOL THEN HERE COMES ANOTHER PREDATOR WITH SOME MORE LIES...IT'S ALL ABOUT THE COMMISSION.. SOME PEOPLE HAVE GOTTEN COMMISSION CHECKS IN AMOUNTS OF UP TO $20,000 DOLLARS BY LYING TO PEOPLE AND THREATS OF COURT.. NES CANNOT SUE NOR CAN THEY GARNISH WAGES. THEY CANNOT THREATEN ONE'S SPOUSE EITHER.. I WAS ONCE ONE OF THESE LIARS BUT THAT'S NOT MY CHARACTER SO I QUIT.. BECAUSE I DID NOT LIKE THEY WAY THEY TREATED THEIR EMPLOYEES AND I DEFNTLY DIDNT LIKE THE WAY THEY TREATED DEBTORS.. MY SUGGESTION TO ANYONE WHO OWES THEM IS TO MAKE A (DP) DIRECT PAYMENT TO YOUR ORIGINAL CREDITOR...THAT WAY NO ONE GETS A COMMISSION FOR IT.... I HOPE EVERYONE WHO OWES NES READS THIS BEFORE PAYING THEM ANYTHING..

Default National Enterprise Systems

I received a phone call yesterday and today from this company. The only thing i have asked is a verification in the mail whom this company is and to who the debt is for. They said i owed 4360. since September 2001. I pay my bills. They done the same stuff about sueing and getting judgment against me. I asked the lady that its odd they are contacting me now about it with it being 8 years old. Can they do that with it being that long ago and also why now. I dont know anything about it. Please someone inform me.
