I am working to get out of the patday loan trap. For the most part, I've found these lender willing to work with me. But I called Nationwide Cash this evening after recieving a letter via email regarding a NSF return. My son was in the hospital and I have to use the funds out of my next check to pay my mortgage and daycare so I can keep working.

The representative at Nationwide Cash's "Fraud" department stated that they will pursue legal action on me if the minimum amount can't be drafted from my bank account. I no longer have overdraft protection, and I will not have funds to cover, which I explained to the man. I stated that I was willing to work out a payment arrangement, but he said if Nationwide Cash made an exception for me, they'd have to make an exception for everyone. He said that they could send out the local authorities for bank fraud. I'm pretty sure that is incorrect, especially here in Texas - I never wrote them a check - it was all over the internet.
How can I work out pay arrangements with Nationwide Cash?

Extend this payment proposal to Nationwide Cash through certified mail with return receipt requested. I hope they will be arranging you a plan if not done on the first time. They try to pressurize payment so that they can recover large amount of money at one time. Do let us know their response after Nationwide Cash have received this letter. I am sure that this will work as it does with most of the people.

One question though, do Nationwide Cash have any basis for sending local authorities out to arrest me?

I would hope not, I am in Texas and a single mom of two, so obviously it rattles me a bit to hear that!

This is just a scare tactic. They will not be sending out the sherrifs to arrest you for bouncing a check. If you became a habitual offended...or basically purposely writing hot checks to BestBuy or other stores, then there would be a reason to get the authorities called.

If at all possible, pay this loan when it's due. If it's going to put a strain on your financial situation, move the funds over into your savings account. You'll get charged a NSF from both sides (your bank and the loan company), but its better than losing your entire check.

Rest assured, no one will be coming after you. You have other things to worry about...

Again, thank you very much for all your replies. This forum has given me power through support and information that I can use.

My loan principle was 500.00 - I have already paid them 500 dollars via "rolling" over because I couldn't afford to pay it all at once.

I am going to send a certified letter tomorrow requesting that they one, validate the debt by listing the principle and interest along with a record of all payments I have made on this loan. I also asked them to refrain from renewing the loan. So maybe I can pay them off soon!

I am asking that they allow me to clear this matter up in payments, which I am more than happy to make, after they send the requested validation.

I DO have other things to worry about - my son was in the hospital, which while not a good thing, was the catalyst to me seeing the light in regard to getting out of the payday loan cycle. They can take priority after my kids and my mortgage payment!

Have you got something in writing from the loan company about the loan not to be renewed? A telephonic message may not sound helpful here as it might not have been recorded in their computer system. If the person who attended your call has entered a note in their system, then it's fine. But you should insist them to give it in writing.

Also, you are supposed to get a financial statement showing the complete break off of the amount. Most financial institutions show their statement in two different columns. One is of the principal amount and the other is of the interest charges. Each monthly payment that you contribute goes to the principal as well as the interest amount proportionately.

This summary gives you an idea how much you have paid to the loan amount as well as in interests. So, you should definitely get a statement from the company. After all, this is your right as a part of the loan contract.

BTW, how is your son now? I hope that he is keeping a good health. God bless him!!

I sent a certified letter today asking them to validate the debt by clearly listing the principle and interest along with the payments made thus far.

In this letter I asked that the loan not be renewed. I also stated that I would gladly send them a cashiers check/money order after their statement of validation was recieved.

I do hope that they reply, and that I am handling this correctly, so I can get this one off my plate too!

Thanks for asking about my son (he'll be 4 in Dec). He's doing alright despite being in a half-body cast. He's been diagnosed with brittle bone disease and his femur's on the mend. 5 more weeks till the cast is removed! YAY!

I think that you have done your part of the job that was required. Now, the ball is in their court and they will have to reply accordingly. If you don't get a reply, then there are legal ways to handle it.

I am feeling so sad to hear about your son. OMG! My heart really goes out for him. He is going through so much pain at such a young age. God, give him some power to come out of this pain quickly.

Take care of your son as well as yourself.

I'm HAPPY to hear that there are other people in the world like me. This website is great. I have 8 loans that keep rolling. I needed money for my daughter's dentist, then repairs on my car. I want to change bank accounts, but I'm scared that they will garnished my wages. I cant afford that. HELP!!

Welcome to the forums.

Thanks for praising the website.

Figuring your situation, I insist you to set up an effective financial plan and put things in order. You need to first analyze how much is your income for each month, what will be the expenses and then the plans towards solving your debt related problems. Remember, this will help you in getting out of your debt and this will be the best move if it can be done.

If you are not able to plan it, and are feeling turned down, you may need debt counseling.

I feel your pain, I have 11 loans out and it seems that I can not get out of the bind. However I did find a credit relief company that is helping me with the payday loans, so far most of the payday loans are excepting the fact that I am with a debt management agentcy. There is only a few (a very few) them that are giving me a hard time. Nationwide Cash is one of them, however, I should have relized this in the first place Nationwide cash told me that rejected the payment from the debt management company, well if i am not mistaken if a creditor rejects a payment they have to eat the bill.

Any way BOO I believe you may find help if you use the following debt management company

I recently got a pay day loan from Applepay.com. they took extra money out of my checking account every two weeks. i finally closed the account. i told them that i needed an adress to pay them off and they refused to give me a mailing address.

Request your bank to dispute the item with Nationwide Cash. Their must be a valid explanation of the debit done or else the excess amount needs to be reverted back. Your bank may have the contact information of Apple Payday
