Hey, for anyone in NC who is interested, I just got off the phone with the Attorney General's office and he said that payday loans are ILLEGAL in NC, period!! If you took one (or 7 like I did) out, then you are not legally obligated to pay them back a dime! You are NOT committing fraud, THEY are! They are not allowed to report it to the credit bureaus, and they cannot put out a summons for your arrest. He also said that even you feel that you should morally pay them back, you might be making it harder for yourself. They usually will not settle for part of it, they want ALL of it. Close your bank account if you haven't already and tell your bank manager about the situation, as embarrassing as it might be. The only thing they can do is call and email you all day long. Do not give in, stand your ground if you choose to try to talk to them, and do not send them any money. Change your phone number if you have to. Call your phone company and have their number blocked. Just don't send them anything and don't cave when they threaten you. They are empty threats and they cannot touch you. They are the crooks, not you. Okay, that's my spiel. I know a lot of it has already been said, but talking to him made my day!! Oh and one last piece of advice I'm sure you all know, DO NOT TAKE OUT ANYMORE!!!

is the same true for any state that pay day lending is illegal in.

Sorry, I realized I did this twice, but I'm not sure how to delete one of them. Anyways, I've been watching this forum for a few days because, like pretty much everyone else here, I have some payday loans that have been weighing on my mind and my bank account, and I finally decided to join this morning. Well technically, I finally figured out how to join this morning.

It depends on the state laws, Kashzan, but I would think it would be the same for NY, because they have pretty good laws restricting pdl's . . . . But I would contact your state's AG office and DFI to confirm.

klynch, I'm glad you got to speak with your state AG. A lot of members have a hard time with their AG. Yours sounds very helpful. And you sound so happy! That's great. I'm sure a huge weight has been lifted from your shoulders after speaking with him. Thanks for posting for others to read.

kash - To ease your mind or at least get the question off your mind, contact your state's Department of Financial Institutions. I emailed mine and got my answer. They're the best ones that can answer that question for you. And, if you're lucky, it'll have an email to contact them. Just send an email.

klynch,I just closed my account and will receive my first full paycheck in over a year. What did you say to the companies when they called you? Did they contact your employer? PLEASE HELP!! I have already rec'd some great information from moderators here. I am still nervous but getting better daily. Thanks for all the infor!!

Hi Sfate...I remember how good it was to have my paycheck all to myself that first time! A few things to remember...did you check with your bank to make sure they actually closed your account and/or can block the ach debits?? What state are you in? Most of us sent cease and desist letters asking that the ipdls contact us my email or us post. When they call you at work explain to them you can not take calls at work.You can also send complaints to your attorney general, the ftc and the bbb. If you have any questions please post them and someone will answwer for you.

I closed the account and opened a new one. I already had one phone call from one company, but I didn't answer. I bank with a state employee credit union and live in NC. I don't believe I signed any wage assignments and I read that wage assignments could not be done to individuals that work for the local government. I do, so is that true?

sfate, I'm a big believer in just covering your butt! I sent letters to every single one of my pdl's revoking any wage assignment that I may have signed. Even to the ones I know I didn't sign. I don't care. Send every one of them a revoke letter regarding wage assignment. This way, none of them will sneak up on you later on down the road and try to play their games. Don't just assume anything. These people are already operating illegally. Don't put anything past them.
