I agree with Steelers. I think the new law that is coming into effect in Ohio is great. I think they just want to make as much money as they can but they HAVE to follow the law. If you are paying what you can afford, then that is all that there needs to be done.

Now here is something crazy - with the new law that is about to be passed - they are opening a new pdl on a corner RIGHT NEXT TO ONE already there! That makes 6 in a miles radius!

I can just see myself one night so hungry, and desparate for a free pizza and I will be rushing right to them just for the free pizza, it will be worth the 300 plus percentage rate on the loan just to get that free pizza!

I'm in OH also and I just recently filed a Ch 13 BK. Nine times out of ten, it is only a civil matter, but my BK attorney did inform me that storefronts can take criminal action, such as "passing bad checks," if they can prove criminal intent. I was dealing with Checksmart also, and the collector that was always harassing me was a serious a$$hole. I was supposed to go to a court mediation with Checksmart to settle the debt, but my attorney advised me that there was no need b/c they were gonna be included in my BK.

I think it would be pretty hard to prove criminal intent. Especially if you were like me and I took out multiple loans over time with different lenders.

How can you prove criminal intent on a check that the PDL knew wasn't good when you wrote it in the firlst place? Very few people go into write a pay advance check meaning for it to bounce.

I'm really glad I found this information I too live in Ohio and I too am in this same boat. I'm freaking out trying to figure out what to do. So, if I close my checking account what can the bank do when those check bounce after the account is close, can the bank still charge me fees? And you guys are sure they have to take payments right?
